COLLECTIONS SEMINAR This seminar will cover all of the key legal issues that impact delinquent vehicle loans, repossessions, and the disposition of collateral. Credit union collectors and collection departments must have a thorough and correct understanding of what to do, what not to do, and how to do it. Participants will gain a clear understanding of the legal duties and obligations that must be met in this critical operational area. In addition, guidelines, procedures and policies that must be in place to avoid liability will be covered. More consumer lawyers are focusing on this area of credit union collection activity than any other. It is critical that credit union collectors know the law and comply in order to avoid potential liability for their credit union as a result of wrongful repossession. BANKRUPTCY SEMINAR The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 introduced sweeping changes to consumer bankruptcies. Now, over a year after its effective date, the impact of the BAPCPA is truly being felt. The 2007 bankruptcy seminars will focus on the new law, cases interpreting that law, local rules and practices, and the many revisions to bankruptcy policy and procedure that credit unions need to implement to maximize their return under the new legislation. The seminars will emphasize, among other topics: • • • • • • new credit counseling rules new procedures to ensure expedited bankruptcy notices sweeping changes to reaffirmations new limits on Chapter 7 eligibility expanded ability to except debts from discharge significant limitations on Chapter 13 "cramdowns"
