2008-2009 Rental Agreement: Terms & Conditions (revised 9/15/08) 40 Lakeland Drive, Champlain, New York 12919 Lakechamplainhouse.com – 954.925.5201 1. RESERVATION PAYMENTS: Your 25% deposit along with this signed agreement is required in order to hold your reservation. The balance of all money is due 90 days before your arrival date, including the security deposit. Failure to pay on time will result in automatic cancellation of reservation and automatic forfeit of all monies paid to date. CANCELLATION: Due to the nature of vacation rental business we cannot accept cancellations after 60 days prior to reservation. Cancellations are effective on the date written notice is received by fax or e-mail to the Owner. The following assessments will apply: A. More than 90 days prior to arrival date $100 administrative fee will be charged. B. Less than 90 days but more than 60 days prior to arrival date 50% of rent. C. 60 days and less 100% of rent. There will be a $40 additional rent charge for any unpaid, returned guest checks. CHECK-IN TIME IS 3:30 PM: Please plan to arrive no earlier than 3:30 PM, and do not come on the premises before this time. WE MAKE EVERY EFFORT TO ENSURE THE PROPERTY IS READY BUT WE CANNOT GUARANTEE. CHECK- OUT TIME IS 10:00 AM. The docks and water trampoline are in the water during summer (June – September) season only. OCCUPANCY: The Guest agrees not to exceed the occupancy allowed by this agreement as described in this Rental Agreement below. Guests and all other occupants will be required to vacate the premises and forfeit the rental fee and deposit for any of the following: A. Occupancy exceeding the stated sleeping capacity. B. Using the premises for any illegal activity includin g, but not limited to, the possession, serving or consumption of alcoholic beverages by or to persons less than 21 years of age. C. Causing damage to the premises rented or to any of the neighboring properties. D. Any acts which interferes with neighbor's right to quiet enjoyment of their property. IF, FOR ANY REASON, LAW ENFORCEMENT IS NOTIFIED DUE TO DISTURBANCES EMANATING FROM THE PREMISES OR GROUNDS, THERE WILL BE A MINIMUM $250.00 CHARGE. The property will be inspected and receive a normal cleaning after your departure. YOU ARE REQUIRED to leave the property in the same general condition in which it was received, dishes are placed in the dishwasher and the home is generally picked up and ready to be vacuumed and dusted, THE PROPERTY IS NON-SMOKING. Smoking in the property will result in an additional cleaning charge of $250.00. PENALTY FOR VIOLATIONS OF THIS AGREEMENT: If Guest violates any of the conditions or restrictions of this Agreement, the Guest agrees that the Owner of this property may terminate this Agreement and enter the premises. Upon notice of termination of the Agreement, the Guest and all invitees of Guest shall vacate the premises immediately without being entitle d to any refund of rent or security deposit. DAMAGES/SECURITY DEPOSIT: Guest agrees to surrender property in the same condition as at commencement of the rental period. Any damages include accidental breakage or damages to the property in excess of “normal wear and tear” which is deemed to be a maximum of $50.00 USD. Any damages in excess of this amount will be deducted from the security deposit. In cases of abuse and malicious damage to rental property in excess of the security deposit, Guest will reimburse Owner the amount of all damage including excessive housekeeping expenses and reasonable attorney’s fees. Security deposits paid will be refunded (less any damages) within 30 days after departure. INDEMNIFICATION OF OWNER BY GUEST: Guest agrees to indemnify and save Owners free and harmless from any claim or liability for any loss or damage whatsoever arising from, related to, or in connection with rental of the Dwelling and/or use of any or all of the properties recreations, including but not limited to any claim or liability for personal injury or damage o r loss of property which is made, incurred or sustained by any Guest or any Guest’s invitee. Guest and all Guest invitee’s will wear available life jackets and/or provide their own when utilizing dock and/or other recreations. LEASEHOLDER RESPONSIBILITIES: While there may be numerous occupants in the dwelling, only the reserving party will be held responsible by the Owner for the payment and other lease holder responsibilities enumerated in the lease. Under no circumstances shall the responsibilities or dwelling be reassigned or sublet. 2. 3. 4. 5. 6. 7. 8. 9. 10. REPAIRS/CONSTRUCTION: Even the best or newest equipment occasionally malfunctions and cannot be guaranteed 100% of the time. Lake Champlain House uses local maintenance personnel and relies on their availability. Problems are corrected as soon as humanly possible. Owners or repairman may enter the premises during business hours for any purpose connected with the repair, care or maintenance of the premises. Refunds will not be issued due to malfunctioning equipment or other related Guest dissatisfaction. 11. PETS: Only acceptable Pets (dogs only) are permitted and only with advance written notice to the owner. All dogs should be crated if left alone in the house. An additional $400 charge for each acceptable pet of which $200 will be refunded (less any damages) within 30 days after departure. Guest is responsible for cleaning up all pet waste during entire visit. Approved Pet Breed & Age: _________________________________________________________ 12. NO REFUNDS FOR EARLY CHECK-OUTS OR NO SHOWS: Guest agrees that once they have checked in to the property, no refund will be made for early check-outs. If Guest does not cancel the reservation and does not arrive for the Guest’s rental period, all monies paid will be forfeited. 13. PERSONAL PROPERTY/VALUABLES: Lock all doors when you leave your accommodations. Do not leave money or valuables unattended. Owner will not be held liable for any thefts. Thoroughly check all drawers and closets before departing. Owner only returns left behind items upon request at the Guest’s expense. 14. The Owner will provide linens/towels and cleaning service for # Guests in Party. Guests need to provide beach towels.
