Understanding the Montana Driving Record
Preface
This document provides detailed information about a Montana Driving Record. While drivers typically refer to the compilation of their driving history as a driving record, over the years, insurance companies, law enforcement, the courts and others have come to refer to the driving record as a motor vehicle record or MVR. Throughout this document, the terms driving record, motor vehicle record and MVR are therefore used interchangeably. The Motor Vehicle Division also maintains vehicle histories, which include a vehicle's registration, odometer and title history. This information relates to a vehicle rather than a driver and is also referred to as a motor vehicle record. You can request this type of motor vehicle record using the Release of Motor Vehicle Records form, MV 210.

What information is included in a Montana Driving Record?
A Montana Driving Record, also known as a Motor Vehicle Record (MVR), consists of information that is assembled by the Motor Vehicle Division of the Montana Department of Justice. Five major categories of information are compiled:

personal history information; licensing information; convictions for offenses regulating the operation of motor vehicles; driver improvement / corrective action records; and accident history.
The Montana Driving Record preserves important personal history information about a driver who has applied for a license. The record also includes details about the driver license examination process; the subsequent issuance, denial, cancellation, suspension, revocation or surrender of any motor vehicle operator’s license; driver performance; and any regulatory processes that have been enacted by the Motor Vehicle Division in response to unsafe driver performance or other requirements of Montana law. All of these records are gathered, retained, utilized and disclosed for the primary purpose of authorizing, promoting and regulating safe, legal operation of motor vehicles on Montana highways. Personal history information includes the individual’s true full name, address information, date of birth, social security number, any current or prior driver’s license number, sex, height, weight, eye color, hair color and photograph. Some categories of information (address, social security number, photograph and medical records) are protected and are deemed under the law to be highly restricted personal information. Highly restricted personal information is only disclosed to others under tightly regulated circumstances that are specifically authorized or required under the law. Licensing information includes the class of the license(s) applied for and/or issued, driver license restrictions, endorsements, license status, and expiration date. To establish and document driver performance, the Montana Driving Record also includes details about court reported convictions for motor vehicle-related offenses and traffic accidents occurring in conjunction with a conviction for violations deemed to be causally related. The record includes details about driver improvement / corrective actions that have been implemented in accordance with conviction reports or judicial orders. Driver improvement actions may include driver control requirements (for example, courtordered imposition of breath alcohol ignition interlock restrictions); court ordered suspensions for failure to appear, comply or pay fines; proof of financial responsibility; the amount or status of license reinstatement fees; and any other regulatory or enforcement actions that have been implemented as a result of a statutory requirement or an order from a court. All of this information is recorded and maintained in a manner that is consistent with state and federal law, all applicable regulations, standards and administrative systems that have been set up to ensure quality assurance and reciprocity between states. These systems include the National Driver Register (NDR), the Problem Driver Pointer System (PDPS) and the Commercial Drivers License Information System (CDLIS).

Why is a Motor Vehicle Record so complicated?
Comprehensive records always contain a great deal of information, and because a Motor Vehicle Record is compiled over the lifetime of a driver, information appears on the record in a wide variety of formats and styles. Codes, abbreviations and system-generated references have changed over time, yet they may be retained within the record. Such changes alter the content and appearance of a current Motor Vehicle Record. Over a period of many years, laws may change. Changes occur as a result of legislation but also as a result of court cases and judicial rulings. Prior laws and the associated legal references may or may not be negated from a Motor Vehicle Record. Old references are oftentimes saved in old formats. Computer systems have evolved over time, too. Old systems supported ways of doing business that may seem archaic today. While software and hardware have improved dramatically, old entries may still appear in the same format that they were originally entered in. Finally, a Motor Vehicle Record for a driver who is licensed in Montana is comprised of information provided by a variety of sources. In Montana, District Courts or Courts of Limited Jurisdiction may provide conviction information. Information may come from tribal courts, courts in other states, other state Departments of Motor Vehicles, even from agencies in other countries. Information may be added to a Motor Vehicle Record via submission of paper documents or receipt of electronic information received via the Commercial Driver License Information System (CDLIS). Whenever sources and reporting formats vary and a large volume of information is retained for a long period of time, the resulting record can appear complicated and difficult to decipher or understand. The information contained within this glossary is provided in an effort to increase understanding and standardize interpretation. It’s been three years since my last traffic ticket. Why do conviction entries older than three years still appear on my Montana Driving Record?
Myth Once 3 years pass with no new traffic violations, a driver has a “clean” driving record. Reality Your driving record is a lifetime record. Traffic convictions stay on your driving record for life. Montana law restricts how some aspects of a driving record may be utilized or applied. For example, in accordance with Montana Code Annotated § 33-18-210 (9), conviction information older than three years that is derived solely from a driving record may not be used to affect your insurance rates or insurance eligibility. Conviction points – the points associated with habitual traffic offender designation – only apply for three years between the dates of prior and most recent convictions (Montana Code Annotated § 61-11-203).

Understanding the Montana Driving Record However, convictions for Driving Under the Influence of Alcohol or Drugs (DUI) will affect your driving record for five years between the date of the prior offense and the date of the most recent offense (Montana Code Annotated § 61-5-208 (2) [c]). Every conviction for a prior DUI or breath alcohol concentration violation will contribute to an individual’s lifetime count, especially if a prior offense occurred while the driver was operating a commercial motor vehicle. A fourth or subsequent conviction over the lifetime of a driver - no matter what type of motor vehicle was being operated at the time of the violation - may be charged as a felony offense. Your driving record is for life. All of the information on your motor vehicle record remains part of your permanent record.
Who gets to see my Motor Vehicle Record?
Under Montana law, a Montana Driving Record may be released upon request as authorized in accordance with the terms and provisions of the Montana Driver Privacy Protection Act and the “Release of Driving Records” form required by the Motor Vehicle Division. Motor Vehicle Records are most often requested by employers and insurance companies. The primary statutes controlling the release of driving records in Montana are found in Title 61 Part 11 Montana Code Annotated. The information released when a Motor Vehicle Record is disclosed does not include driver address, social security number, photograph, medical information or previous driver license number. A Certified Driving Record is derived from the same body of information but the record is verified and endorsed in a manner that is designed to meet rules of evidence, the needs of local prosecutors, prospective employers, insurance companies or other entities making an official request. The Additional License Information field is included as a component of a Certified Driving Record, however, previous driver license / identification card numbers are not disclosed unless a specific request is submitted by a governmental agency performing an official function and the request is approved by the Motor Vehicle Division. Disclosure of a Motor Vehicle Record may be made in response to law enforcement requests. Such requests may be submitted either manually or electronically via the Montana Department of Justice Criminal Justice Information Network (CJIN). Any response to a law enforcement request will always include address information (including address history). The Additional License Information field and all previous driver license and/or identification card numbers are also disclosed to law enforcement. In addition, law enforcement agencies submitting official requests may access driver photographs and original copies of signed applications. In accordance with the Montana Driver Privacy Protection Act, the identity of a requestor approved to receive a Motor Vehicle Record is recorded electronically, usually via correspondence entries associated with the affected driver’s file. The Motor Vehicle Division retains original paper copies of signed records release forms for three years following the date of disclosure of the record.

What does it mean when a driver license is suspended, revoked or cancelled?
These terms apply to a driver’s license or a driver’s privilege to operate motor vehicles on highways. In accordance with the definitions found in Montana Code Annotated, the terms have the following meanings: "Suspension" means that the driver's license and privilege to drive a motor vehicle on the public highways are temporarily withdrawn, but only during the period of suspension. Once the requirements of the suspension have been met (i.e. time periods, chemical dependency treatment, court requirements, reinstatement fees, etc.), a driver license may be reinstated without required written or road tests. "Revocation" means that the driver's license and privilege to drive a motor vehicle on the public highways are terminated and may not be renewed or restored. An application for a new license may be presented and acted upon by the department after the expiration of the period of the revocation; however, applicants must meet all requirements, pay all fees and take all tests required for a new license. "Cancellation" means that the Motor Vehicle Division may cancel a driver's license if it has reasonable grounds to believe that the licensee was not entitled to the issuance or that since the issuance, the licensee has become ineligible. A license may also be cancelled if the licensee fails to give the required or correct information in the licensee's application or commits any fraud in making the application. An applicant for a commercial driver’s license who fails to give the required or correct information or commits any fraud in making the application is disqualified from operating a commercial motor vehicle for a period of 60 days from the date of the cancellation. Once the requirements of the original cancellation have been met, the driver will be required to reapply for a new license.
What does it mean when the Motor Vehicle Record states “History not on file”?
When the notation “History not on file” appears on a Motor Vehicle Record, it means that corresponding information has not been received or recorded by the Motor Vehicle Division. This notation does not imply that corresponding information does not exist within similar records and files that may be retained elsewhere by other agencies or other jurisdictions. For example, a record of a traffic accident may be retained by the Montana Highway Patrol yet not be recorded on a Motor Vehicle Record. Even today, between all agencies and all jurisdictions, all applicable records are not yet fully integrated. A Motor Vehicle Record serves as an aggregated record for a specific driver. As such, the record attests to the integrity of the information that has been entered. In regards to any notation that states “History not on file”, the record cannot attest to the integrity of information that is absent, and no such conclusions can be drawn.

Understanding the Montana Driving Record In fact, it is possible for a driver to hold a valid Montana driver license, yet be suspended or revoked in another state. Laws are not always consistent between States. Montana law prohibits issuance of a driver license to a driver who is ineligible according to the National Driver Register (Montana Code Annotated § 61-5-105). But the law does not always permit withdrawal of a previously issued driver license if the licensed driver later becomes ineligible and the Montana license has not expired. Yet under Montana law, it is a violation for a person to drive when their driver license has been suspended or revoked in this state or any other state. Resulting interpretations can be confusing to say the least. Records requestors who are unsure about the status, accuracy or completeness of any Motor Vehicle Record should contact Records and Driver Control Bureau at (406) 4443289 for further clarification.

How do I access an Motor Vehicle Record?
The public can request their own driving record, or under authorized circumstances as defined in the Montana Driver Privacy Protection Act, the driving records of others, once the required Release of Driving Records form has been completed and submitted with the appropriate processing fee and a self-addressed, stamped envelope. The Release of Driving Records (Form 34-0100) is available at the following website: www.doj.mt.gov/driving/forms.asp This form must be notarized or you must attach a copy of your state or government issued photo identification, such as a driver’s license, identification card, or passport. The photo identification cannot have been expired more than four years. Fees:

OTHER FIELDS ON AN MVR COMMERCIAL DRIVER LICENSE CLASS – ENDORSEMENT – RESTRICTION FURTHER EXPLANATION MULTI UNIT – CLASS A CDL SINGLE UNIT – CLASS B CDL UNDER 26000 – CLASS C CDL Some restrictions affect a CDL holder’s entire license, for example, “No Airbrake” - may not operate air brake or air brake/combination equipped vehicles. Some CDL restrictions may interact with one or more aspects of the CDL holder’s Class / Type / Endorsements, for example, “Type 2 Unless Subject to 391 FMCSR”. SPECIAL DRIVER LICENSE RESTRICTIONS ENTERED AS TEXT Special restrictions may be entered as free text. For example, some of the text restrictions that may appear on an MVR include: Class B while transporting passengers or Contact lens in right eye only. Text entries are displayed with preset tab delimiters required by the computerized Driver Control System. Tabs may inappropriately segment a text entry and make it hard to read. To properly interpret the special restriction, ignore these extra spaces. This field appears on some versions of a Motor Vehicle Record and indicates that prior records existed in different forms: i.e. prior driver license; license of another type; prior driver license number, identification card, etc. “Record Only” entries are sometimes (but not always) an indicator that a MT record was created before a MT license was applied for or issued. For example, a serious conviction may trigger creation of an MVR even though no Montana license has ever been issued. Individual line entries may also be qualified by “type”, i.e. name type. These fields add date parameters to information listed under the “Driver Improvement Actions:” portion of the MVR. Driver Improvement Begin Date establishes commencement of the action as listed (suspend – revoke – cancel). Driver Improvement End Date states the date when the withdrawal action expires, although a driver is not eligible to be re-licensed until a Restore Date (other than 00-00-0000) is entered to indicate the actual date of driver license reinstatement. Dates entered as 99-99-9999 indicate an indefinite action whereby expiration of the action must be triggered by a separate required event, i.e. meeting a court requirement or paying child support, etc. The “Accidents:” field of an MVR depicts accident history, if any has been recorded, and the field includes the accident number assigned by the Montana Highway Patrol, the accident date, accident time, accident severity and conviction number for the violation deemed causally related to the accident. Accident history was temporarily suspended in 2002 due to insufficient / inaccurate data transfers but record entries are expected to resume.
