EXECUTIVE SUMMARY:
Staff requests authorization to advertise an ordinance to amend the Sugarfoot Oaks/Cedar Ridge Neighborhood
Preservation and Enhancement District Ordinance to correct and update the legal description and
population/household figures for the District.
BACKGROUND:
On October 23, 2001, the Board adopted an ordinance to create the Sugarfoot Oaks/Cedar Ridge
Neighborhood Preservation and Enhancement District. The purpose of the attached ordinance is to correct
certain scrivener’s errors in the legal description of the District, which incorrectly identify the various subdivisions
within the District. In addition to this correction, the legal description has been updated to include replats within
the District.
ISSUES:
Should the Board authorize advertisement of an ordinance pertaining to the Sugarfoot Oaks/Cedar Ridge
Neighborhood Preservation and Enhancement District.

ORDINANCE 03-
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF ALACHUA
COUNTY, FLORIDA, AMENDING CHAPTER 71 OF THE ALACHUA COUNTY CODE OF
ORDINANCES RELATING TO THE NEIGHBORHOOD PRESERVATION AND
ENHANCEMENT DISTRICT FOR SUGARFOOT OAKS, SUGARLANE, AND CEDAR
RIDGE SUBDIVISIONS; AMENDING SECTION 71.02.03, STATEMENT OF BOUNDARIES,
SIZE, AND POPULATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR
INCLUSION IN THE CODE; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Board of County Commissioners of Alachua County, Florida, under the
provisions of Chapter 163, Part IV, Florida Statutes on October 23, 2001 adopted an ordinance 01-24
creating a Neighborhood Preservation and Enhancement District for Sugarfoot Oaks, Sugarlane, and Cedar
Ridge subdivisions; and,
WHEREAS, the Board of County Commissioners wishes to correct a scrivenor’s error and
update the legal description of said District to reflect recent replats,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
ALACHUA COUNTY, FLORIDA:
Section 1. Section 71.02.03, Statement of Boundaries, Size, and Population, is
amended in its entirety to read:

This District includes the Sugarfoot Oaks, a subdivision as recorded in the Alachua
County Official Records in Plat Book K, Page 32 J, page 66 of the Official Records of Alachua
County;, the Sugarfoot Oaks Unit 2, a subdivision as recorded by the Alachua County Official Records
in Plat Book K, page 91 32 of the Offical Records of Alachua County; , Sugarfoot Oaks Unit 3, a
subdivision recorded in Plat Book K, page 91 of the Offical Records of Alachua County; the Sugarlane,

a subdivision as recorded by the Alachua County Official Records in Plat Book K, page 84 of the
Official Records of Alachua County; , Sugarlane Replat recorded in Plat Book L, page 80 of the
Official Records of Alachua County; Sugarlane Replat 2 recorded in Plat Book M, page 9 of the Offical
Records of Alachua County; and the Cedar Ridge, a subdivision as recorded by the Alachua County
Official Records in Plat Book M K, page 19 8 of the Official Records of Alachua County; Cedar Ridge
Addition 1 recorded in Plat Book K, page 80 of the Official Records of Alachua County; Cedar Ridge
Addition 1 Replat recorded in Plat Book L, page 83 of the Official Records of Alachua County; and
Cedar Ridge Villas recorded in Plat Book M, page 19 and Plat Book K, page 8 of the Official Records
of Alachua County. The District consists of approximately sixty-five (65) 72.7 acres and
approximately two thousand (2,000) people comprising approximately twelve eight hundred (1,200 800)
households.
Section 2. Severability. It is the declared intent of the Board that if any section, subsec-
tion, sentence, clause, phrase, or provision of this ordinance is held invalid or unconstitutional by a
court of competent jurisdiction, such invalidity or unconstitutionality shall not be so construed as to
render invalid or unconstitutional the remaining provisions of this ordinance.
Section 3. Inclusion in the Code, Scrivener’s Error. It is the intention of the
Board of County Commissioners of Alachua County, Florida, and it is
hereby provided that the provisions of this ordinance shall become and be
made a part of the Code of Laws and Ordinances of Alachua County,
Florida; that the sections of this ordinance may be renumbered or relettered
to accomplish such intention; and that the word “ordinance” may be
changed to “section,” “article,” or other appropriate designation. The
correction of typographical errors which do not affect the intent of the
ordinance may be authorized by the County Manager or designee without
public hearing, by filing a corrected or recodified copy of the same with

the Clerk of the Circuit Court.
Section 4. Effective Date. A certified copy of this ordinance shall be filed with the
Department of State by the Clerk of the Board within ten (10) days after
enactment by the Board, and shall take effect upon filing with the
Department of State.
DULY ADOPTED by unanimous vote of the Board of County Commissioners
in regular session, this day of , A.D., 2003.

NOTICE IS HEREBY GIVEN that the Board of County Commissioners of Alachua
County, Florida, will consider the adoption of an ordinance at its meeting to be held in Room
209 of the Alachua County Administration Building, 12 Southeast First Street, Gainesville,
Florida, on the 11th day of February, A.D., 2003, at 6:00 o'clock p.m., or as soon thereafter as
the matter may be heard. Said ordinance being titled:

The proposed ordinance is available for review at the Office of the County Commission,
second floor, Alachua County Administration Building, 12 S.E. First Street, Gainesville, FL.
All persons are advised that, if they decide to appeal any decision made at this public
hearing, they will need a record of the proceedings and, for such purpose, they may need to
ensure that a verbatim record of the proceedings is made, which record includes the testimony
and evidence upon which the appeal is to be based.
