         EXECUTIVE SUMMARY: The attached proposed ordinance augments and clarifies the process for establishing
         Community Development Districts (CDDs) in Alachua County.

         BACKGROUND: On January 10, 2005, the Board of County Commissioners approved authorization to advertise
         an ordinance for the establishment of CDDs in Alachua County. The ordinance adoption hearing was duly
         advertised by newspaper publication on January 13th. CDDs are independent district units of local government
         created for the limited purpose of financing and managing basic community development services within the CDD
         boundaries. The Uniform Community Development District Act of 1980, Florida Statutes Chapter 190, constitutes
         the sole authorization for establishing CDDs in Florida, and provides a uniform process and criteria that include
         filing of a petition and fee; legal description of boundaries; written consent by all owners of land within the
         boundaries; designation of the initial board of supervisors; and public hearings.

         Though it appears that a local enabling ordinance is not necessary to implement the Uniform CDD Act, several
         Florida Counties have chosen to adopt ordinances to augment and clarify procedures, particularly in regard to
         filing requirements. The attached proposed ordinance is abbreviated and adapted from the City of Jacksonville’s
         ordinance, which was recommended as a model by several attorneys with expertise on the subject of CDDs.

         ISSUES: Should the County adopt an ordinance to augment and clarify the process for establishing CDDs in
         Alachua County?
