Terms of Rental Agreement (Sample) www.yourhomeinsf.com Revised: July 25, 2009 The tenants agree in consideration of the use and occupancy of the premises herein specified: 1. To use said premises as a residence ONLY. No more than Four people may reside there unless agreed in writing. 2. To abide by Condominium Rules: NO PETS. NO SMOKING ANYWHERE ON PREMISES. NO PARTIES. Tenants may not arrive the first day before 3pm or leave the last day after 11am without written permission from the owner. Tenants must lower stereos and TVs from 9 p.m. until 9 a.m. Sunday night thru Friday morning then between 11 p.m. and 10 a.m. thru Sunday morning. Only one compact or mid-sized car allowed in the garage - NO Full size or SUV. Tenants shall not park in any area except the space provided and shall insure their auto does not inhibit the other tenant from using their space. Vehicles that cannot fit in the parking space provided must be parked on the street. Tenants who do not abide by these rules may be asked to leave immediately and will forfeit their Security Deposit. 3. Cancellation Policy: There is a $50 fee for cancellations more than 30 days before your scheduled arrival. The cancellation fee within 30 days of your scheduled arrival is Half the Rental Fee. The cancellation fee within 7 days of your scheduled arrival is The Entire Rental Fee. Travellers are encouraged to consider travel insurance such as that found at http://insuremytrip.com/ The Owner will refund all payments in case the house becomes unavailable but assumes no other liability. 4. The Security/Loss deposit will be returned in full provided: a) All provisions of the agreement are complied with, b) The condo and contents are left reasonably clean and in undamaged condition, c) No property is missing. If loss or damage exceeds the Security/Loss deposit, tenants agree to pay for such loss or damage on receipt of a loss/damage notification. Owner or his Agent is the sole arbiter of the extent of any loss or damage. A fee of $15 will be charged for a lost key and $100 for a lost garage door opener. 5. Tenants shall permit no activities on premises that are contrary to any law, ordinance and/or any applicable health and/or fire department or insurance policy provisions. 6. It is expressly understood and agreed that neither owner of said premises or agent shall be liable for any damages or any injury to all tenants or to tenants’ property from whatever cause arising from occupancy of said premises by tenants. It is further understood and agreed that neither Agent nor Owner shall be responsible for any personal property left by tenants in said premises. 7. Tenants agree to report promptly to the owner’s agent or owner any housekeeping, mechanical, electrical, plumbing or other problem with the property. It is understood and agreed that owner or Agent shall have the right to enter and inspect premises at all reasonable times to insure maintenance and safety of the premises.
