Coverage Effective Date: This application does not provide coverage until received and marked accepted by Eagle Warranty Corporation (hereafter cited as "Eagle") at its office. Neither the auto dealer nor any other person has the authority to effect coverage or alter the terms of this contract. If you have not received written acceptance of this contract from Eagle, you must not assume you have coverage. Should you have any questions regarding coverage you must call Eagle customer service at the above toll free number. Once in effect, this contract can be renewed by Eagle's receipt of the renewal fee no later than the last date of the term selected. Claim Procedure: You must take the vehicle to a repair center capable of performing the repair. Owner is responsible for all costs relating to diagnosis and any tear down requested by EAGLE to allow EAGLE to verify the cause of the condition. If upon EAGLE'S inspection, the vehicle is not properly torn down to allow full diagnosis, owner shall be responsible for any reinspection costs. It is then your responsibility to ensure that the repair center notifies EAGLE at 1-800-735-2529 prior to beginning any work. If EAGLE is able to verify that a covered component has failed under the terms of this service contract, EAGLE will issue an authorization number explaining to the repair center exactly what, and to what extent is covered by EAGLE. EAGLE reserves the right to have the repair done elsewhere where EAGLE determines that a covered repair can be done at a lesser expense or by a more capable facility. Failure to comply with our claim procedure will result in the claim being voided. All claims must be reported prior to the expiration of this service contract. No claim will be paid without a prior authorization number issued.
Power Train
The 90 / 90 Power Train Service Contract application if accepted is to provide reimbursement for the repair and/or replacement of the failed covered components with components of like or equal value and will remain in effect for as long as the term indicated. Obligations of the provider under this service contract are backed by the full faith and credit of EAGLE. By signing this application, you acknowledge that you have read the same and that you understand and agree to all terms of this service contract (including all terms on this page and the reverse side) and further that this contract if accepted by EAGLE is between you and EAGLE with EAGLE not being bound by any act, omission or representation of the dealer or any other party.

To Obtain Reimbursement: After your repair center has received an authorization number, and your vehicle has been repaired, you must submit the work order / receipt with the authorization number clearly marked on the bill to EAGLE at the address listed above. Within 15 business days from the date of arrival of your bill in our office, your reimbursement check is to be mailed. All authorized work orders must be in our office within 90 days from issuance of the authorization number. After the 90th day, any authorized bills that have not been received will become invalid and that authorization number will have expired.
You further agree that to the best of your knowledge all information filled in has been stated correctly and completely. There is no credit for early termination. Please see reverse side for important state required disclosures regarding NY, SC, TX, AND WV CONTRACTS. This contract, if accepted by EAGLE shall be interpreted and subject to the laws of the state where the sale of the vehicle took place, regardless of where a claimed breakdown occurs.

What is covered? No sales tax on repairs and no component, cost or service is covered by this contract other than those itemized below.
Engine Components:
Services cover ed under this service contract:
Engine: Seals and gaskets are covered ONLY in conjunction with a covered repair. All internal lubricated parts located within the engine block along with any engine block, oil pump, and oil pan failure caused by any such part. Intake manifold, Head gasket and manifold gasket are covered for coolant leaks only.
Towing: Towing charges will be reimbursed up to $50.00 (fifty dollars) in the result of a failed covered component. Labor: Labor rate is set at the current industry accepted rate to replace or repair any covered component and not to exceed $50.00 per hour.
Transmission Components:
Transmission: Seals and gaskets are covered ONLY in conjunction with a covered repair. All internal lubricated parts located within the transmission case along with transmission case failure caused by any such part. Torque converter, flywheel.
Rental: Reimbursement towards rental vehicle of up to $25.00 per 8 hours of authorized labor time to replace or repair a failed covered component. Rental eligibility begins only after the first 8 hours of labor time has been completed. (Maximum rental allowance is 3 days / $75.00 dollars)

Drive Axle: Seals and gaskets are covered ONLY in conjunction with a covered repair.All internal lubricated parts located within the transfer case and front/rear axle housing, along with front/rear axle housing and transfer case failure caused by any such part. Drive shaft, universal joints. Constant velocity joints on four wheel drive vehicles only..
Limitations, exclusions and additional conditions applying to coverage:
THERE ARE NO WARRANTIES THAT EXTEND BEYOND THE TERMS OF THIS EXPRESS LIMITED SERVICE CONTRACT. EAGLE'S RESPONSIBILITY PURSUANT TO THIS SERVICE CONTRACT IS EXPRESSLY LIMITED TO PAYMENT OF THE REASONABLE COST OF A COVERED COMPONENT AND SHALL NOT EXTEND TO ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES OF OWNER(S). This service contract provides reimbursement of a listed failed component of equal value with used or rebuilt components, at EAGLE'S discretion including components that may be from a non original equipment manufacturer (Non-OEM), whenever available. EAGLE is not responsible for any improper repairs made prior to or after the date of sale, any mechanical condition resulting from any vehicle part that was defective or worn to the point of reasonably needing repair prior to the acceptance date of this contract by EAGLE, any repair that is due to negligence of ANY operator of said vehicle, failure to properly maintain the vehicle according to the vehicle's owner manual, including, but not limited to operating without proper lubricants or coolants, any damage that results from fluid leaks, any consequential damage such as any component being damaged by either a covered or non-covered component, any damage due to weather conditions, vandalism, flood, fire or the result of an accident. The operator of the vehicle is required to safely but immediately pull off to the side of the road, turn the engine off and secure servicing when any sound, condition, warning light and/or gauge indicates a problem to assure that no further damage occurs. EAGLE is also not responsible for any loss of time, work or any other inconvenience should a breakdown occur. EAGLE reserves the right to reject any claim and/or cancel any contract containing any false information or where any misrepresentation takes place during the processing of a claim. You are required to keep and provide to EAGLE upon request exact copies of all your maintenance records from the date of purchase. EAGLE'S total liability for all cumulative repairs under this service contract shall not exceed the selling price of the vehicle or value of the vehicle at the time of repair whichever is less. Any balance of this service contract is transferable at a $65.00 transfer fee to another owner or vehicle. If ownership of the vehicle changes at any time, this contract and any open claims made against the service contract during the original signed owners contract term become cancelled and/or void unless transferred at the time owerships changes.

Vehicles with rotary, V10, V12 engines and any vehicle containing more then one turbo system are not eligible for coverage. Dodge Stealth Porsche Sterling Rolls Royce Alfa's Lamborghini Mitsubishi 3000 GT RV's Kit Cars BMW (Series 7, Z Series only are NOT eligible) Mercedes (400 Series, 500 Series, 600 Series, C36 Sport Sedan, C43 Sport Sedan only are NOT eligible) Any dual wheel vehicle Any vehicle considered "commercial" Any vehicle altered from factory specifications Any vehicle containing the 4100 engine Any vehicle containing the Northstar Engine Any vehicle under the purchase price of $1500.00 (Excluding the cost of tags, transfer fees, tax or any other fees above and beyond the actual selling price of the vehicle) Any vehicle older than 20 years old Any vehicle with more than 175,000 miles or in which the odometer mileage has been altered for any reason at anytime. **** Important Notice **** Odometer and engine gauges must be operating and operating correctly at the time of sale and through the term of this contract.

Important State Required Disclosures
West Virginia You may cancel this service contract at anytime within the first ninety (90) days from the purchase date for a prorated refund by returning this contract to EAGLE at the address on the front of this contract with a written notice of cancellation.
New York: Pursuant to New York Law: You have the right to return this service contract for a refund within 20 days of the date of mailing of the service contract or at least 10 days if the contract is delivered at the time of sale by mailing your copy to EAGLE at the address indicated on the front hereof for a full refund of the purchase price, less any claims authorized, after which the contract is voided. If any refund due you is not paid within 30 days of your returning your copy of the contract to EAGLE, your will be entitled to an additional 10% penalty per month until paid. South Carolina: Regarding South Carolina service contracts, the contract holder shall have a nontransferable right for 20 days from the mailing of the contract to the holder (or 10 days from delivery if received at the time of sale) to return the contract to EAGLE and receive a full refund, if no claim is made on the contract prior to its return, with a 10% penalty to be added to the refund if not paid within 45 days after return of the contract pursuant to Chapter 78, Section 38-78-30 (F) of the South Carolina Department of Insurance Regulations.
