I hereby make application for a licence to place a stall on the Braintree Wednesday Market, each week,
particulars of which are stated below:

If accepted as a Stallholder, I agree:
a)      To pay the rent for the stall regularly on demand.
b)      To observe and comply with all bylaws, statutes and orders that relate to Markets and the sale of the
        goods specified below.
c)      To observe and perform the terms and conditions set out on the back of this form and any other
        conditions as may be made from time to time by Braintree District Council of which I shall have
        been previously notified.
d)      That this licence is personal to me and cannot be transferred to a third party.

     Terms and Conditions to be observed in respect of the placing of a stall at any
                        Braintree District Council Market.
1.       This licence shall continue from week to week until terminated by 24 hours notice given by the
         Council at any time. The Stallholder must place a stall at the Market every week unless otherwise
         agreed with the Council

2.       The Stall shall be kept in the space allocated by the Council from time to time and the Stallholder
         must keep the avenues adjoining the Stall clear and free from refuse and litter.

3.       The Stall shall only be used for the sale of goods specified overleaf and the same shall be available
         for sale during the period commencing no later than 10.00am and ending no earlier than 3.30pm. The
         Stall and all unsold goods shall be removed by 5.30pm.

4.       The Council reserves the right to deny permission to sell any goods which it deems unsuitable. For
         example, no toy guns capable of discharging a projectile of any sort will be permitted to be sold on
         the Council’s Markets.

5.       The Stall shall only be used by the Stallholder and his employees. The Stallholder shall not do or
         allow anything to be done which may cause or be a nuisance or annoyance to any member of the
         public or which may be detrimental to the efficient operation of the Market.

6.       Stallholders are expected to treat their colleagues and all our visitors and residents with respect.

7.       No traders vehicles will be placed on the Market site, other than for loading and unloading, without
         the permission of the Markets Superintendent and, where relevant, Traffic Wardens.

8.       The Stallholder shall exhibit his name on a board or fascia, the size, style and colouring of which is
         to be approved by the Markets Superintendent.

9.       The Stall shall be kept in an orderly manner, clean and free from litter. No heating or lighting
         apparatus shall be installed without the permission of the Markets Superintendent.

10.      At all times throughout the day the Stallholder shall place all refuse neatly in the trailers provided by
         the Council for this purpose.

11.      The Stallholder shall:
                 (i)     indemnify the Council against all costs, demands, claims proceedings and actions
                         incurred by the Council relating to or arising out of the use of the space allocated by
                         the Council and
                 (ii)    obtain and maintain Public Liability Insurance with a minimum indemnity limit of
                         £1,000,000 (one million pounds) and shall produce to the Council evidence of such
                         insurance on request.
