RESIDENCE LIVING LICENSE AGREEMENT & RESIDENCE HALL ASSESSMENT FEE The undersigned student (“Student”) and Whittier College (“College”) hereby enter into this Residence Living License Agreement (“License Agreement”) upon the following terms and conditions: COLLEGE REQUIREMENTS: All Freshmen, Sophomores and Juniors are required to live in Whittier College housing unless: 1. The student resides at his/her legal residence, defined as where the student is claimed as a dependant on the 2006 federal income tax return, and within a 25 mile radius of the college, or 2. The student is or will be 22 on or before the first day of classes; 3. The student is married. Registration: By signing this License Agreement, the Student states that (s)he is or will be, enrolled as a full-time student at the College for the term of the License Agreement. Failure of the Student to register with the College by the end of the third week of each semester shall be considered a material breach of the License Agreement, and the College may, at its sole option, terminate this License Agreement. Students who fail to enroll shall be responsible for payment of the entire amount of the License Agreement except as provided under the “Cancellation, Withdrawal and Termination” section of this Agreement. Violation of Policies: If the Student is found in violation of College policies or regulations, including those specified in the Guide to Residential Living and/or The Student Handbook, which, by this reference, is incorporated fully herein and made a part of this License Agreement, the College reserves the right to change the accommodation or terminate the License Agreement. The College also reserves the right to terminate housing for students whose actions threaten the health, safety and welfare of themselves, other students and/or the College. Students whose housing privileges are terminated are not relieved of their financial obligations under this License Agreement. TERM: The Residence Living License Agreement is a two-semester (one academic year) Agreement. It shall be in full force for the fall and spring semesters, or remaining portion thereof, although payments may be made on a semesterly basis. If the person whose name and lottery number has been used to reserve an on-campus room assignment does not assume occupancy by the first day of classes, arrives last, leaves early or does not assume occupancy for the duration of the term, that person will not be excused from abiding by the College’s residency requirement. All students who do not meet the requirements to live off-campus are required to participate in the annual room selection process. If an eligible student does not participate in room selection, a room will be assigned to the student and his/her account will be charged for the full cost of a double space and a 19 flex meal plan for the academic year. ANY STUDENT WHO MOVES OUT OF THE RESIDENCE HALL DURING THE LICENSE AGREEMENT PERIOD WITHOUT OFFICIAL WRITTEN RELEASE FROM THE DIRECTOR OF HOUSING OR DESIGNEE CONTINUES TO BE LIABLE FOR CHARGES INCURRED DURING THE LICENSE AGREEMENT PERIOD. Students must move out within 24-hours of their last final examination. The residence halls will close on May 23, 2008. Housing during vacation periods may be provided for an additional cost (listed under the “Schedule of Charges” section). Such vacation period housing may involve temporary assignments as determined by the College. Please note: Students living in housing are required to be FULL-TIME students as defined in the Whittier College Catalog of Courses, and they are also required to be enrolled in the College meal plan. Students must also be enrolled in a January course in order to live on campus during January Interim. RESIDENCE ASSIGNMENTS: The College will provide the Student with space in a College residence hall during the term of the License Agreement, except in cases where a temporary assignment may be necessary. The College agrees to process the License Agreement only after the Student and/or legal guardian has submitted a completed housing application and signed the License Agreement. In accordance with the policies contained herein, the Student will not be permitted to occupy a room prior to the official opening date or after the official closing date, except under the following circumstances: 1. Special permission may be granted by the Director of Housing or by an authorized designee of that office in writing. 2. Graduating seniors may remain on campus for Commencement activities; however, they must vacate their rooms the day following Commencement by 12:00 noon. COLLEGE POLICIES: The College will, when necessary: 1. Require the Student to move to other accommodations in order to vacate a building, floor, or wing or for other reasons as decided by the College; 2. Adjust room assignments so that when vacancies occur in a double room, the remaining resident must either consolidate with another resident at the direction of the College or pay the pro-rated cost for a single room; 3. Exercise such emergency procedures as are necessary; 4. Inspect all rooms on a semesterly basis for purposes of inventory, maintenance, safety and health factors. Students will receive advanced notification of the health and safety inspections. The College reserves the right to inspect all rooms with or without the resident being present. ASSIGNMENT FOR LICENSE: This License Agreement is not transferable and shall not be assigned by the Student. PAYMENT AND DEPOSITS: All students living on campus will be assessed an annual Residence Hall Assessment fee of $100 to offset hall damages for that academic year. If the student is not assessed any damages, the $100.00 Residence Hall Assessment fee will be applied to the student’s Business Office account. Room charges, as detailed at the end of this Agreement, are due and payable at the College’s Business Office. This License Agreement is approved and accepted by the College only when signed by the Director of Housing in the appropriate space. ● IMPORTANT ● All Residence Living License Agreements are binding for the academic year or remaining portion thereof. Such requests must be submitted in writing to the Director of Residential Life no later than July 1, 2007. The Student whose request is denied will be responsible for the financial obligations incurred pursuant to the License Agreement. The Student whose request for cancellation of the License Agreement is approved will be assessed the following amounts: Housing and Meal Plan Fee cancellation schedule Withdrawal Date During week 1 During week 2 During week 3 During week 4 During week 5 During week 6 After Week 6 Policy 100% of housing and meal plan fees will be cancelled 90% of housing and meal plan fees will be cancelled 80% of housing and meal plan fees will be cancelled 70% of housing and meal plan fees will be cancelled 60% of housing and meal plan fees will be cancelled 50% of housing and meal plan fees will be cancelled 0% of housing and meal plan fees will be cancelled If a student is suspended, dismissed, expelled or asked to leave the residence halls or College for any reason, the student is not eligible for tuition, room, board, insurance, or fee cancellation. Departure: When students move out of the residence halls, they must turn in their room key(s) and officially check out with a Residential Life staff member. Failure to do so will result in an improper check-out fine for $50 and the cost for replacement of keys and for the recoring of the room lock. THE STUDENT IS RESPONSIBLE FOR ANY AND ALL DAMAGES TO THE ROOM. Removal: Where the Student does not move out in a timely way following the termination of this License Agreement for any reason, including but not limited to violation of policy or the License Agreement, failure to register, disciplinary sanction and/or expiration of the term the College reserves the right to remove the Student from the occupied residence hall space. Damages: The College is not liable for loss or damage to property caused by fire, rain, windstorm, earthquake, theft or vandalism or other forces of nature or casualty or any cause beyond the reasonable control of the College. The College is not an insurer and expects the Student to procure appropriate insurance to protect against such losses. The Student is liable for damage in areas over which the Student has full or partial control. Damages will be billed directly to the Student’s account. All students remaining on campus during these vacation periods will reside in Wanberg Hall only. Winter Break (December 16, 2007 to January 8, 2008) Spring Break (April 2-6, 2008) Students must provide their own phone and answering machine. PROVISION OF TELEPHONE SERVICE IN THE WHITTIER COLLEGE RESIDENCE HALLS Charges and payments: Telephone service for all campus extensions, the local calling area, and certain toll free numbers is included in the Residence Hall room rate. Any charges incurred including, but not limited to, collect calls and third party billings will be billed as incurred by Whittier College. The individual who incurs these fees or charges will be liable for those costs; however, all roommates will ultimately be held equally liable for any delinquent amount that is owed.
