Mr. BOOZMAN introduced the following bill; which was referred to the
Committee on Veterans’ Affairs
A BILL
To amend title 38, United States Code, to expand eligibility
for vocational rehabilitation benefits administered by the
Secretary of Veterans Affairs.
1 Be it enacted by the Senate and House of Representa-
2 tives of the United States of America in Congress assembled,
3 SECTION 1. SHORT TITLE.
4 This Act may be cited as the ‘‘Early Access to Voca-
5 tional Rehabilitation and Employment Benefits Act’’.
6 SEC. 2. EXPANSION OF ELIGIBILITY FOR VOCATIONAL RE-
7 HABILITATION BENEFITS ADMINISTERED BY
8 THE SECRETARY OF VETERANS AFFAIRS.

9 Section 3102 of title 38, United States Code, is
10 amended—

1 (1) in paragraph (1)(B), by striking ‘‘or’’ at the
2 end;
3 (2) in paragraph (2), by striking the period at
4 the end and inserting ‘‘; or’’; and
5 (3) by adding at the end the following new
6 paragraph:
7 ‘‘(3) the person—
8 ‘‘(A) at the time of the Secretary’s deter-
9 mination under subparagraph (B), is a member
10 of the Armed Forces who is hospitalized or re-
11 ceiving outpatient medical care, services, or
12 treatment;
13 ‘‘(B) is determined by the Secretary to
14 have a total disability permanent in nature in-
15 curred or aggravated in the line of duty in the
16 active military, naval, or air service; and
17 ‘‘(C) is likely to be discharged or released
18 from such service for such disability.’’.
