PURPOSE:

        To provide a consistent process for identifying and reporting victims of alleged or suspected
         abuse, neglect, or exploitation or neglect in compliance with applicable laws and regulations.

        To demonstrate support for the client’s right to be free from mental, physical, sexual and verbal
         abuse, neglect or exploitation.

        To demonstrate support for the client’s right to safety.

POLICY:

        __________________ is committed to promoting client safety and an environment that is free
         of abuse, neglect or exploitation to the best of its ability for all clients receiving care, treatment
         and/or services.

        __________________ employees are obligated to report known or suspected abuse, neglect
         or exploitation of clients; this includes dependent adults, elders, spousal or partner abuse,
         neglect or exploitation. Failure of staff, including contracted personnel, to report the suspicion
         or knowledge of abuse, neglect or exploitation of a client is considered unacceptable conduct
         and may result in disciplinary action up to, and including, termination.

        All clients/families/caregivers shall be notified at the beginning of care, treatment and/or
         services of the state abuse, neglect, or exploitation Hotline telephone number. The number is
         __________________.

        Healthcare professionals are not liable for either civil damages or criminal prosecution as a
         result of making such a report unless it is proven they made a false report with malice.

        The responsibility of __________________ ends with reporting of the observation to the
         appropriate agency.

        __________________ shall offer inservice training for staff on adult/child abuse, neglect or
         exploitation detection and reporting at least on a yearly basis, and more often if necessary.

DEFINITIONS:

        Dependent Adult:

                 Any person residing in this state, over the age of 18, who has physical or mental
                  limitations, which restrict his or her ability to carry out normal activities or to protect his
                  or her rights, including, but not limited to, persons who have physical or developmental
                  disabilities, or whose physical or mental abilities have diminished because of age.

        Physical Abuse:

                 The use of physical force against another person in a way that results in injury to the
                  person, or puts the person at risk of being injured.

        Elder Abuse:

                 The intentional or unintentional hurting, either physical or emotional, of a person who is
                  age 60 or older.

                 Fiduciary Abuse:

                         A situation in which a person, who stands in a position of trust with the elder,
                          willfully steals the money or property of that elder, or appropriates the elder's
                          money or property to any use of purpose not in the due and lawful execution of
                          his/her trust.

                 Neglect Includes:

                         Failure to assist in personal hygiene, or in providing food and clothing for an
                          elder.

                         Failure to provide medical care for an elder's physical and mental health needs,
                          although a person's voluntarily relying upon treatment by spiritual needs through
                          prayer in lieu of medical treatment does not constitute neglect.

                         Failure to protect an elder from health and safety hazards.

                         Failure to prevent an elder from suffering malnutrition.
