Pursuant to Chapter 551 of the Texas government code, this notice is to advise that a regular meeting
of the Smith County Commissioners Court will be held at 9:00 a.m. on Monday,
January 26, 2009 in the Smith County Commissioners Courtroom on the 1st floor of the Smith
County Courthouse Annex, 200 E. Ferguson, Tyler, Texas.

9.        Receive North East Texas Regional Mobility Authority (NET RMA) Annual Report to Smith
          County from Mr.Tab Beau.

10.    Discuss, consider, and take any action necessary to approve the reappointments of Gary
       Haibrooks and Tab Beall to the NET RMA Board of Directors.

11.       Receive brief report on Smith County Transportation Advisory Committee (STAC) and the East
          Texas Transportation Coordination Steering Committee from Mr. Jamal Moharer.

12.    Discuss, consider, and take any action necessary to address contract amendments between Texas
       True Choice/Viant and Baylor Health Care System hospitals that impact the County’s
       healthcare contract with HealthFirst TPA.

13.    Receive letter from Smith County Community Supervision and Corrections Department
       regarding 2008 delinquent child support funds collected.

14.    Discuss, consider, and take any action necessary to accept The Texas Task Force on Indigent
       Defense Statement of Grant Award FY2009 Formula Grant.

15.    Accept 2008 Racial Profiling Report from Constable Precinct 4.

16.    Receive FY09 Projects Update, take any action necessary.

17.    Discuss, consider, and take any necessary action to approve the ThyssenKrupp Elevator contract
       for elevator modernization for the Smith County Courthouse.

18.    Receive into minutes the Certificates of Course Completion for Public Information Act and
       for Open Meetings Act for Commissioner Terry Phillips and Commissioner Jeff Warr.

19.    Discuss, consider, and take any necessary action to approve the Spindlemedia contracts,
       including the Software Licensing Agreement and the Software Maintenance Agreement.

20.    Take any necessary action to release securities pledged by the County’s depository, Southside
       Bank in the amount of $15,000,000.00.

21.    Accept Auditor/Treasurer financial report for November 2008.

22.    Receive status report from the Road & Bridge Department regarding number of miles completed
       for the Road Reconstruction project; and receive update on any other Road & Bridge
       Department items.

23.    Report on Smith County Jail Inmate Status and related information.

EXECUTIVE SESSION: To consult, receive, and seek advice from attorney pursuant to Section
55 1.071 of the Texas Government Code.

 24.   Receive consultation and seek legal advice regarding Public Information Act requests for Legal
       Department memorandums covered by the attorney-client privilege.                   Specifically,
       OR-2008-00303. No action necessary.

PUBLIC COMMENT:               An opportunity for members of the public; who have previously filled
out a participation form to address the Commissioners Court on agenda items andlor request a matter
on a future agenda. Individuals are limited to a maximum of three (3) minutes. The Court may not
deliberate on non-agenda items.

SMITH COUNTY COURTHOUSE ANNEX ACCESSIBILITY STATEMENT FOR DISABLED PERSONS This meeting site is
accessible to disabled persons as follows: Entrance to the Courthouse Annex is accessible through the front entrance on the south
side of the Courthouse Annex located at 200 E. Ferguson. A wheelchair ramp provides access to the front entrance. The
Commissioners Courtroom is on the first floor. If any special assistance or accommodations are needed in order to attend a
Commissioners Court meeting, please contact Commissioners Court staff at 903-590-4600, in advance so accommodations can be
arranged.
