					THE STATE OF TEXAS

COUNTY OF ORANGE

                      BE IT REMEMBERED that a Special Court Session was held on Monday, July 17, 2006 at
2:00 P.M. in the Commissioners’ Courtroom of the Orange County Administration Building with the following in
attendance:

                           Carl Thibodeaux,            County Judge
                           James Stringer,             Commissioner, Precinct No. 1
                           Owen Burton,                Commissioner, Precinct No. 2
                           John Dubose,                Commissioner, Precinct No. 3

Absent was:                Beamon Minton,              Commissioner, Precinct No. 4


                        The meeting was called to order at 2:10 P.M., Scott Kerrwood gave the invocation, Carl
Thibodeaux led in the Pledge of Allegiance, and the following business was transacted, to-wit:


                       Agenda items are in the order they were taken in the meeting.


   APPROVE             Motion made by John Dubose, seconded by Owen Burton approving the minutes of the
   MINUTES             Regular Court Session held on July 10, 2006, as circulated.

                       All Voted AYE. Motion Carried.


2. BILLS PAID          Motion made by James Stringer, seconded by Owen Burton authorizing payment of bills
                       approved by the County Auditor as per attested listings and also specifically as follow:

                       a. $95,474.19 to Merit Construction from General Fund (01.111.5519) for repairs to
                          County buildings due to Hurricane Rita.

                       GENERAL FUND          $261,690.54
                       ROAD & BRIDGE           32,559.45
                       MOSQUITO CONTROL         5,045.91
                       ADULT PROBATION          4,416.29
                       ---------------------------------
                       TOTAL FOR PAYMENT     $303,712.19

3. PRE-ALLOWED         Motion made by John Dubose, seconded by James Stringer accepting for recording in the
   LINE ITEM           minutes of the Court the County Auditor’s June, 2006 report of pre-allowed Line Item
   TRANSFERS           Transfers, per Commissioners’ Court policy.

                       All Voted AYE. Motion Carried.

4. KISHI ROAD          Motion made by John Dubose, seconded by Owen Burton approving an agreement between
   AGREEMENT           the County of Orange, Texas and the Texas Department of Transportation for two (2)
                       Memorial Marker Signs. The “Kishi Road” named highway marker will be fabricated and
                       erected at each end of FM 1135, from IH-10 to FM 105 in Orange County. Orange County
                       will pay the State a sum of $700.00 for costs incurred by the State for the project prior to
                       installment of the signs.

                       All Voted AYE. Motion Carried.
5. FILL VACANT    Motion made by Owen Burton, seconded by James Stringer appointing Bill Stutes to fill the
   POSITION       vacant position of the Orange County Emergency Services District #4 Board of Commission-
                  ers.

                  All Voted AYE. Motion Carried.


6. CLOSED         Motion made by Owen Burton, seconded by James Stringer authorizing Orange County
   RAILROAD       Commissioners’ Court to send a letter to Union Pacific Railroad Company and the Texas
   CROSSINGS      Railroad Commission, requesting existing railroad crossings, both private and public, NOT be
                  closed in the Womack Road area of Orange County, Texas. These crossings are vital for
                  future industrial development and the current safety of farming and industrial operations in
                  Orange County.

                  All Voted AYE. Motion Carried.


7. FILL VACANT    Motion made by James Stringer, seconded by Owen Burton approving the filling of a vacated
   POSITION       tax clerk position and waiving the ninety day waiting period. Waiver requested due to training
                  time needed before tax collection season arrives.

                  All Voted AYE. Motion Carried.


8. VEHICLE REG.   Motion made by John Dubose, seconded by James Stringer to leave the vehicle registration
   ADDITIONAL     fees as they are for the calendar year 2007 with no additional fees added on.

                  All Voted AYE. Motion Carried.


9. NIMS           Motion made by John Dubose, seconded by James Stringer authorizing Orange County to
   TRAINING       move forward with the IS 700 NIMS Introduction training, which has to be completed by
                  September 30, 2006 by the Orange County Commissioners’ Court and all pertinent personnel
                  that were designated when Orange County Commissioners’ Court adopted the NIMS
                  Emergency Management Policy.

                  All Voted AYE. Motion Carried.


10. REPLACE       Motion made by John Dubose, seconded by James Stringer authorizing the replacement of one
    MOSQUITO      (1) ¾ ton pickup truck used for spraying purposes by Mosquito Control District to be paid for
    CONTROL       out of Capital Outlay Contingency.

11. MOSQUITO      Motion made by John Dubose, seconded by Owen Burton moving $25,000.00 from Regular
    CONTROL       Contingency to fund the purchase of additional chemicals needed for continued mosquito
    CHEMICALS     abatement through fiscal year ending 2005-2006.

                  All Voted AYE. Motion Carried.
12. TRANSFER          Motion made by James Stringer, seconded by Owen Burton authorizing the transfer of the
    ASSETS            following assets:

                      Asset #10744 (a Compaq Laptop Computer) from Election Administrator to Surplus

                      Asset #10745 (a Compaq Laptop Computer) from Election Administrator to Surplus

                      Asset #9281 (a Frederick AC Unit) from Park to Surplus

                      Asset #13067 (a Laserjet Printer) from MIS to Election Administrator

                      Asset #10845 (a Desk Unit) from Purchasing to Commissioners’ Court

                      All Voted AYE. Motion Carried.


13. APPOINT           Motion made by James Stringer, seconded by Owen Burton appointing Mark Wimberley, Tina
    SELECTION         Leverett, Ladonna Alford, Janell Duchamp and Commissioner James Stringer to the Selection
    COMMITTEE         Committee to review the Request for Proposals for two (2) Modular Buildings for the
                      Election Administrator.

                      All Voted AYE. Motion Carried.

14. ADVERTISE         Motion made by John Dubose, seconded by Owen Burton allowing the Purchasing Agent to
    FOR BIDS          advertise for proposals on a Disaster Recovery Package.

                      All Voted AYE. Motion Carried.


15. COMMENTS          John Dubose asked about what the Corps of Engineers was doing with the chips at the landfill.
                      Carl Thibodeaux informed the Court that there would be Budget Workshops on Wednesday.


1. DISEASE    Motion made by John Dubose, seconded by Owen Burton authorizing Orange County to
   MANAGEMENT participate in the Disease Management Program offered by TAC at a cost of $3.40 per
   PROGRAM    employee.

                      All Voted AYE. Motion Carried.


16. ADJOURN           There being no further business a motion was made by James Stringer, seconded by
    COURT             John Dubose to adjourn the Commissioners' Court meeting.

                      All Voted AYE. Motion Carried.
                      Carl Thibodeaux adjourned Court.
