            Special Instructions for Westchester County Rent Guidelines Board Order


On June 24, 2009, the Westchester County Rent Guidelines Board adopted guideline
adjustments for rent stabilized apartments in Westchester County. The guidelines applicable
to renewal leases commencing on or after October 1, 2009 and on or before September 30, 2010
are:


       Where the tenant does not pay for heat and/or hot water:


       .    For a one year lease, the greater of 2.25% or $20.

       .    For a two-year lease, the greater of 4.0% or $40.


        Where the tenant does pay for heat and/or hot water:


       .    For a one year lease, the greater of 1.8% or $16.

       .    For a two-year lease, the greater of 3.2% or $32.


Owners are entitled to collect a percentage increase or a fixed dollar amount, but not both.

 Please note that the fixed dollar amounts DO NOT apply to renewal leases for garage or parking spaces for
which rent stabilized tenants are charged separately. Under those circumstances, rent increases are limited
to the percentages provided above where the tenant does not pay for heat.

The rent increase selected is to be entered under Item 2, under Column "c" of the lease renewal
form. It is not to be entered under Column "d".

 If the amounts entered under Column "c" are not based on a percentage, but reflect the flat dollar
amounts authorized by the applicable guideline, enter "N/A" within the parentheses.

                                              PART B - TENANT'S RESPONSE TO OWNER

Tenant: Read instructions on reverse side carefully. Check and complete one of the two responses below. You must return this Renewal
Lease Form to the owner by certified mail, within 60 days of the date the owner served you with this Renewal Lease Form. If
you fail to do so, the owner may begin proceedings to evict you from your apartment.

    I (we) the undersigned tenant(s), agree to enter into a __________ year renewal lease at a monthly rent of $ ____________ .

This renewal lease is based on the same terms and conditions as my (our) expiring lease, and further attached lawful provisions and
attached written agreements, if any (see item 5 under PART A above). The rent provided for in this renewal lease may be increased or
decreased by order of the Division of Housing and Community Renewal (DHCR) or the Rent Guidelines Board (RGB).

    I (we) will not renew my (our) lease and (we) intend to vacate the apartment on the expiration date of the present lease indicated
    above.

At least two copies of this duly completed and signed Renewal Lease Form must be mailed by certified mail, to the tenant in
occupancy no more than 120 days and not less than 90 days prior to the end of the tenant's lease term.

The owner must fully complete PART A on the reverse side of this Form explaining how the new rent has been computed. Any rent
increase must not exceed the applicable Rent Guidelines Board adjustment(s).

This Renewal Lease Form must be offered on the same terms and conditions as the expiring lease, except for such additional provisions
as are set forth by the owner and attached to this Form. If there are any additional lawful agreements between the owner and the tenant,
a copy signed by both parties must also be attached to this Form.

The tenant must return to the owner one copy of this Renewal Lease Form, completed and signed by the tenant in PART B on the
reverse side of this Form.



                                                 INSTRUCTIONS TO TENANT



If you wish to accept this offer to renew your lease, you must complete and sign this Renewal Lease Form in the space provided in PART B
on the reverse side of this Form, and you must return one copy of the signed Renewal Lease Form to the owner by certified mail within
60 days of the date this Form was served upon you.

Before you complete and sign PART B and return this Renewal of Lease Form, be sure to check the number of additional lawful
provisions and written agreements indicated under item 5 on the reverse side of this Form and that the same number of lawful provisions
and written agreements have been attached by the owner to this Form. Please read all attachments carefully. If such other lawful
provisions appear, they are part of this lease renewal offer and renewal lease. If there are any lawful agreements between you and the
owner, attached copies must be signed by both parties.

If you question the Legal Regulated Rent or the rental adjustments specified on the front of this Renewal Lease Form, ask the owner
for an explanation. You may telephone the NYS Division of Housing and Community Renewal (DHCR), Office of Rent Administration,
at the telephone number listed below for your Borough or District Rent Office for a rental history of your apartment and any related
questions.

If the owner agrees to a rent which is lower than the legal regulated rent, this lower amount should be entered in item 3 on the reverse side
of this Form, and a signed copy of the agreement should be attached. You may not change the content of this Renewal Lease Form without
the owner's written consent.

Your acceptance of this offer to renew shall constitute a renewal of the present lease for the term of years and rent accepted, subject to any
other lawful changes which appear in writing on the attachments to this Form, and subject also to payment of the new rent and additional
security, if any. Such additional security shall be deposited by the owner in the manner provided for on initial occupancy.

If you do not sign and return this Renewal Lease Form at the new rent (which appears in column "d" or item 3 on the reverse side
of this form) in accordance with the instructions, and within the prescribed 60-day period, the owner may have grounds to start
proceedings to evict you from your apartment.

                                 Attachment to ETPA Renewal Lease Form

                       (In accordance with Emergency Tenant Protection Act of 1974)




   The County Rent Guidelines Board did not issue the new guidelines rates, for leases commencing on or after
   October 1, ______ , before required lease renewal notices had to be sent. As a result, the rent increase in
   this lease was adjusted by the previous rent guidelines rates. This adjustment may increase or decrease after
   the County Rent Guidelines Board issues the new rates. Consequently, the rents quoted in your lease are
   only approximations and are subject to change.

   Adjustments are permitted when the Rent Guidelines Board establishes new rates. Any adjustments will be
   effective on the first day of the lease.

   If the County Rent Guidelines Board establishes new rates that differ from those quoted on this lease and
   does so after the effective date of this lease, any adjustments will be made on the first rent payment date of
   the month after the Board issues the rates. If the new rate is higher, the tenant must pay the difference. If
   the new rate is lower, the owner must refund the difference.

   In addition, upon learning of the new rates, the tenant may elect to change his/her lease term (1 or 2 years)
   from what he/she had previously chosen.
