SERVICE AGREEMENT & GENERAL RELEASE

THE PARTIES HERETO AGREE AS FOLLOWS: 1. This Agreement for cat-sitting services is entered into this ______ day of ______________, 20____ by and Between Beaverton Cat Sitting, hereinafter referred to as BCS, and ___________________________________, hereinafter referred to as Client. 2. The initial term of this Agreement shall be for ____________ visits, from __________________________ to . 3. Following the initial term, this Agreement will continue on an as-needed basis until the Agreement is terminated by either party, as provided hereunder. 4. Fees are __________________________ per visit, payable in full upon completion of contracted services. 5. Client hereby releases, disclaims and acquits BCS from any and all claims, action, suits, demands and liabilities (other than those resulting from gross negligence or willful misconduct) both at law and at equity arising during the dates of service set forth above. Client further agrees not to hold BCS liable for any acts of God over which BCS has no control such as flooding, earthquakes, tornadoes, fire or other natural disasters including acts of terror or forced entry of home or for the death of the pets named to be cared for, due to natural causes or an act of God. 6. Client agrees to take reasonable and prudent steps to prevent entry to the property and its dwellings where pets will be housed by all parties not specifically known and agreed to by BCS during the dates of service set forth above. BCS assumes no responsibility for clients home and/or pets if client authorizes any party other than BCS entry to their home during the period of this agreement. Client understands and agrees that BCS is not responsible for the health and/or well-being of any pets having access to leave the confines of clients house and/or property. If veterinarian care is deemed necessary by BCS and such timely care is unavailable from the clients referred veterinarians, client releases BCS to seek comparable care from a veterinarian of their choice. 9. In the event a veterinarian determines that clients pet is terminal and life saving measures are not recommended and client cannot be readily reached for their approval, client hereby grants full and complete authority to BCS to have their pet humanely euthanized by clients veterinarian or a comparable veterinarian of BCS’s choice should the clients veterinarian be unavailable. Client further agrees to release the veterinary facility and BCS from any and all liability for so euthanizing said pet. Clients initials___________________. 10. BCS agrees to provide the services stated in this Agreement in a reliable, timely, trustworthy and professional manner. In consideration of these services, and as an express condition of their provision, Client agrees to be fully bound by all the terms and conditions hereof. 11. BCS reserves the right not to perform under the terms of any Agreement if its officers, employees or contractors become concerned about their personal safety. In this unlikely event, Client will be immediately notified if any scheduled visit does not take place and charges for the unfulfilled portion of this Agreement will be refunded or forgiven. 12. Client is the owner of the home and or pet, or has been authorized to arrange for its care. Client has read and fully understands the terms and conditions of this Agreement.
