                                       APRIL 1, 2009
       On this the 1st day of April, 2009, A.D., at 10:00 a.m., the Commissioners’ Court
of Jackson County, Texas convened in a Special Term, Special Session, thereof, at the
Courthouse of Edna, Texas, with the following members of the Court present, to-wit:

At which time the following proceedings were had.
Demonstrations for Mobile Data Terminals
       Andy Louderback, County Sheriff, addressed the Court and introduced Saul
Delgado of Houston, Texas, representing Portable Computer Systems. Mr. Delgado then
addressed the Court concerning the Mobile Data Terminals to place in the patrol cars of
the Sheriff’s Department and demonstrated the features that they provide.
       Andy Louderback then addressed the Court on the expense for 10 units for
$68,510 including a five year warranty with Protection Plus.
       After discussion, information received, no action taken.

       A motion was then made by Comm. Deyton, seconded by Comm. Belicek to
adjourn at 11:25 a.m.
       Meeting was ADJOURNED.

Citizens Comments
          There were none.
Minutes Approved
          The Minutes of March 23, 2009 and April 1, 2009 were presented. It was stated by Comm. Deyton
to amend the Minutes on page 611 under News and Information concerning the CPR training. Comm.
Deyton stated the CPR training was for the precincts not only Comm. Court.
          A motion was made by Comm. Bubela, seconded by Comm. Hunt to approve the Minutes with
change.
          Motion carried.

Budget Amendments
          Budget amendments #267 through 275 were presented.
          A motion was made by Comm. Belicek, seconded by Comm. Deyton to approve the budget
amendments.

Certify and Budget GDEM Bridge City Mutual Aid Reimbursement and Consider Payment of
Overtime to Deputy
          Discussion was had concerning the GDEM Mutual Aid reimbursement of $516.40 for the Sheriff
Deputy’s overtime out of the reimbursement money.
          A motion was made by Comm. Bubela, seconded by Comm. Hunt to certify and budget the
overtime payment of $516.40 plus fuel and fringe.
          Motion carried.
Certify and Budget Gulf of Mexico Energy Security Act of 2006 (GOMESA) Payment Received for
2009 and Additional LEOSE Funds Received for the Sheriff’s Department Training
          Discussion was had concerning the GOMESA payment received of $14,713.76.
          A motion was made by Comm. Hunt, seconded by Comm. Belicek to certify and budget the $14,
713.76.
          Discussion was had concerning the LEOSE fund received for $670.00 in additional funds that is
strictly for Sheriff’s Department training.
          A motion was made by Comm. Bubela, seconded by Comm. Deyton to certify and budget the
funds.
Motion carried.
Consider Ratification of Grant Agreement, Certify and Budget Funding in the Amount of $5,500
from M. G. and Lillie A Johnson Foundation, Inc to Purchase VHS/DVD Shelving Resources for the
Library and Purchase of Same
          Judge Stafford noted that the grant for $5,500 was received. It was also noted that Terri Gasch has
already signed the grant.
          A motion was made by Comm. Bubela, seconded by Comm. Hunt to ratify the Grant Agreement,
certify & budget funds for $5,500 and approve purchase of shelving not to exceed grant amount.
          Motion carried.

Consider Approval of Funding in the Amount of $5,604 from the Tocker Foundation to Purchase
Young Adult Shelving and Purchase of Same When Grant Received and Contract Signed by the
County Judge
          Discussion was had concerning the Tocker Foundation Grant.
          A motion was made by Comm. Belicek, seconded by Comm. Bubela to approve the grant and the
purchase of shelving once the grant for $5,604 is received.
          Motion carried.
Consider the Library’s Request to Apply for the Target Grant in the Amount of $3,000 for
Promoting Early Childhood / Young Adult Literacy Development Through the Purchase of Listen
and Read-a-Longs Collection Development Materials
          After discussion a motion was made by Comm. Bubela, seconded by Comm. Deyton to authorize
Terri Gasch to apply for the Target Grant in the amount of $3,000 and to authorize her to sign for it.
                  Motion carried.
Consider Ratification of Hazard Mitigation Grant Program (HMGP) Application to Update and
Revise Jackson County’s Mitigation Action Plan and Authorize the 25% County Match
          Michelle Darilek noted the total Grant is $70,000 with the County’s match being $17,500 and that
the County’s Mitigation Action Plan must be reviewed and updated every 5 years and the HMGP grant
will assist in paying for the update..
          A motion was made by Comm. Deyton, seconded by Comm. Hunt to ratify the application and
approve the County’s match of $17,500.

Consider Request from Edna High School Class Regarding Prom Decorations in County Services
Bldg., and Take Any Necessary Action
         Kaylea Orsak, Edna High school Class President spoke to the Court concerning the decorations for
their Prom that is being held in the County Services Building on May 8, 2009. She showed the Court the
clips they would be using to hang the decorations noting that these clips are specifically designed for use
on the type of ceiling grid in the Services Building.
         A motion was made by Comm. Belicek, seconded by Comm. Hunt to approve only the use of the
clips to hang their decorations.
         Motion carried.
Receive County Treasurer Continuing Education and PFIA Certificates of Compliance
                 Mary Horton’s Certificate of Continuing Education for 2008 and her Certificate of
Completion of Public Funds Investment Act were received.

Accept and Approve Treasurer’s Quarterly Report
         This item was tabled.
Consider Changes to Procurement Card, and Take any Necessary Action
         Comm. Belicek noted that an addition of MCC #5200 Home Supply Warehouse Store for
Precinct, Maintenance and Jail is needed.
A motion was made by Comm. Belicek, seconded by Comm. Bubela to approve the addition.
         Motion carried.
Consider Changes to Courthouse Sidewalk Project, and Take Any Necessary Action
         This item was tabled.
Approve Purchase of Computer for District Clerk, and Take Any Necessary Action
         Sharon Mathis, District Clerk, spoke to the Court concerning the purchase of a new computer for
her office. She requested the funds come from the office supply budget in the amount of $774.12 for a Dell
computer including the needed software. She also asked the Court, since this was an unplanned purchase
for the year, please keep this in mind at the end of the year if her budget runs low.
         A motion was made by Comm. Bubela, seconded by Comm. Hunt to approve the purchase of a
Dell computer plus the software needed in the amount of $774.12.
         Motion carried.

Consider Acceptance of VL & JH Robinson Charitable Foundation Donation for Mobile Data
Terminals and Certify and Budget Same if Approved
         It was noted that a donation for $30,410.00 was received from VL & JH Robinson Charitable
Foundation to help towards the purchase of Mobile Data Terminals for the Sheriff’s office.
         A motion was made by Comm. Belicek, seconded by Comm. Hunt to accept, certify and budget
the funds.
         Motion carried.

Consider Authorizing Sheriff to go out for Bids on Mobile Data Terminals, and Take Any Necessary
Action
         Sheriff Andy Louderback spoke to the Court concerning the purchase of 8 Mobile Data Terminals,
7 of which will be installed in mobile units and 1 stand alone unit. The cost is $52,000 for the initial
purchase of the Mobile Data Terminals with Protection Plus warranty and an estimated cost of $441.60 per

month. Sheriff Louderback noted the initial charge for the terminals and any reoccurring monthly fees
would come out of Abandoned Motor Vehicle fund or grant funds.
         A motion was made by Comm. Hunt, seconded by Comm. Bubela to approve the purchase of 8
Mobile Data Terminals under the State contract noting the balance, after the VL & JH Robinson Donation,
and any reoccurring monthly charges would be taken out of Abandoned Motor Vehicle fund.
         Motion carried.
Payment of County and Precinct Bills and Court Orders, if Any
         A motion was made by Comm. Hunt, seconded by Comm. Bubela to authorize the payment of
County and Precinct bills.
         Motion carried.

         A motion was made by Comm. Hunt, seconded by Comm. Deyton to approve the payroll changes.

Receive Various County Reports
         The Library report was received.
News and Information
         Comm. Deyton expressed concerns with the Reverse 911 system. He noted that we need to get
someone cross trained to run the Reverse 911 system. He also stated that it needs to be a team effort with
the City of Edna.
         Comm. Bubela noted that the spring clean up is next weekend, April 17 and 18, 2009.
Present “Return on Investment Report” Detailing Services Provided to the County
         Don Polzin, Executive Director, Gulf Bend Center, presented a Return on Investment Report
which showed the services provided to the County in 2008.
Consider Resolution from Veterans Group Regarding Veterans Benefits, and Take Any Necessary
Action
         A motion was made by Comm. Bubela, seconded by Comm. Belicek to adopt the Resolution and
send it on to the State level.
         Motion carried.

Consider and Take Action on Identity Theft Compliance Issues and Solutions for Jackson
County as Presented by DeGoLa RC&D representative (Lenny Anzaldua) and the Business &
Risk Consulting Group of America (Bert Howard, CITRMS)
       Bert Howard addressed the Court regarding an Affirmative Defense Response System. He
noted that this plan would be at no cost to the County and would protect employees from all types of
identity theft and would in return minimize the risk for the County.
Budget Amendments
       Budget amendments #276 through 278 were presented.
       A motion was made by Comm. Bubela, seconded by Comm. Deyton to approve the budget
amendments.

Consider Changes to Courthouse Sidewalk Project, and Take Any Necessary Action
         Comm. Belicek spoke to the Court concerning the changes that need to be made to the sidewalk
project. He noted that all of the front, up to what was replaced last year, needs to be replaced at a cost of
$4,895 that will be added to Bid Package B under the 25% change order. He also noted that there is an
additional $350 increase on Bid Package A.
         A motion was made by Comm. Belicek, seconded by Comm. Bubela to approve $4,895 on Bid
Package B and $350.00 on Bid Package A.
         Motion carried.


Consider Road Rehabilitation Project Agreement for Fiscal Year 2010 with LNRA, and Take Any
Necessary Action
         Charles Reckaway addressed the Court Concerning the Road Rehabilitation Project Annual
Agreement with LNRA.

Consider Contract of Vangard Wireless for Tower Rental of TANA, and Take Any Necessary
Action
         Discussion was had concerning the Tower Rental with Vangard Wireless. It was noted that this is
the tower used for volunteer services located in Ganado. The cost is $1,200 with a 3 % increase annually.
         A motion was made by Comm. Bubela, seconded by Comm. Hunt to approve the contract for
$1,200 per year with the 3% increase annually for 5 years..

Consider Resolutions Regarding Oil and Natural Gas Valuation, and Take Any Necessary Action
        Judge Stafford spoke to the Court concerning Resolutions regarding Oil and Gas Valuation.
Judge Stafford noted there are 3 resolutions requesting that Senator Glenn Hagar, Representative Geanie
Morrison, and the Jackson County Appraisal District contact the State of Texas Comptroller’s Office
concerning clarification of their interpretation of Texas Tax Code Sec. 23.175.
        After discussion a motion was made by Judge Stafford, seconded by Comm. Bubela to approve
the resolutions.

Consider Road Crossing Agreement with Acock Anaqua Operating Comp. L.P. on County
Road 224, and Take Any Necessary Action
         Comm. Bubela spoke to the Court concerning the Road Crossing Agreement for CR 224.
         A motion was made by Comm. Bubela, seconded by Comm. Belicek to approve the
agreement.

Consider Application for County Road Crossing with LaWard Telephone Exchange, Inc. at
Sunrise Bay Subdivision, on Windswept Drive and Beacon Drive, and Take Any Necessary

         Comm. Deyton spoke to the Court concerning the Road Crossing Application for the Sunrise
Bay Subdivision.
         A motion was made by Comm. Deyton, seconded by Comm. Bubela to approve the
application.
         Motion carried.
Consider Request of Commissioner Pct. 3 to Enter Private Land for County Road Drainage
Purposes, and Take Any Necessary Action
         Comm. Belicek spoke to the Court concerning entering Timmy Jacobs land to clear a relief
culvert on County Road 311.
         A motion was made by Comm. Belicek, seconded by Comm. Bubela to allow entrance onto
Mr. Jacobs land.
Consider Request from Sheriff’s Department to Declare 2000 Ford Crown Victoria Surplus
Property and to Sell at Victoria Auto Auction, and Take Any Necessary Action
         Judge Stafford noted the 2000 Ford Crown Victoria is Jackson County Property tag #05856.
         A motion was made by Comm. Deyton, seconded by Comm. Bubela to declare the 2000 Ford
Crown Victoria surplus property and give the approval to sell it at the Victoria Auto Auction.
         Motion carried.
Consider Approval of Jackson County Memorial Library Technology Plan, and Take Any
Necessary Action
         Terri Gasch, County Librarian, addressed the Court concerning the Technology Plan for the
Library.
A motion was made by Judge Stafford, seconded by Comm. Hunt to approve the plan.
         Motion carried.

Receive Various County Reports, News and Information
         The Extension report and the Treasurer’s Monthly report were received.
         Judge Stafford noted that a Thank You note was received from Carol Morton.
         Judge Stafford noted that the KBD index is 435.
         Mary Horton noted that TAC is presenting a Loss Control Workshop that we are hosting on
July 23, 2009 at the County Services Building.
         Comm. Bubela expressed concerns with the free County Clean-up weekend. It appeared that
there were quite a few out-of-county residents that took advantage of the free service.
         Mary Horton also noted that certain County Officials need National Incident Management
System (NIMS) testing to get reimbursed from FEMA.

The Court recessed at 10:00 a.m. to reconvene at 1:30 p.m.

Consider Purchase of 120 Additional Cavalcades by the Historical Commission and Take Any
Necessary Action
         A motion was made by Comm. Bubela, seconded by Comm. Belicek to approve the purchase
of the additional cavalcades.
         Motion carried.
Consider and Take Action on Identity Theft Compliance Issues and Solutions for Jackson
County as Presented by DeGoLa RC&D representative (Lenny Anzaldua) and the Business &
Risk Consulting Group of America (Bert Howard, CITRMS)
         Mary Horton, County Treasurer, recommended participating in the Identity Theft program
that Bert Howard presented to the Court earlier in the day.
         A motion was made by Comm. Deyton, seconded by Comm. Hunt to approve the payroll
deduction authorization for the Identity Theft program.
         Motion carried.

Consider Resolution on Electronics Recycling, and Take Any Necessary Action
         This item was tabled.

Workshop on Theatre Renovation Project (1:30 p.m. Grand Jury Room)                                    Formatted: Font: 12 pt

       Visitors present for the workshop were:
               Jan Taylor, John Taylor, Roy Ortolon, Bertha Dell McDowell, Joe Speed, Frank
               Condron, Kay Simons, Joyce Jarratt and Charles Kroll.
       Discussion was had concerning the renovation of the theatre. It was noted that it could be
used as a Convention Center or Civic Center. The Flag City Opry has expressed interest in using the
theatre. The area schools could possibly use it for their Theatre Arts programs. Other concerns
expressed were about parking and the maintenance of the building once the renovations are
completed.
       A grant for the renovations has been applied for with TX-DOT for $1.8 million. The total
estimate for the renovation is $1.3 million.
