HM GOVERNMENT’S GUIDE TO INTERAGENCY WORKING TO
SAFEGUARD AND PROMOTE THE WELFARE OF CHILDREN

Status Of HM Government’s Guide To Interagency Working To
Safeguard And Promote The Welfare Of Children

The status of Working Together to Safeguard Children as statutory guidance
is outlined in detail in that document. In broad terms:

   Section 7 of the Local Authority Social Services Act 1970 requires Local
    Authorities to comply with statutory guidance unless local circumstances
    indicate exceptional reasons which justify a variation. This applies to the
    whole of Part 1 of HM Government’s Working Together. This includes
    Chapter 5: “Managing Individual Cases”.

   Section 16 of the Children Act 2004 requires the Local Authority and SCB
    partner organisations to have regard to the guidance in Chapters 3, 4, 7
    and 8 of HM Government’s Working Together – which means that they
    must take the guidance into account and, if they decide to depart from it,
    have clear reasons for doing so.

Guidance that is non-statutory for any particular organisation nevertheless
represents a standard of good practice, and will assist organisations and
individuals to work effectively together.

The same principal applies to educational institutions with duties under
Sections 157 and 175 of the Education Act 2002.
