OBJECTIVE

To provide guidelines for issuing orders under Section 124 of the Act relating to the keeping of
animals or birds on the premises.

POLICY STATEMENT

An order may be issued when it is considered that animals or birds should not be kept on a
premises or that animals and birds should be kept on a premises but in a specific manner and/or
restricted in the number kept on a premises.

STATEMENT OF PROCEDURES

1          CRITERIA
When any or all of the following occurs:
(a)        Pigeons are not being kept in accordance with Council’s adopted Pigeon (Approvals)
           Policy.
(b)        Where birds or animals are not being kept in accordance with Schedule 5 of the Local
           Government (Orders) Regulations 1993.
(c)        Any animals or birds that are being kept in such a state or location that is considered to
           be a nuisance or health hazard or are kept in such numbers that constitutes a health
           hazard as determined by an appropriate Council Officer.

2          NOTICE OF INTENT
Prior to the issue of an order, Council must advise the relevant person with a notice of intent to
give an order.

3          MEDIATION

Any person in receipt of a notice of intent may make representations on the proposal to Council
within a specified time.

4.         PENALTY

Any person not complying with an order may be liable to a penalty in accordance with Local
Government Act 1993.

A penalty notice (On The Spot Fine) may be issued for failure to comply with an Order.
