We Cannot Give You Legal Advice, But…. The Real Estate Commission strives to serve licensees and the public. However, often the Commission receives requests for advice on or interpretations of contractual obligations. We are unable to help with those requests because we cannot give legal advice. Similarly, the Commission cannot: • Approve or disapprove specific conduct; • Waive or modify any requirement of the statues and rules administered by the Commission; • Assist in resolving disputes about commissions or fees amongst licensees or between licensees and the public; • Recommend a brokerage firm, an individual licensee, or an approved school; or • Recommend specific law firms or specific attorney(s). For each of these, please contact your private attorney. However, the staff at the Commission can assist in many ways including the following: • Describing steps necessary to become licensed; • Explaining licenses can be transferred, placed on inactive status and reinstated; • Answering questions regarding continuing education; • Directing licensees to specific statutory and regulatory provisions; and/or • Giving out names and phone numbers of other agencies or organizations that might be of assistance to the caller. Because the Commission is often hard to reach, we recommend that you use the web site to learn: • How a complaint is filed and processed. • Whether a license is current. • What applications are needed.
