College Student Disciplinary Procedure

1.      Purpose

        1.1     The document sets out the procedure for dealing with either instances
                of alleged gross misconduct or when the Faculty Student Disciplinary
                Procedure has been exhausted and there is a recommendation to
                suspend or expel a student.

2.      Scope

        2.1     Referral from Faculty Disciplinary Procedure

        2.2     Gross misconduct, for example: assault; harassment; bullying;
                vandalism; theft; fraud (including plagiarism); serious negligence
                leading to damage or injury

        2.3     Where students have behaved in an unacceptable way outside college
                attendance times and outside college premises, particularly where this
                leads to criminal proceedings, the college reserves the right to take
                appropriate action.

4.      Applicable to

        4.1     All students whose programme of study is managed directly by
                Stafford College.

5.      Definition

        5.1     Student is a person on an accredited learning programme

        5.2     Disciplinary Committee is a group consisting of a Vice Principal
                (chair), the student’s Head of Faculty and Tutor (and in attendance the
                student and, if requested, student support, e.g. parent, guardian,
                employer, friend, staff volunteer, Student Union Representative).

        5.3     Disciplinary Appeals Panel is a group consisting of Principal (Chair)
                and two other members of the Senior Management Team (but not
                including the Vice Principal who chaired the Disciplinary Committee
                or the student’s Head of Faculty).

        5.4     Plagiarism is the presentation of work as a student’s own, when this
                has been copied from any other source without acknowledgement of
                the source.

6.      Description

6.1     The College Disciplinary Procedure provides a framework which promotes
        fairness and equality regardless of age, race, skin colour, disability, gender,
        marital status, sexual orientation and faith. It acknowledges the individuals
        basic right to justice. It encourages students to be represented at every stage.
        The college is mindful of its responsibilities to parents of students under 18
        and to employers supporting students on part-time study. These will be
        informed of any alleged misconduct.

        Appropriate training will be provided for staff taking part in the Disciplinary
        Committees or Disciplinary Appeals Panels.

        6.1.1   For instances of gross misconduct the procedure continues from
                section 6.2 (stage 1).

        6.1.2   For instances referred from the Faculty Disciplinary Procedure the
                procedure continues from section 6.3 (stage 2).


6.2     Stage 1

        6.2.1   All staff are required to take initial action to prevent breaches of
                college rules. Incidents should be reported immediately to a Head of
                Faculty, duty manager or member of the Senior Management Team.



        6.2.2   The most senior person on duty should decide whether to remove the
                student immediately from the college premises for the remainder of the
                day. The decision must pay due regard to the student’s care and
                welfare. In appropriate instances the police will be informed. The
                student should be asked to report the following day directly to their
                Head of Faculty or Faculty Manager.

        6.2.3   The member of staff who initially reported the incident to the
                appropriate Head of Faculty should provide a written report. The Head
                of Faculty can, if necessary, suspend the student for no more than five
                working days while the alleged misconduct is being investigated.

        6.2.4   The student will be informed in writing (QAL/005/DP1) that they must
                not attend the college during that time. Note: No temporary exclusion
                should affect the students access to formal external examinations.

6.3     Stage 2

        6.3.1   If it is deemed necessary to pursue the matter further the student will
                be invited to attend a Disciplinary Committee hearing arranged to take

                place 2 to 3 weeks from referral to stage 2. The student will be advised
                in writing (Letter QAL/005/DP2) of :

                • the date and time of the hearing
                • details of the complaint
                • the student's right to attend
                • the student's right to representation (and if they are to be
                  accompanied that they should inform the College of the name and
                  status of the person)
                • the fact that witnesses will be called if appropriate
                • the fact that the hearing may proceed in their absence, unless they
                  are ill

        6.3.2 The Disciplinary Committee will decide what action is appropriate.
              Such action may include expulsion.

                If a student is expelled their Head of Faculty will arrange for them to
                receive appropriate advice on their future, for example, referral to
                Connexions or other agencies.

        6.3.3   The decision will be conveyed to the student in writing (Letter
                QAL/005/DP3). The student has the right to appeal against the
                decision of the Disciplinary Committee.


6.4     Stage 3

        6.4.1   Students have the right to appeal to the Principal who will call a
                Disciplinary Appeals Panel. Notification of appeal must be made
                within 5 working days. The Disciplinary Appeals Panel will inform the
                student of:

                •   the date and time of the hearing
                •   the student's right to attend
                •   the student's right to representation
                •   the fact that the Panel may proceed in their absence

        6.4.2   The Disciplinary Appeals Panel decision is final and will be conveyed
                to the student in writing (Letter QAL/005/PD4).

7.      Records produced

        7.1     Notes of Head of Faculty's investigation
        7.2     Notes of Disciplinary Committee. Copies of these will be held on the
                student file for three years
        7.3     Notes of Appeals Panel
        7.4     Letters QAL/005/DP1 to QAL/005/DP4 as applicable (Appendix 1)
