2 - MCC 7040/7360 Overview



• Are administered by the Office of Capital Improvements (OCI).


• Provide opportunities to small business to participate on Miami-Dade
  County construction contracts, facility repairs, neighborhood
  improvements, and emergency repairs.


• A maximum value of $2.5 million.

• 100% set-aside for Community Small Business Enterprise (CSBE)
  firms certified by the Department of Small Business Development (SBD).


• Rotational pool on a continuing basis.


• Only contractors pre-qualified by OCI will be entered in the RPQ and
  allowed to bid on a solicitation.

MCC 7360-0/08

• Open competitive contract accessible to all vendors


• Contractor must be pre-qualified with OCI at the time of the award


• Only utilized when federal funding is involved or when 100% CSBE goal is
  not attainable due to unavailability of certified vendors in the required Trades


• If not federally funded, RPQ must be presented to the Review Committee
  before submitting it to OCI

3 - MCC 7040 & 7360 Pre-Qualification Requirements


  Registered Vendor with Miami-Dade County Department of Procurement
  Management (DPM).

  Submit to OCI the Request to Participate for Qualified Contractors form and
  firm’s responsibility affidavit.

  Submit copy of contractor’s License to OCI.

  Submit to OCI copy of proof of insurance (General Liability, Auto Liability,
  and Workers Comp)

 Submit to OCI copy of CSBE certification letter (7040 only)

4 - MCC 7040/7360 Competitive Bidding Process

MCC 7040-0/07


  RPQ’s valued less than $10,000 are assigned on a rotational basis. Do not
  require competitive quotations. Contact the next firm on the assigned
  rotation list provided by OCI.

  RPQ’s valued between $10,000 and $200,000 are competitively bid with a
  minimum of 3 contractors. Only contractors included in the RPQ by OCI
  shall be allowed to bid.

  RPQ’s valued over $200,000 are competitively bid among all firms which
  have been pre-qualified by OCI in a particular trade.

4 - MCC 7040/7360 Competitive Bidding Process

MCC 7360-0/08

  RPQs must be submitted to OCI no later than Tuesdays at noon.

  OCI creates ad and submits file to the Clerk of the Board for advertisement
  no later than 10:00 AM on Wednesdays in order to meet the deadline.

  RPQs are advertised every Thursday in DPM’s website and Daily Business
  Review.

5 - CSBE Level of Participation & Participation Measures



CSBE Levels

 3 CSBE contracting participation levels based on firm’s 3 year average gross
 revenues.


   Level I – Less than $2,000,000

   Level II – $2,000,000 - $5,000,000

   Level III – $5,000,000 - $10,000,000

7040 Participation Measures

   Single (Specialty) Trade Projects
     Level 1 – up to $2,500,000
     Level 2 – above $50,000 to $2,500,000
     Up to $50,000 only CSBE Level 1 can participate.

   Multiple Trade Projects
     Level 1 – up to $2,500,000
     Level 2 – above $2,000,000 to $2,500,000
     Up to $2,000,000 only CSBE Level 1 can participate.

8 - Bid Evaluation Procedure

• Compare base estimate to base bid price for the lowest responsive, responsible
  bidder


• When there is a difference greater than 20% a justification note in the note
  section should be added to the RPQ in CIIS


• User Departments need to evaluate and consider contractor’s past
  performance


• User departments should review the performance evaluation in CIIS


• If evaluations are not available in CIIS, users should make every effort
  to obtain alternate sources of performance history

9 - Collusion Affidavit (Ordinance 08-113)
 • A contractor recommended for award as the result of a competitive
   solicitation for any County construction contract shall, within 5 business
   days of the filing of such recommendation, submit an affidavit under the
   penalty of perjury: stating either
     1) The contractor is not related to any of the other parties bidding in the
        competitive solicitation or
     2) Identifying all related parties

10 - Emergency RPQ’s Procedure

 “An emergency is an unforeseen or unanticipated urgent and immediate
 need for the protection of life, health, safety or welfare of the community
 or the preservation of public property.” From 7040/7360 Contract.

   During working hours, contact OCI for the next available vendor.

   During non-working hours, users access the emergency list of contractors
   in CIIS (vendors must be rotated).

   Within 5 working days users should submit the post award documentation
   to OCI, with an e-mail justifying the circumstances. The user department’s
   Assistant Director or his designee must be copied on this e-mail.

   In the event a contractor does not respond to the emergency request, user
  departments should send an e-mail to OCI documenting the non-
  responsiveness of the contractor

11 - Changes to the RPQ/PO Justification and Process

• Within the general scope of the original RPQ


• At the physical location or adjacent to the original site of the RPQ


• Should involve trades currently included in the original RPQ or involve an
  unanticipated discovery occurring during the course of the contract


• Clearly justify the reason for the change


• Equitable adjustment (increase/decrease) to the contract price caused by a
  requested change in work and or time extensions

• When changed work must be performed within the general scope of work, a
  change order must be processed, regardless of the value of the changes being
  made. All change orders must be processed in CIIS and reviewed and
  approved by OCI


• User departments are required to submit to OCI copies of all executed
  change orders regardless of the dollar amount or time change requested. A
  change order is executed when the following signatures are received: County
  project manager, user department assistant director or designee, contractor,
  and Surety (when applicable)

12 - MCC Update


A one year contract extension was approved by the Board of County
Commissioners (BCC) in May 2008 for both MCC contracts along with an
additional allocation of $200 million.

      MCC 7040 expires on 10/31/2010

      MCC 7360 expires on 05/31/2009



Ordinance 08-81 was approved by the BCC in July 2008 increasing the MCC
cap to $2.5 million for each project. We intend to request an extension.
