WEB SITE HOSTING TERMS AND CONDITIONS
Terms: 1. The Customer's first billing period starts on the day the account is activated. 2. Hosting fees are due prior to commencement of hosting service. Hosting fees are billed on a quarterly basis. 3. Domain name registration fees are the responsibility of the customer and are billed via email from Internic. Currently Internic charges $70 for the first 2 years and $35 for each additional year. See the Internic for details. (www.internic.net) 4. Digital Widgets will not refund any setup fee once an order has been placed. 5. Digital Widgets will refund the customer for unused prepaid hosting charges, unless the Customer is in violation of the usage terms below, for services canceled with more than 30 days remaining. The refund will be in the amount of all remaining full months of hosting. Usage Terms: 1. The Customer will not attempt in any way to deny service or access to others using the Internet by such means as mail bombings, software pirating, or mass mailings. 2. The Customers password is secure and will be treated as private and confidential. 3. Customers will not be allowed to use excessive amounts of CPU processing on any of our servers (we are very lenient). 4. Digital Widgets will not be held responsible in any way for any information lost or destroyed by the Customer or anyone the Customer has given his or her password, or due to the mis-use of the virtual server. This includes unauthorized "hacking" due to the use of poorly written ASP/CGI programs and scripts. 5. Digital Widgets will not be held responsible in any way for any information lost or destroyed due to system outage or failure. While Digital Widgets provides daily tape backups of all servers, with weekly tapes removed to off-site storage, the Customer retains responsibility for backup of source material. 6. Digital Widgets liability is limited to refund of hosting fees in the event of a system outage or failure. 7. The Customer agrees to not use any illegal, offensive or pornographic material on their virtual server. Use of this material will be grounds for termination of the Customers account. 8. Digital Widgets retains the right to refuse service to any Customer who is in violation of any of the above. 9. Digital Widgets will not refund the Customer in any amount for the remainder of the Customers billing period if the Customer is in violation of any of the above.
