Please read the following conditions which apply to your application. These conditions, and the exclusions of responsibility and liability in them, are
given by Norwich and Peterborough Building Society (also referred to in these conditions as “we” or “us”) both on its behalf and on behalf of its
employees and valuer(s).
Acceptance of this application
Acceptance of this application does not guarantee that we will provide a mortgage. We may decline this application without being required to state any reason.
About the valuation and limitations on liability arising from the valuation report and generally
We are required to obtain a mortgage valuation report to help us decide what loan, if any, to make secured on the property.
The valuation report for mortgage purposes on the property is not a structural survey and must not be treated or relied upon as such. The valuation given is for
mortgage purposes only and may not represent either the open market value of the property or its particular value to you.
We will instruct one of our approved panel valuer(s) to carry out the report. The valuer will only make a limited visual inspection of the property and will not carry
out a building survey. There may well be defects, including serious structural defects, that are either not noticed or not referred to you.
In some cases and at our discretion, we may carry out either an electronic valuation (which does not require the valuer to carry out an inspection of the
property) or we may carry out an external appraisal only. If the valuation of the property is carried out using one of these methods, a copy of the valuation report
will not be provided to you.
Where the valuer is not one of our employees, we do not accept any responsibility for the valuation or report or make any representation that it is correct in any
respect. Where the valuer is our employee, no responsibility is implied or accepted by us or our employees to you or anyone else for:
     Any loss, however great, suffered as a result of relying on our willingness to lend;
     Any defects or condition, any diminution of value or any loss, however great, which a limited visual inspection of the type mentioned above could not

     reasonably be expected to have disclosed or anticipated if it had been carried out by a person exercising the degree of skill and competence normally
G


     employed in such a limited, non-structural, visual inspection;
     Any other loss, however great and for whatever reason, suffered as a result of relying upon the inspection; but
     Liability is not excluded or limited in respect of personal injury or death resulting from any act or omission on our part or on the part of our employees.

This notice is given by us, both on our own behalf and on behalf of our employees. We do not authorise our employees or agents or valuer(s) to make

statements in any way qualifying or accepting liability for the report or with regard to any proposals you may have for the property.
Any retention figure set out in the mortgage offer is for our purposes only. It does not indicate the actual cost of remedying any items of disrepair etc referred to.
Arranging your own comprehensive survey
We strongly recommend that, to protect your own interests, you arrange an independent survey of the property, for example a RICS/ISVA Home Buyers’ Survey
and Valuation, or a building survey. Please see the leaflet ‘Guide to our fees and charges’ for details on valuations.
Transfer of Mortgage
We may transfer the mortgage which you are applying for, and any assignment or other related deeds and documents, to another body which may not be a
building society or associated with a building society. If we transfer your mortgage, you will not be a borrowing member of Norwich and Peterborough Building
Society any longer. You will also not have the rights and obligations of a borrowing member. When you complete the mortgage which you are applying for, you
will give your general consent to us to make such a transfer.
Insurance
Adequate building insurance will be a condition of your mortgage.
Data Protection Act 1998 (‘the Act’)
How we will use the information you provide:
We will use and record the information you provide and which we obtain from our enquiries to consider your application.
In considering your application we will search your record at a credit reference agency/agencies. They will supply us with credit information as well as
information from the Electoral Register. This information will also be used to establish your identity. They will add to your record details of our search and your
application whether or not it proceeds. This will be seen by other organisations carrying out later searches.
We will use an automated decision making system when assessing your application.
We will also add to your record with the credit reference agency/agencies details of your agreement with us (including the payments you make under it and/or
failure to keep to its terms).
We, the credit reference agencies and others may also use the information for statistical analysis about credit, insurance and fraud and for tracing debtors.
You may obtain the names and addresses of the credit reference agencies we use from time to time by telephoning 0800 883322 or by clicking on
www.npbs.co.uk/personaldataclause. You have right of access to your personal records held by these agencies.
We will also use, record and disclose the information which you provide and which we obtain from our enquiries in the following ways:
     to instruct the valuer who will prepare the mortgage valuation report and the conveyancer(s) who will act on our behalf in relation to the mortgage;
     to obtain an acknowledgement from each occupier of the property who is aged 17 or over of our interest in it;

     to assist in tracing and pursuing debtors and in pursuing any claims under mortgage indemnity insurance (if obtained);

     to comply with any requests for information received from the Financial Services Authority or any appropriate regulatory body;

     to allow us to provide you, by post, telephone or email with details of any products or services that we provide or which companies within the Norwich and
G


     Peterborough Building Society group of companies (“the N&P Group”) provide which we think may be of interest to you;

     for commission calculation by us and by others;
     to administer your account with us and for research.

In order to prevent crime we may exchange information (both within the UK and, where appropriate, overseas) with other members of the N&P Group and
G


where necessary with fraud prevention and law enforcement agencies and other organisations. We will disclose your information to any suppliers we engage to
process personal data on our behalf.
We may search your record at a credit reference agency/agencies from time to time before giving you details of any products or services that we provide or
which companies within the N&P Group provide which we think may be of interest to you.
From time to time, we may search our records, those of the N&P Group and those of a credit reference agency/agencies to help manage your account and to
take decisions regarding credit facilities.
We may continue to process the information in this application form and which we obtain from our enquiries after redemption of any mortgage for marketing
research and statistical analysis.
Telephone calls may be monitored and recorded to help with staff training, customer service and for the purpose of security and fraud prevention.
Information we hold will be processed only for purposes for which it has registered under the Data Protection Act 1998. We will provide you with a copy of
information we hold concerning you on payment of a fee.

                                                 DECLARATIONS AND AGREEMENTS
All applicants must read the following sections and sign the declaration and form of consent. Where more than one of you is signing the form, the
declarations are made and the authorities and agreements are given by each of you separately.
Agreement to assign borrowers’ windfalls to charity
Note: This Agreement does not apply to you if you have had a mortgage loan with the Society at any time since 1st October 2000 or if you are in one of the
other groups of people that the Society has decided should be exempt.*
Where more than one of you is signing this form the above Note and, if applicable, the rest of this agreement apply to each of you separately.
1. I agree with the Society that I will assign to the selected charity my right to receive any borrowers’ windfalls. I authorise the Society and any successor
     to pass any borrowers’ windfalls directly to the selected charity (or to any other charity which the selected charity may nominate) without giving any
     notice to me. I understand that the selected charity will have the benefit of this Agreement, and that neither it nor the Society will release me from it or
     vary the terms, even if the Society decides at some stage in the future that new borrowing members generally will not be required to enter into similar
     agreements. I authorise the Society to give the selected charity any information about me and any account that I have with the Society (either now or in
     the future) but only if the selected charity reasonably needs it for any purpose arising out of this Agreement. I understand that if the Society no longer
     exists following a merger with another building society, this Agreement will still apply between me and the other society.
2. In this agreement:
     a) “selected charity” means the Charities Aid Foundation or, if it ceases to be registered as a charity, any other registered charity selected by it;
     b) “borrowers’ windfalls” means any benefits which I may become entitled to as a borrowing member of the Society under the terms of any future
         transfer of the Society’s business to a successor (i.e. on a conversion or take-over). The expression “borrowers’ windfalls” does not include those
         benefits the Society has decided I may keep; and
     c) “successor” means any company or other corporate body to which the Society transfers its business under Section 97 of the Building Societies Act
1986 (or under any provision which amends or replaces it).
*Details of these groups and (where applicable) the benefits that may be kept are available from the Society. The number and composition of the groups may
change from time to time but no change will apply retrospectively.
“Society” in the section “Agreement to assign borrowers’ windfalls to charity” means Norwich and Peterborough Building Society.
I agree to be bound by the “Agreement to assign borrowers’ windfalls to charity”.
Other Declarations and Agreements
In this section “the Lender” means Norwich and Peterborough Building Society.

      I authorise the Lender, for credit assessment purposes, to make enquiries of my current (and any previous) employer, banker, accountant, financial adviser,

      the Inland Revenue or any other Government department or body or any other person or entity in order to check the information that I have given or which

      has been given on my behalf or to obtain further information about me which is relevant to this application.

      assessed with reference to any “associated” records. If this is a joint application, I agree that an “association” will be created at the agencies which will link
      our financial records. This linking will continue until one of us successfully files a “disassociation” at the agencies. I agree that my associate’s information
      will be taken into account. If either of us apply for access to information held at the agencies, the applicant will only receive information relating to
      himself/herself and the name(s) of any associate(s).
* If any person in respect of whom information is given is under 17 years of age, the Lender will require a separate form of consent to be signed by such person
