Complying Development
Albury Local Environmental Plan 2000

Definition – Complying Development is development that requires approval from council, but
approval is guaranteed if the set of predetermined criteria are satisfied.

Note: This sheet is to be provided with any application for a Complying Development Certificate and
must demonstrate compliance with the following:



I understand that all forms of complying development MUST comply with the following conditions and
that I confirm that my proposal is consistent with each and every condition.


The proposal:
      Must comply with the deemed-to-satisfy provisions of the Building Code of Australia 1996
      relevant to the development.
      Must be local development of a kind that can be carried out with consent on the land on which
      it is proposed, and it is not an existing use as defined in Section 106 of the EP&A Act.
      Must not contravene any condition of a development consent applying to the land.
      Will require Local Government Approval to be obtained from Council for any water or sewer
      work involved.
      Must be clear of any easement, public sewer, water main or stormwater main, or the zone of
      influence of a public sewer, water main or stormwater main.
      Must not be carried out on a heritage item or on land that is the site of a heritage item.
      Must not involve use of a relocated dwelling, caravan or kit home.
      Must not be carried out on land in the flood referral area.
      Must not be carried out on land in a bushfire prone area.
      Must not be carried out on land within 400m of the banks of the Murray River.
      Must not be carried out on land within the Doctors Point, Lyne Street, Corry’s Road and
      Allambie Road areas or on land within the primary tip buffer area.
      Must not require a tree (4.5m in height and 3m spread) to be removed unless the prior
      approval of the Council has been obtained.
      Must not be carried out on land that is contaminated (Consult with council to confirm).
      Must not use reflective untreated surfaces or reflective galvanised iron or zincalume roofing
      material.
      Must not be built or constructed to the property boundary (No zero Lot lines).
      Must not be carried out on land used for the purposes of a shop or commercial premises in
      which restricted publications, within the meaning of the Classifications Enforcement Act 1995
      are exhibited, sold or available to the public.
      Must not be used for the purposes of a brothel or for the administration of tattoos.

The commercial use involves:
                                                                                      Yes   No    N/A
A different use of a building resulting from a change of its use from one kind of
shop, office or commercial premises to another.
Located within the Regional Centre Zone or District Centre Zone only.
Alterations and internal fit-outs do not add additional gross floor space to the
building.
Does not involve footpath seating unless Council’s prior approval has been
obtained.
Does not involve external alterations or shop front alterations.
Any food shop complies with the Council’s food standard code for food premises.


If the answer is YES or N/A to all of the above questions then the proposed development is deemed
to be complying.

I confirm that the attached plans and specifications are consistent with all of the above conditions
(general & specific) and that it is my responsibility to ensure the development complies with the
above and any conditions that may be attached to the Complying Development Certificate (CDC)
