DEAR GREG RYAN:
Our record review shows that the LIBBY WSC water system violated the maximum contaminant level (MCl) for trihalomethanes
(TTHM) in the water supplied to Its customers. This violation occurred during the second quarter of 2009. 30 TAC, Chapter
§290.113, of the Texas Administrative Code describes how we determined that this violation occurred.

The information that we used to determine compliance for your system is shown in the table below. The MCl for TTHM is 0.080
milligrams per liter (mgll) (80 micrograms per liter (~gIl» based on a running annual average. Based on the data contained in the
table below, we determined that the running annual average of TTHM was 0.084 mgll (84 ~gIl).

If you have not already done so, we encourage you to seek assistance. One form of assistance we can offer is through the TCEa 

Directed Assistance Contract that is designed to offer free assistance to public water supplies in financial. managerial and 

technical areas. Please call Margot Taunton of the Utilities and District Section at (512) 239-6403 and ask for a referral for "MCl 

violation directed assistance.' If you would prefer. you can contact the coordinator listed at the end of the leHer to assist you with 

this referral. 


PUBLIC NOTIFICATION REaUIRED:                                 ,

You must take the following actions to meet the public notification requirements of 30 TAC §290.122: 

             You must use the enclosed wording for every notice. and include a brief statement about what you plan to do to fix
             the problem. This statement must describe what actions the water system is taking to correct the violation. and when
             the water system expects to return to compliance.
             You are required to repeat the notice every three months for as long as the violation persists. You should use the
             same method that you used for the initial notice.
             Please send a copy of every public notification and a signed Certificate of Delivery for Public Notice to this office
             within ten days after it has been delivered. Send to:

OTHER REQUIREMENTS: 

In addition. you must take the follOwing actions: 

             You need to identify how you can prOVide water that meets the drinking water standards. Some options include
             modifying treatment. blending your sources, reconfiguring your entry points. or finding an additional source. You
             may wish to consult with an engineer who specializes in drinking water issues for specific solutions on how to
             resolve your violation.
             We will continue to sample your system on a quarter1y basis.
             You must keep a copy of this letter with your Monitoring Plan, in accordance with 30 TAC §290.121.
All public water systems that violate primary drinking water standards are referred to the TCEQ's Enforcement Division for
determination of follow up actions. Should you have any questions regarding those follow up actions, you may contact the
Enforcement Division at (512) 239-2545.

                                    Mandatory Public Notification Language

    The LIBBY WSC has been notified by the Texas Commission on Environmental Quality (TCEQ) that the water            '
    this system supplies has exceeded the maximum contaminant level (MCl) for total trihalomethanes (TTHM's),
    as set in the Commission's Drinking Water Standards.


    The MCl for TTHM's is 0.080 milligrams per liter (mg/L). Compliance with this level is based on a running
    annual average of quarterly sample results. The LIBBY WSC's running annual average for quarter 2 of 2009
    was 0.084 mg/L.

    Trih~lomethanes are a group of volatile organic compounds that are formed when chlorine, added to the water
    during the treatment process for disinfection, reacts with naturally-occurring organiC matter in the water.


    Some people who drink water containing trihalomethanes in excess of the MCl over many years may
    experience problems with their liver, kidney. or central nervous systems, and may have an increased risk of
    getting cancer.

    You do not need to use an alternative water supply. However, if you have health concerns, you may want to
    talk to your doctor to get more information about how this may affect you.

    received this notice directly (for example, people in apartments, nursing homes, schools, and businesses). You
    can do this by posting this notice in a public place or distributing copies by hand or mail.
