The regular meeting of the West St. Paul City Council was held on Monday, October 8 at 7:00
p.m. in the Council Chambers of the Municipal Center, 1616 Humboldt Avenue, West St. Paul.

Roll Call:
The roll being called, the following members were:
Present:       Mayor Zanmiller, Clpns. Tessmer, Lewis, Englin, VanMoorlehem, Iago and
               Wright.
Absent:        None.

Also Present: City Manager Arbon Hairston, City Attorney Kori Land, Police Chief Manila
Shaver, Asst. City Manager/HR Director Karen Divina, and Deputy City Clerk Diane Meissner.


APPROVAL OF AGENDA:
ON MOTION of Clpn. Wright, seconded by Clpn. Lewis, resolved to adopt the agenda
     for October 8, 2007 with the following additions: Mayor Zanmiller added First Reading –
     Ordinance Repealing Outdoor Digital Display Sign Franchise Ordinance, and Declare
     Default of Service Agreement for Indoor Advertising at Public Facilities with Media
     Holdings Group B LLC – New Business. Ayes: 6 Nays: 0

PROCLAMATIONS AND RECOGNITIONS
Employee of the Month – Karl Hoidahl, Mechanic
Mayor Zanmiller recognized West St. Paul Mechanic Karl Hoidahl as the October Employee of
the Month. He noted Karl has been a dedicated public employee for the city since 1988
maintaining the entire city fleet of vehicles and equipment while always making sure to stay
current with new technology through continuing education. Karl is truly an asset to the City.
Mayor Zanmiller presented Mr. Hoidahl with a Certificate of Appreciation and a Gift Certificate.

CITIZEN COMMENTS
None.

COUNCIL COMMENTS
Clpn. Lewis noted three upcoming events. (1) Open House at the Dakota Lodge at Thompson
Park sponsored by the County on Thursday, October 11 from 4 to 7 p.m. (2) the Annual Waffle
Feed and Bake and Craft Sale at the Thompson Park sponsored by the Senior Citizens on Sunday,
October 21, from 9 a.m. to 1 p.m. (3) Saturday, October 27th at 10:00 a.m. will be the dedication
of the Dakota County Communication Center in Empire Township.

CONSENT AGENDA
ON MOTION of Clpn. Lewis, seconded by Clpn. VanMoorlehem, resolved to adopt the
      following Consent Agenda items:

                                   RESOLUTION NO. 07-98

          RESOLUTION SETTING ANNUAL ESTIMATED COST PER ACRE FOR
                  PARK DEDICATION FEES FOR THE YEAR 2007

WHEREAS, Section 15.11(2) of the Parkland Dedication Ordinance requires the City Council
    to establish an annual estimated cost per acre for Park Dedication fees; and

WHEREAS, Park Dedication fees on business and industrial property must be determined on the
    fair market value per acre of undeveloped commercial/industrial land in the City; and

WHEREAS, staff has researched undeveloped commercial/industrial land within the City and
    was unable to find any that were sold this year. The most recent sale of undeveloped
    commercial/industrial land is the vacant Heimies Clothing site at 1510 South Robert
    Street which was sold in 2006. The current land value for this 0.46 acre property as listed
    on the Dakota County website is $250,000.

NOW, THEREFORE, BE IT RESOLVED, that based on the above criteria, the City Council of
     the City of West St. Paul sets the estimated cost per acre of undeveloped
     commercial/industrial land at $543,000 per acre for the year 2007.

PUBLIC HEARING/FINAL READING/ORDINANCE AMENDING THE WSP CITY
CODE, SECTION 1140 REGARDING PEDDLERS, SOLICITORS AND TRANSIENT
MERCHANTS
The Mayor announced to the public that this Public Hearing will be continued to the Council
meeting on October 22, 2007.

ON MOTION of Clpn. Tessmer, seconded by Clpn. Iago, resolved to CONTINUE the
  Final Reading of an Ordinance Amending the West St. Paul City Code, Section 1140
  Regarding Peddlers, Solicitors and Transient Merchants to the Council meeting scheduled
  on October 22, 2007. Ayes: 6 Nays: 0


RESOLUTION AMENDING THE FEE SCHEDULE TO ADD SOLICITOR AND
REGISTRATION FEE
The Mayor noted that this Resolution is related to the previous Public Hearing and is also to be
continued to October 22, 2007.

ON MOTION of Clpn. Wright, seconded by Clpn. Tessmer, resolved to CONTINUE the
  Resolution Amending the Fee Schedule to Add Solicitor and Registration Fee to the
  Council meeting scheduled on October 22, 2007. Ayes: 6 Nays: 0


FIRST READING/AN ORDINANCE AMENDING THE WSP CITY CODE, SECTION
1200 REGULATING INTOXICATING LIQUOR LICENSES
City Attorney Land indicated that the 2007 Legislature authorized cities to increase their off sale
intoxicating liquor license fees from $200 to a maximum of $380. However, regardless of what
fee the City has, they also allowed the off sale liquor license establishments a $100 reduction in
their license fee if they provide certain things, such as providing employee training, posting a
policy, and providing an incentive program which rewards or punishes employees for following
the age guidelines. This Ordinance amendment also provides an opportunity to require licensees
to use age verification devices within 60 days after their license approval. If this Ordinance is
passed on First Reading, a Final Reading will occur on November 13th after all the current off sale
license holders are notified of the Amendment increasing the fee.

Clpn. Tessmer asked what the current license fee is and if the plan is to increase it to $380?

Attorney Land replied, the current fee is $200 which was the maximum previously allowed by the
State. It is proposed to increase the fee to $380, but they could get a $100 deduction for meeting
the criteria and the fee would then be reduced to $280.

Clpn. Tessmer asked how much the age verification machine costs, and Police Chief Shaver
replied that it varies but many of the cash register systems used already have it built into their
software system.

Clpn. Tessmer liked the idea but was concerned we would reduce the fee by $100 if they spend
$2,000 for the machine. Would every register have to have the technology?

Clpn. Wright noted that usually they would purchase one program but it would run on all the
connected registers.

Police Chief Shaver suggested he could research some of the questions asked by Clpn. Tessmer,
and give him some answers later in the week.

ON MOTION of Clpn. Wright, seconded by Clpn. Lewis, resolved to pass First Reading of
  An Ordinance Amending the West St. Paul City Code, Section 1200 Regulating
  Intoxicating Liquor Licenses. Current intoxicating liquor license holders will be
  notified 30 days prior to Final Reading on Tuesday, November 13, 2007. Ayes: 6 Nays: 0


FIRST READING/ORDINANCE REPEALING ORDINANCE NO. 07-10, OUTDOOR
DIGITAL DISPLAY SIGN FRANCHISE ORDINANCE WITH MEDIA HOLDINGS
GROUP B LLC

City Attorney Land stated that there have been many provisions in the Outdoor Digital Display
Sign Franchise Ordinance that the franchisee has not met and several provisions that are currently
in default that the franchisee is aware of. Legal council is recommending that an Ordinance be
passed repealing that Ordinance, holding a public hearing and final reading after it has been
published.

ON MOTION of Clpn. Englin, seconded by Clpn. Tessmer, resolved to pass First Reading of
  Ordinance No. 07-10, Outdoor Digital Display Sign Franchise Ordinance with Media Holdings
  Group B LLC. Ayes: 6 Nays: 0


DECLARE DEFAULT OF SERVICE AGREEMENT FOR INDOOR ADVERTISING AT
PUBLIC FACILITIES WITH MEDIA HOLDINGS GROUP B LLC

City Attorney Land stated the Service Agreement for Indoor Advertising at various municipal
facilities is in default in several of the provisions. Legal counsel is recommending the Council
authorize staff to declare the Agreement in default; give them the proper notice so they have an
opportunity to appear, and if they don’t, the Agreement would be declared null and void.

ON MOTION of Clpn. Englin, seconded by Clpn. Tessmer, resolved to declare the Service
  Agreement for Indoor Advertising at Public Facilities with Media Holdings Group B LLC, in
  default.  Ayes: 6 Nays: 0


ADJOURNMENT
ON MOTION of Clpn. Lewis, seconded by Clpn. Tessmer, resolved to adjourn the regular
     City Council meeting of October 8, 2007 at 7:15 p.m. until it reconvenes for the
     Regular Council Meeting to be held on Monday, October 22, 2007 at 7:00 p.m. in the
     Council Chambers of the Municipal Center, 1616 Humboldt Avenue.
