Area/s affected:
The amendment applies to land known as112-126 Old Warrandyte Road and 35 Illawong Drive,
Donvale.
The land comprises a 20 hectare property, situated approximately 23 kilometres east of Melbourne,
generally bound by Old Warrandyte Road to the north, the western bank of the Mullum Mullum Creek
to the east, Berrima Road to the south and Kern Place, Mullum Drive and Illawong Drive to the west.
General Description (including need for the amendment):
The amendment sought to rezone the land from a Low Density Residential Zone (LDRZ) to a
Residential 1 Zone (R1Z) to facilitate the subdivision of the subject land into 56 lots. The amendment
also sought to provide for a more appropriate environmental planning outcome by incorporating a linear
park along the western side of the Mullum Mullum Creek, which was to be transferred to Council. It
also proposed to incorporate design controls, including the provision of building envelopes on each lot
to guide the future subdivision and development of the site. Such controls sought to ensure that
existing and future vegetation is adequately accommodated on site.
Specifically the amendment proposed to:
    •    Rezone the land from Low Density Residential to Residential 1 for the land contained in the
         proposed subdivision;
    •    Rezone the land from Low Density Residential to Public Conservation and Resource for the
         land proposed to be transferred to Council as an open space reserve;
    •    Rezone the land from Urban Floodway to Public Conservation and Resource;
    •    Remove the Heritage Overlay from the land;
    •    Apply a new Design and Development Overlay to the land, which relates to subdivision and the
         number of dwellings;
    •    Apply a new Significant Landscape Overlay schedule to the land in the place of Schedule 1;
         and
    •    Extend the Environmental Significance Overlay 2 over the whole of the land proposed to be
         transferred to Council as an open space reserve.
Concurrent to the preparation of a planning scheme amendment, an application for planning permit (TP
14575) was been made under section 96A(1) of the Planning and Environment Act 1987, which
proposed to subdivide the land into 56 lots.

Exhibition Process:
Prior to Council seeking authorisation to prepare the amendment an information session about the
proposal was conducted with surrounding residents on 3 May 2007. Approximately 90 people attended
this session
Following Council’s resolution to abandon the amendment, 340 letters were sent out to surrounding
residents, advising them of Council’s resolution.

Status
Council resolved to abandon amendment at its meeting on 25 September 2007.
