APPLICATION REQUIREMENTS: TCT will be performing a credit check based on the information provided here. The results of the credit check will determine if a deposit is required and how much the deposit will be. Full payment of deposit, if any, will be required prior to connection of service. TCT will provide, at no additional expense, all equipment,* installation and wiring** needed to support Wireless Broadband Internet service. TCT will schedule and provide a competent installer. The customer will be responsible for networking multiple computers on the service as well as equipment required for networking. Customer agrees to abide by the Acceptable Use Policy of the Company. The Acceptable Use Policy can be found at http://www.tctwest.net/acceptable_use_policy.htm. Although most customers do not require the use of a static IP address, those customers who request a static IP address agree to pay a $25.00 setup fee and $10.00 per month for the use of each static IP address requested. In addition, customers requesting static IP addresses must provide a written request with a brief explanation of the reason the address is needed. Customer will be responsible to verify ownership of the premise or provide written permission from the owner allowing installation of equipment. Five e-mail addresses will be included in the monthly price of Wireless Broadband Internet service. The customer will need to request one e-mail address (and provide password) and then will be able to self-control the additional addresses. If customer is a current TCT Internet customer, their TCT e-mail addresses will transfer to this account. Equipment: Customer understands the equipment provided by TCT remains the property of TCT and must be returned to the Company, in good condition, in the event the customer’s service is terminated, either by customer request or by TCT equipment not returned in working condition will be charged to the customer’s TCT account at replacement cost at the time of disconnect. By signing this agreement, customer gives permission for TCT to remove its equipment from the customer’s premise if service is terminated for any reason. Good surge protection and grounding are recommended and are the responsibility of the customer. Equipment provided by TCT remains the property of TCT. Any damage to the provided equipment after initial installation will be the responsibility of the customer. Customer may purchase equipment protection coverage for $1.50 per month which will cover all damage to TCT equipment. Contract Period: Customers may sign a one-year agreement resulting in a $5.00 per month reduction in the regular monthly recurring charge. After the one-year agreement period has expired, customer will remain on the system at the reduced price on a month-to-month basis. Customers requesting a disconnect for any reason, including change of residence or business location, or who have been disconnected for non-payment of services, prior to the completion of the one-year agreement will be charged the full service rate through the end of the agreement period. TCT will not be held responsible if customer moves to a location that cannot be served by its Wireless Broadband Internet service and the full remainder of the contract will be charged. Customer selecting the month-to-month option may request their service be disconnected with 10 days notice. Equipment will be removed from the customer’s residence or business within 10 days of the request for termination. Installation: ** TCT will provide up to 5-1/2 man hours for installation at no charge to the customer one time. This allotment of time will be more than adequate for most residential and business installations. Unique construction types and additional customer-requested wiring may require additional time which will be billed to the customer. The installation crew will inform the customer prior to installation if additional charges will apply. A $100 move fee will apply if a customer requires service moved to a new location (either within the same premise or to another physical location) after the initial installation by TCT. TCT charges $70 for the first hour and $50 per additional hour for service work. Customers may purchase wireless service coverage for $1.75 per month that would cover the customer in the event on-site visits are required after initial installation. I have read this agreement and agree to my Internet Service Provider’s Service Agreement and Operating Rules as defined in the Acceptable Use Policy. By signing this contract, I agree that I am at least 18 years of age and legally bound by this contract. If I am not 18 years of age, the signature below is of a parent or guardian that agrees to be held responsible for the actions of the account applicant. I also understand that I am responsible for determining that my computer and modem hardware meet the minimum requirements recommended by my Internet Service Provider and that my Internet Service Provider does not accept responsibility or liability for accounts with substandard hardware. I further agree that billing will begin on the day of activation of account in our server. Customers will be billed by mail monthly unless the customer subscriibes to online bill presentation and payment (EBPP). Customers sibscribing to EBPP will be notified by email when their bills have been uploaded to the server. Bills are rendered one month in advance. . In the case of termination of service, all unused charges will be refunded to the customer. I authorize TCT to bill my account for any charges that I may accrue from month to month. This authorization is valid until revoked in writing. I also certify that I have read the “welcome to” information provided. I further understand that my Internet account will be suspended if my account is not paid in full by the date indicated on my monthly statement. I understand that should my Internet service be terminated due to nonpayment, I may be assessed a reconnect fee. I further understand the I will receive informational emails from my Internet Service Provider periodically. I accept the free email filtering service with the understanding that it is not guaranteed to filter all junk mail or to detect all viruses. I realize that to be better protected, I should also use independent virus detection software on my computer(s). I may request the Postini service be removed from my account. There will be a service order charge to reinstate the service if desired later. Although we do offer unlimited access to our users, we do request that dial-up customers not “camp on”. Please feel free to use our service as often and as long as you need to, but when you are not accessing the Internet for browsing, downloading or e-mailing, please disconnect so our other customers may connect. We do not authorize the use of gateway connections with dial-up accounts. If you need multiple access, please contact us regarding a special circuit for Internet. If camping on and/or use of gateways persist, your dial-up account will be terminated. I further understand that email must not be left on the server and that if my mailbox exceeds 25MB, mail will not be delivered until the size of mailbox is decreased.

No Busy Signal Policy The “No Busy Signal Policy” is not a guarantee that customers will never receive a busy signal when attempting to connect to our server. The Policy simply means that we will not purposefully over sell our service causing existing customers difficulty in accessing the Internet due to lack of facilities. We monitor our modem usage closely and strive to keep our customer to modem ratio at or below 7:1. When we determine that our customer base has outgrown or will soon outgrow the number of modems available, new facilities will be ordered. It is understood that some facilities must be obtained through alternative providers such as Qwest or RT Communications. Availability and delivery dates for facilities purchased from these alternative providers may be delayed. TCT has no control over this type of facility availability. Multiple Connections Customers purchase one connection for each full account purchased. This connection entitles the customer to use one modem at a time. Customers found using multiples connections (more than one tctwest.net or tritel.net modem) at the same time will be disconnected immediately. Continued misuse of our services in this manner will result in permanent termination of service. Unlimited Usage Our offer of “Unlimited Usage” does not constitute a 24x7 connection (continuous, uninterrupted) to the Internet. The term “dial up account” means that the customer will dial up, using a modem, to access the Internet. Dial up accounts are interactive by definition, which means that the customer must be using the connection -- not merely “camping on”. When the connection is no longer needed for active Internet use, it must be terminated allowing other customers access to the Internet Service Provider’s (ISP) modems. Customers found to have been connected longer than 24 hours at a time will be disconnected. Customers may be disconnected prior to 24 hours of usage if a particular calling area (i.e. Powell exchange customers or Cody exchange customers) is experiencing busy signals due to lack of available modems. Customers connected for the longest period of time will be disconnected to allow others access to the Internet. If a customer has need of a continuous, dedicated connection to the Internet, a dedicated account may be requested. The rates for dedicated connections vary according to location and required bandwidth. Acceptable Use Policy Our Acceptable Use Policy is available on our website at www.tctwest.net.
