The House Keeping for various Exchange buildings at Kancheepuram External (Urban areas)
Division are carried out by the approved contractor M/S. S.K.M. Enterprises, 9/4,
Narayanapalayam Street, Kancheepuram. The contract period of the same has expired on
30.06.2009 and administrative approval for House Keeping work by the same contractor for
3 months from 01.07.2009 to 30.09.2009 has already been obtained from GM (W), CHTD,
CH.. Now fresh tender is called for to carry out the housekeeping work from 01.10.2009.

The following particulars are furnished for the tender.

   TENDER NOTICE FOR HOUSE KEEPING AND ALLIED WORKS FOR THE TELEPHONE
      EXCHANGES IN KANCHEEPURAM EXTERNAL DIVISION (URBAN AREAS).

        For and on behalf of BHARAT SANCHAR NIGAM LIMITED, Sealed tenders are
invited by the General Manager West, BSNL, Chennai Telephones from reputed agencies for
"HOUSE KEEPING AND ALLIED WORKS" for the various Telephone Exchange
buildings at Kancheepuram Urban Division.

       Tender schedule along with terms and conditions can be had from the Divisional
Engineer External, Old Telephone Exchange building, Kancheepuram on written request
enclosing a crossed DD payable at Chennai obtained from any scheduled Bank drawn in
favour of BSNL, Chennai Telephones for Rs.520/- (Rupees Five hundred and twenty only)
(cost of form Rs.500/- + VAT 4%) between 10:00 hrs and 15:00 hrs from 16.09.2009
onwards.

       RATE BID should be submitted in the enclosed proforma of „RATE BID‟ in a
SEALED cover. An EMD for Rs.3000/- (Rupees Three thousand only) as crossed DD
payable at Chennai obtained from any scheduled Bank drawn in favour of BSNL, Chennai
Telephones should accompany the sealed Tender.

         Sealed tenders complete in all respects and superscribed as "TENDER FOR
HOUSE KEEPING AND ALLIED WORKS” addressed to, Divisional Engineer, External,
BSNL, Old Telephone Exchange building, Kancheepuram will be received up to 15:00 Hrs
of 26.09.2009 and will be opened at 15:30 Hrs on the same day in the presence of Tenderers
/ their authorised representatives.

        The General Manager West, BSNL, Chennai telephones reserves the right to accept
or reject all or any of the tenders without assigning any reason thereof. Incomplete tenders,
tenders received after the due date, conditional tenders and tender not accompanied by EMD
will not be entertained.

    TENDER SCHEDULE FOR HOUSE KEEPING AND ALLIED WORKS FOR THE VARIOUS
     TELEPHONE EXCHANGE BUILDINGS AT KANCHEEPURAM EXTERNAL DIVISION.
                              (URBAN AREAS)

I. TERMS AND CONDITIONS
 1. Please read the terms and conditions carefully before filling up the tender form. Any
      tender which is not in conformity with instructions is liable for rejection.
 2. This tender is for Housekeeping and Allied works for list of Telephone Exchange
      buildings at Kancheepuram External (Urban areas) Division. The RATE BIDs should
      be submitted in the enclosed proforma of „RATE BID” in a SEALED cover. The
      tenderer in his own interest must visit the place of work where Housekeeping and
      Allied works are to be carried out. The actual number of labourers likely to be involved
      / required for the work should be ascertained before participating in the bid.
 3. This tender document has the following parts:
     i.    Notice Inviting Tender
    ii.    Terms & Conditions, Work Specification, The Agency and its responsibilities,
           Mode of payment and Penalty clause.
   iii. Near Relative Certificate format
   iv.     RATE BID forms
    v.     EMD amount
 4. The bid shall be made only in the original official tender form.
 5. The tender forms are non-transferable and cost of tender schedule is not refundable.
 6. The rates shall be quoted in rupees both in figures and words without any ambiguity.
      The rates should be inclusive of all taxes including service tax if any at the prescribed
      rates.
 7. The offer shall be, preferably neatly typewritten or neatly handwritten, without erasure,
      overwriting, scoring off etc. If any correction is necessary the same should be made
      after scoring out the old entry. All the corrections should be duly attested with full
      signature by the tenderer. Any ambiguity will lead to invalidation of the tender. In case
      of difference between the rates quoted in figure & words, the rates in words will be
      taken as correct. Each page of the Tender schedule / Annexure / Certificate regarding
      near relatives / Rate proforma should be signed and dated.

 8. Offer with over -writings or illegible writing is liable for rejection.

 9. An Earnest Money Deposit (EMD) of Rs.3,000/- (Rupee Three thousand only) is
    payable by a crossed Demand Draft payable at Chennai obtained from any scheduled
    bank in favour of BSNL, Chennai Telephones. The DD should be enclosed with the
    completed tender schedule. Sealed tenders without EMD will not be accepted.

 10. The Earnest Money Deposit will not fetch any interest. The EMD will be refunded to
     the unsuccessful tenderers after finalisation of tender, on production of advance
     stamped receipt by the tenderers and completion of any other departmental formalities
     prescribed.

 11. The successful tenderer shall deposit an amount equal to 5% of total value of the work
     per year as Security Deposit, which will not fetch any interest. The EMD amount of
     Rs.3,000/- (Rupees Three thousand only) paid by the successful tenderer will be
     adjusted towards part payment of the Security Deposit. The balance amount of Security
     Deposit should be paid by crossed DD obtained from any Scheduled bank in favour of
     the BSNL, Chennai telephones or by means of Bank Guarantee.
 12. The Security deposit is payable as a Guarantee for the satisfactory performance of the
     contract.
 13. The Security deposit amount is liable to be forfeited if the successful tenderer fails or
     neglects to perform any of his obligations under the terms and conditions of the tender
     agreement and the house keeping and allied works carried out by him.
 14. The Security Deposit will be refunded on completion of the work to the satisfaction of
     the GM West, BSNL, Chennai telephones.
 15. After the acceptance of the contract, if any / all the terms and conditions of the contract
     is / are violated, the General Manager West, BSNL, Chennai Telephones reserves the
     right to terminate the contract. In such cases, the security deposit amount will be
     forfeited to the BSNL.
 16. The General Manager West, BSNL, Chennai Telephones reserves the right to terminate
     the contract by giving 15 days notice and without assigning any reason whatsoever.
 17. The successful tenderer shall enter into an agreement with the General Manager West,
     BSNL, Chennai Telephones for Housekeeping and Allied works. The EMD of the
     successful tenderer will be forfeited if they do not pay the Security deposit / not enter
     into agreement.
 18. The General Manager West, BSNL, Chennai Telephones reserves the right to cancel the
     letter of acceptance of tender and work order if the house keeping and allied works
     carried out by him fail to meet the specifications mentioned in the tender schedule,
     without prejudice to any other penal action he may choose to take against the tenderer
     with in the terms of the tender document. The General Manager, West, BSNL, Chennai
     Telephones shall not be responsible for any loss or damage suffered by the tenderer as a
     result of cancellation of the letter of acceptance and work order.
 19. The General Manager West, BSNL, Chennai Telephones reserves the right to award the
     contract to the selected bidders either in full or in parts. The decision of the General
     Manager West, BSNL, Chennai Telephones will be final and binding.
 20. The EMD and Security Deposit may be forfeited under the following conditions:-
            i)      Withdrawal of bid by the tenderer after finalisation of tender.
            ii)     Failure to accept the offer of tender and failure to remit the Security
                    deposit with in fifteen days of the acceptance of the tender.
            iii)    Non-performance of obligations as per the terms and conditions in the
                    agreement for house keeping and conservancy services.
            iv)     If the tenderer withdraws the tender during the validity period
            v)      If any unexcused delay in execution of work caused, such delay may
                    further warrant imposition of liquidated damages and/or termination of
                    contract.
 21. Non- sealed tenders/incomplete tenders/tenders received after the due date/tenders not
     accompanied with DD for EMD/conditional tenders will be rejected.
 22. Belated bids will be rejected and returned unopened to the bidders.

 23. No sub-contract is permissible. The General Manager West, BSNL, Chennai
     Telephones reserves the right to employ any other contractor under the same terms and
     conditions and approved rates, if the tenderer fails in his obligations or if exigencies
     arise.
 24. The General Manager West, BSNL, Chennai Telephones reserves the right to award the
     contract to the selected bidders either in full or in parts. The decision of the General
     Manager West, BSNL, Chennai Telephones will be final and binding.
 25. The General Manager west, BSNL, Chennai Telephones reserves the right to modify the
     terms & conditions and specifications before the issue of letter of acceptance to the
     successful tenderer if exigencies warrant such changes in the opinion of the General
     Manager West, BSNL, Chennai Telephones though normally such modifications will
     not be done.
 26. The General Manager West, BSNL, Chennai Telephones reserves the right to accept or
     reject all or any of the tenders without assigning any reasons there for. The decision of
     the General Manager West, BSNL, Chennai Telephones in this matter will be final and
     binding.
 27. The General Manager, west, BSNL, Chennai Telephones reserves the right to issue the
     work order for selected locations according to the actual requirements and exigencies. It
     is not mandatory to place work order for all locations in one go.
 28. The successful tenderer shall observe all instructions if any regarding Housekeeping and
     Allied works.
 29. The normal period of validity of tender shall be ONE YEAR from the date of signing of
     the agreement but can be renewed for a further period if exigencies warrant such
     renewal.
 30. In case of any dispute, the decision of the General Manager West, BSNL, Chennai
     Telephones will be final.
 31. Any dispute arising out of the agreement is subject to the arbitration rules under
     arbitration act 1996 (Arbitration and Conciliation act of 1996) and shall not lie with any
     civil court at the first instance. It is the tenderer‟s responsibility to have the copy of the
     Arbitration Act as mentioned above and it will not be supplied by BSNL. The arbitrator
     will be appointed by the General Manager West, BSNL, Chennai Telephones and the
     award of the arbitrator shall be final and binding on both the parties.
 32. No open offer in the form of Telex/Telegram/Fax/over Telephone will be acceptable.
 33. No correspondence will be entertained over this tender before opening.
 34. If the date of opening of tender is declared as a holiday for any reason, automatically the
     next working day will be the last day for receipt/opening of the tender with the same
     timings.
 35. The General Manager west, BSNL, Chennai Telephones reserves the right to employ
     more than one contractor for Housekeeping and Allied works. He also reserves the right
     to conduct negotiations subject to the existing BSNL/DOT rulings on the subject.
 36. The offer will be opened in the presence of the tenderers or their authorised
     representatives at the date and time specified in the tender notice.

  37. No one will be permitted to alter the rates on or after submission of tenders.
  38. The following documents shall be enclosed with the sealed tender offer:
      i)       The Rate Bid indicating the rates should be submitted in a wax sealed cover
      ii)      Crossed DD for EMD of Rs.3,000/- (Rupees Three thousand only).
      iii)     Documentary evidence for registration of firm, labour licence, ESI / PF with
               statutory authorities.
      iv)      Experience certificates for a minimum period of two years from comparable
               companies / firms.
  39. The General Manager West, BSNL, Chennai Telephones or his authorised subordinate
      officers will not be responsible for late receipt / non receipt of the offer due to the postal
      delay or delay in delivery by courier. It will be the responsibility of the prospective
      bidder to ensure that his bid reaches the officer concerned well ahead of the deadline.
  40. It has been decided by the BSNL Board that the near relatives of all BSNL employees
      either directly recruited or on deputation are prohibited from participation in tenders and
      execution of works in the different units of BSNL.
The near relatives for this purpose are defined as:
i.        Members of a Hindu undivided family,
ii.       They are husband and wife,
iii.      The one is related to the other in the manner as father, mother, son(s) & sons wife
          (daughter-in-law), daughter(s) & daughters husband (son-in-law), brother(s) &
          brothers wife, sister(s) & sisters husband (brother-in-law).

The company or firm or any other person is not permitted to tender for works
in BSNL unit in which his near relative(s) is (are) posted. The unit is defined as SSA / Circle
/ Chief Engineer / Chief Architect / Corporate office for non-executive employees and all
SSA in a circle including Circle office / Chief Eng. / Chief Archt / Corporate office for
executive employees (including those called as Gazetted officers at present). Therefore it has
been decided by the competent authority that the tenderer should give a certificate that none
of his / her such near relative is working in the units as defined above where he is going to
apply for tender / work. In case of proprietorship firm, certificate will be given by the
proprietor, for partnership firm will be given by all the partners and in case of limited
company by all the Directors of the company. Any breach of these conditions by the
company or firm or any other person, the tender / work will be cancelled and earnest money /
security deposit will be forfeited at any stage whenever it is so noticed. The department will
not pay any damages to the company or firm or the concerned person. The company or firm
or the person will also be debarred for further participation in the concerned unit.

  41. The tenders complete in all respects duly signed in each page shall be sent in sealed
      cover superscribed “TENDER FOR HOUSE KEEPING AND ALLIED WORKS” should be
      addressed to

II. WORK SPECIFICATION
A. DAILY SERVICES
1 The tenderer has to execute the work between 8 AM and 4 PM on all days except
     Sundays and Holidays. Under special circumstances the man power should be provided
     during other hours, Sundays and holidays, if required.
2 Dusting of furniture, cupboards, office equipments, Telephones and cleaning with soap
    oil or liquid cleaners wherever required.
3 Vacuum cleaning and brushing of telephone exchange equipments, carpeted-areas and
    computers, typewriters, copiers etc.
4 Cleaning of air conditioner grills.
5 Sweeping and cleaning of entire floors area of the buildings and open area daily.
6 Removal of waste papers and wastes from Dust bins.
7 Disposal of garbage and burning of garbage.
8 Filling of water filters and cleaning of glasses, water jugs, flasks and water drums.
9 Cleaning of windowpanes, glasses and stains/dirt on glasses to be removed as and when
    noticed.
10 Arranging furniture for meetings, bringing refreshments from canteen /hotels and
    serving.
11 Providing drinking water (hot and cold) to all staff working in office twice or thrice a
    day.
12 Cleaning of bathrooms, toilets, toilet floor, ceramic tiles of the side wall, flush outs,
    urinals, wash basins, closets etc twice a day by providing sufficient quantity and standard
    disinfectants.
13 Cleaning of bathrooms, toilets, urinals, wash basins etc. four times a day by providing
    sufficient quantity and standard disinfectants in Old Telephone Exchange building.

B.   WEEKLY SERVICES
1    Cleaning of fans, tube lights and fittings including changing, if the same is required.
2    Removal of cobwebs, cleaning of file racks.
3    Mopping of floors of entire building with phenyl & soap oil.
4.   Cleaning of open terrace.

III. THE AGENCY AND ITS RESPONSIBILITIES
1 The materials used for the House keeping and Allied works shall be of standard make.
    The cost of the cleaning materials including cleaning Acid, liquid soap, cobweb remover,
    mop, broomsticks, naphthalene balls/phenyl etc. are to be borne by the tenderer.
2 The agency should be a reputed and registered one and should have experience in house
    keeping and allied services.
3 In case of additional requirement of house keeping, the agency should be in a position to
    get the work done, at contract rates only.
4 In case it is found by the BSNL that any property or materials of the BSNL is lost or put
    to loss / damage due to the negligence of the agency, the agency will be held fully
    responsible and should reimburse the cost of the loss / damage so incurred. The decision
    of the GM west, BSNL, Chennai Telephones as to the quantum of loss and negligence is
    final.
5 The BSNL shall stand indemnified against any claims arising due to injury/damage to
    any property or any human being during the currency of contract on account of any act of
    omission/commission on the part of the contractor or his failure / negligence to take
    adequate precautions, such claims will be borne by the contractor in full.
6 The successful contractor shall ensure that persons employed by him are paid the
    minimum wages as stipulated and revised from time to time under Minimum Wages Act,
    1948. He should also ensure that the payment is made before 5th of the following month
    to which the wages are related. In this regard, he should also ensure that statutory records
    are maintained and shall be made available whenever required by Central / State Govt.
    authorities. He should follow the relevant labour rules in force scrupulously.
7 The firm should maintain attendance card cum wages slip, employment card service
    certificate, labour records etc. as per contract labour regulation act and relevant rules.
8 The firm should have been duly registered and licenced under contract Labour
    (Regulation and Abolition) Act, 1970. The tenderer shall produce documentary evidence
    for Registration, Licence number and date (the licence period should cover upto the date
    of validity of the tender). He shall also mention ESI and PF number.
9 The contractor should indicate the ESI number as well as EPF number of the contract
    workers. The contractor should be responsible for all labour regulations including
    Employees Provident Fund act, Employees State Insurance Act, payment of gratuity act,
    minimum wages, ESI, EPF etc.
10 No child labour will be permitted. The contractor should supply manpower with
    identified uniform with name badges and identity card.
11 The General Manager west, BSNL, Chennai telephones shall not be responsible fully or
    partially to any labour or other dispute that may arise between the contractor and their
    work force.
12 The labourers provided by the contractor should be supervised properly. The contractor
    shall be responsible for the discipline of the worker working under him. If at any time it
    is found that the worker is indulging in acts of misbehaviour or misconduct etc. the firm
    has to take suitable action in this regard.
13 When complaints are made by the offices of the building, against any member deployed
    by the contractor, immediate action should be taken by the contractor to withdraw such
    personnel and replace them by others who are acceptable to the O/o General Manager
    west, BSNL, Chennai telephones.

14 The persons employed by the contractor for execution of the work shall be deemed to the
   employees for the contractor and the contractor shall be responsible for Payment to them
   of their salaries / wages and any other amount due to them and providing them such
   amenities and facilities as they may be entitled to under any law or act applicable to their
   employment.
15 The contractor shall be responsible for making such payments as may become applicable
   to the staff employed by them under the provisions of the workmen‟s Compensation act
   in case of any accident or eventuality during the course of work by the worker..
16 The contractor shall not assign the work to a third party on subcontract with any other
   agency or company.
17 The contractor ensures that no member of the personnel or employees shall get himself /
   herself involved in any trade union activities

IV. MODE OF PAYMENT TO THE AGENCY

The bills for the work executed in each month will be submitted in triplicate to the authority
who issues the work order. The payment will be made on monthly basis on submission of the
claim by the agency based on the actual days of work performed by the agency for the
previous month. Work will be considered to be complete only if certified by the designated
unit officer that the work has been executed satisfactorily and the certificates should be
countersigned by the respective Divisional Engineers. Bills will be settled after deduction of
Income Tax as per rules in force. The payment will be made by crossed cheque only. If any
of the person sent by the agency for work fails to carry out the work or absent from work as
per the terms and conditions laid proportionate reduction of charges will be made on prorate
basis. In case of any delay in payment, no interest shall be payable to the tenderer on the
value of the bill.

V. PENALTY

Penal deductions, not exceeding 2% of the amount payable in any bill, will be made for poor
services on the basis assessment by the BSNL authorised officers. . The decision of the
General Manager West, BSNL, Chennai telephones regarding the nature and quantum of
penalty shall be final and binding. In case of willful negligence in housekeeping and allied
works without satisfactory reasons, the tenderer runs the risk of being blacklisted, besides
forfeiture of Security Deposit.
