                                    NOTICE OF MEETING


Pursuant to Chapter 551 of the Texas government code, this notice is to advise that a special meeting of
the Smith County Commissioners Court will be held at 8:15 a.m. on Wednesday, March 4, 2009 in
the Smith County Commissioners Courtroom on the 1st floor of the Smith County Courthouse
Annex, 200 E. Ferguson, Tyler, Texas.

CALL TO ORDER

PUBLIC SESSION:


PUBLIC HEARING- 8:15 A.M.

 1. Receive public input regarding proposal to create Tyler Airport Reinvestment Zone #1 (Faulconer,
    Inc.).

PUBLIC SESSION:
                                              AGENDA

 2. Approve and/or ratify payment of accounts, bills, payroll, transfer of funds, and health claims.

       a) Consider approval of a budget transfer for IT Department from Contingency to
          Miscellaneous Contracts in the amount of $20,000.00.

 3. Discuss, consider, and take any action necessary to allow the residents of Wooded Acres
    Subdivision, Lindale, Texas the option to be excluded from the Smith County Animal Control
    Ordinance, as described in the ordinance.

 4. Discuss, consider, and take any necessary action regarding recommendation from the Smith
    County Tax Abatement Committee for a proposed Tyler Airport Reinvestment Zone #1
    (Faulconer, Inc.), including but not limited to the creation of the zone, approval of abatement
    contracts, and entry of any related orders.

 5. Discuss, consider and take any action necessary to authorize Purchasing Director to advertise and
    request sealed bids for the following commodities for Smith County:

      a)   Refmed Road Oil, RB-06-09
      b)   Automotive Parts, RB-07-09
      c)   Pavement Markings, RB-08-09
      d)   Sand, RB-09-09
      e)   Parking Lot, NE Ferguson, G-0 1-09
      f)   Construction Manager for Smith County, RFQ-01 -09.
   6. Discuss, consider, and take any action necessary to approve, effective March 9, 2009, the Order
      for Local Option Election Upon Presentation of Verified Petition Legalizing the Sale of Mixed
      Beverages in Restaurants by Food and Beverage Certificate Holders Only within the
      corporate limits of the City of Winona, Texas.

   7. Discuss, consider, and take any action necessary to approve, effective March 9, 2009, the Order
      for Local Option Election Upon Presentation of Verified Petition Legalizing the Sale of All
      Alcoholic Beverages for Off-Premise Consumption Only within the corporate limits of the City
      of Winona, Texas.

   8. Discuss, consider, and approve the donation of several old and obsolete computer items from
      storage to Mustard Seed Ministries.

   9. Take tour and conduct on site inspection with Courthouse cleaning vendor; discuss project as
      necessary.

EXECUTWE SESSION: To consult, receive, and seek advice from attorney pursuant to Section
55 1.071 of the Texas Government Code.

10.     Receive and seek legal advice regarding proposed general release form for refund of defendant’s
        costs for Justice of the Peace #5.

PUBLIC SESSION:

11.     If necessary, discuss, consider, and take any action relevant to general release form for refund of
        costs for Justice of the Peace #5.

PUBLIC COMMENT:              An opportunity for members of the public; who have previously filled out
a participation form to address the Commissioners Court on agenda items and/or request a matter on a
future agenda. Individuals are limited to a maximum of three (3) minutes. The Court may not
deliberate on non-agenda items.

SMITH COUNTY COURTHOUSE ANNEX ACCESSIBILITY STATEMENT FOR DISABLED PERSONS This meeting site is
accessible to disabled persons as follows: Entrance to the Courthouse Annex is accessible through the front entrance on the south
side of the Courthouse Annex located at 200 E. Ferguson. A wheelchair ramp provides access to the front entrance. The
Commissioners Courtroom is on the first floor. If any special assistance or accommodations are needed in order to attend a
Commissioners Court meeting, please contact Commissioners Court staff at 903-590-4600, in advance so accommodations can be
arranged.
