THE BRADFORD ON PEACHTREE ROOFTOP USE AGREEMENT
I, the undersigned, (“Homeowner”), being the owner of unit number of The Bradford on Peachtree building located at 2161 Peachtree Road NE, Atlanta, Georgia 30309, hereby acknowledge to have received the key(s) to access the rooftop of said . Homeowner hereby agrees not to make copies of building (“Rooftop”) on / /200 said key(s). Homeowner hereby agrees to relinquish the Rooftop key(s) to the Association upon request. Homeowner hereby agrees that any person(s) accessing the Rooftop by 1) using the key(s) issued to the Homeowner; 2) invited in by the Homeowner; or 3) through a door opened or left opened by the Homeowner are to be considered guests (“Guests”) of the Homeowner. Homeowner hereby acknowledges that there are rules and regulations (“Rules”) governing the use of the Rooftop imposed and amended from time to time by The Bradford on Peachtree Condominium Association, Inc. (“Association”), in order to protect the roof and its surrounding area, to promote the safety of those enjoying the Rooftop, and to preserve the comfort of all homeowners and residents. Homeowner hereby agrees to faithfully and unconditionally obey the Rules as posted on the Rooftop or published on any other form or media by the Association. Furthermore, Homeowner accepts full responsibility for the conduct and actions of his/her Guests and their full compliance with the Rules. Homeowner hereby accepts full financial, civil, and criminal responsibility for all building or personal property damages caused by Homeowner and/or his/her Guests while on the Rooftop, including but not limited to damage to the roof membrane or tiles and cleaning of garbage left behind and outside of the designated containers. Homeowner hereby releases the Association from any and all liabilities caused by the use or the inability to use the Rooftop by him/her and/or his/her Guests. Homeowner hereby agrees to indemnify and hold harmless the Association in the event of a claim or lawsuit caused in whole or in part from the negligent acts or omissions of Homeowner and/or his/her Guests or for any other cause whatsoever, including but not limited to claims for personal injury to the Homeowner, to his/her Guests, or to any other person(s) or entity(ies) whether on the Rooftop or elsewhere. This Agreement shall be governed and interpreted in all respects by the laws and statutes of the State of Georgia as such laws and statutes are applied to agreements entered into and to be performed entirely within Georgia by Georgia residents. The venue for any action hereunder shall be in the Superior Court of Fulton County, Georgia.
