REPORT FROM THE ARIZONA LEGISLATURE

       Life at the Legislature has been like a giant roller coaster – one minute we are down and
the next we are up. We are still struggling to get our AHCCCS bill (SB1085) passed, along with
our medical necessity review bill (SB1154). In the meantime, we are working to revive the
language of HB2644 which would prohibit Chiropractic Board members from working for
insurance companies except for provision of patient care.

        Most recently, the AHCCCS bill, SB1085, passed the House Health and House
Appropriations Committees. The debate is now down to whether the bill will cover all 1 million
AHCCCS enrollees, or only 300 enrollees for a 3 year “pilot program” to determine costs. The
time has come for you to flood your House of Representatives members asking them to support
SB1085 for the entire AHCCCS program, not just a small pilot group. You should call and email
the reps for both your home and office district. Find their names and email addresses at
www.azleg.gov. If you have any questions about how to do this, call ACS at 602-368-9496.

        The medical necessity review bill, SB1154, would allow HMOs to use DCs to sign off on
claims denials instead of the current mandate for an MD or a DO. We are “testing the waters” to
see if we can expand this bill to require all HMOs to disclose the guidelines they rely upon to
determine the medical necessity of chiropractic care. With this information we could show
legislators what is really going on.

        HB2644, the Chiropractic Board bill, failed in the Senate Health Committee by a vote of
3-4 because one key senator couldn‟t believe that Chiro Board members could be biased just
because they have received thousands of dollars from auto insurers. Another no vote came
because a senator believed the bill should apply to all Boards, not just Chiro. The writing is on
the wall – either this year of next we will get a bill prohibiting Board members from being agents
of insurers. In the committee hearing, the Chiro Board‟s lobbyist actually admitted that passage
of such a law would have a negative effect on two of the three DC Board members. What a
surprise!

         You can be sure that, through thick and thin, we will never stop working for you and
chiropractic. And what’s more, there are no “ACS bills” or “AAC bills” this year, just “ACS/AAC
bills.” A united front at the Legislature has clearly increased our chances of success this year.

UNITED HEALTHCARE FINED RECORD AMOUNT BY AZ DEPT. OF INSURANCE
       Your complaint and grievance letters are working! United HealthCare has recently been
fined more than $350,000 by the AZ Dept. of Insurance for continuing violations of state law
including:

• United's health care plans failed to provide health care appeals information packets to members
within five day as required by law.

• The insurer didn't send the right information about the process to help patients contest the
insurer's decisions to deny care.

• United didn't respond within the required time to patients who contested its denials of care, nor
did it provide written information to patients on why their treatments were denied.

• United paid no interest or too little interest to physicians on undisputed claims that it paid late.

• The insurer outright denied claims from health care providers before asking for extra
information.

• The insurer didn't resolve provider payment disputes in a timely way.

        In addition to being fined, United is also being required to file a corrective action plan. It
will have to report to the insurance director on a monthly basis until matters are resolved.

of state government. The Director of the AZ Dept. of Insurance has made it perfectly clear that
she will not allow insurers to violate state law. Be sure to continue to file complaints with ADOI

CHIROPRACTOR AND ACS MEMBER DENNIS KIRSTEN ANNOUNCES RUN FOR
STATE HOUSE OF REPRESENTATIVES
       From the AZ Daily Sun in Flagstaff, February 19, 2006: “Chiropractor and Republican
Dennis Kirsten of Window Rock is running to represent District 2, including Flagstaff and the
Navajo Nation, in the Arizona House of Representatives. Democratic incumbents Ann
Kirkpatrick and Albert Tom have both formed re-election committees for the fall.
       Kirsten, a chiropractor for the last 21 years and a married father of four, is running as a
Clean Elections candidate. He moved to Arizona from California in 1984 and started a practice
in Window Rock. He's running, he said, because, „I believe that Flagstaff, the Navajo Nation,
and the Hopi Tribe are getting shortchanged in Phoenix due to the lack of Republican
representation from our District.‟”
        Note from Dr. Immerman: “I had the pleasure of serving with Dr. Kirsten on the Board of
Directors of the AZ Chiropractic Alliance when it was formed in 1989. He is extremely
dedicated to the Chiropractic profession in Arizona and ACS strongly endorses his election

IMMERMAN CONSULTING TIP OF THE MONTH
       The topic of this month’s tip is the Arizona Chiropractic Board of Examiners. As reported
by many observers, the Chiro Board has gone overboard in disciplining doctors, especially in
response to complaints filed by insurance companies which have been coming in fast and thick.
Minor documentation errors are being elevated to insurance fraud.
       The Board is very active. Right now there are approximately 60 doctors on probation with
the Board. Ten years ago the number was 3-4.
         If you receive a Board complaint, we invite you to call ACS. We can refer you to an attorney
who will be the best for your issue. We can also give you an overview of the process which we have
found greatly decreases the anxiety associated with Board complaints. Members, don’t hesitate to
call if you have a Board complaint. We will show you how to move through the process with the
least harm.

ACS PROVIDES INPUT INTO CIGNA HEALTHCARE PROVIDERS ADVISORY
COMMITTEE MEETING
        As a condition of settlement of the lawsuit between CIGNA and a number of plaintiffs
including ACS and the ACA, CIGNA agreed to consider our grievances on a regular basis at special
meetings. The next meeting is April 11, 2006 and, based on an ACS request, the following will be
considered:
1. ASHN and ASHP determine medical necessity through reliance on chiropractic guidelines that are
kept secret from the profession, and which do not represent the standard of care in chiropractic.
The ASHN/ASHP guidelines have never received general acceptance by the chiropractic profession.
They are essentially drafted by a small handful of chiropractors who are far out of the mainstream.
We want an agreement that CIGNA will disclose the guidelines they rely on in determining medical
necessity for chiropractic care. We also want CIGNA to agree to base their claims decisions on
guidelines that have received general acceptance by the profession.
2. ASHN and ASHP bundle chiropractic services into a single code for each day of service. This
drastically reduces the amount which can be charged for per visit.
3. The paperwork requirements remain onerous.
       We will let you know what happens at this important meeting.
