Contact us as soon as you decide to sell and give us details of where your deeds are held along with your mortgage account number. We can make a start on the legal work at this stage - which can often avoid frustrating delays later in the process.
Leases can be complicated and cover in detail such things as service charges, ground rents, maintenance, cleaning, insurance, repairs, parking, gardens, neighbours, pets etc. You will need to provide us with the latest receipts and details of insurance, maintenance, ground rent, service charges etc. in order to make your sale go as smoothly as possible.
we will agree the final transfer document, and obtain a statement showing how much is needed to repay your mortgage. A completion statement will be prepared and arrangements made for all documents to be signed.
Completion
At this point all the legal and financial transactions should be complete, and the proceeds from your house sale will then be available. If dealing with a negative equity property, any additional amount needed to repay your mortgage will be required at least 5 days before completion in order to clear.
Instruct a Solicitor
Once a buyer has been found, and a price negotiated, contact us straight away with: • Any relevant papers such as planning permission etc. • What your plans and timescales are. • As much information as possible about the buyer. You will then be sent a client care letter, fixtures and fittings list and property information form which should be completed as soon as possible and returned. A list of all items included in and excluded from the sale will help ensure that no arguments ensue at a later date.
Surveys
Your buyer will be having a survey done on your property. It is important that you let us know when it has been done - in order to tackle any problems that may have arisen as soon as possible.
Exchange of Contracts
A Contract sets out exactly what has been agreed between the buyer and you. It will include the price agreed and any special arrangements. It is only when the contracts are formally exchanged with an agreed completion date, that both parties are legally bound. A completion date is the date on which you have agreed to move out of the property and the buyer has to pay the agreed price. There can often be frustrating periods of delay if other properties are in the chain - and patience is required.
On completion
• Any monies due to you will be paid directly to your bank if instructed. • Keys will be released. • Deeds will be transferred to the buyer’s solicitor.
Before you move
• Transfer or cancel your Contents and Buildings Insurance, bankers orders & direct debits for previous mortgage installments etc. • Arrange for transfer or disconnection of gas, electricity, water and telephone services; including final readings of relevant services. • Set a provisional date for removals to be confirmed on completion. • Notify relevant Authorities.
Draft Contract
We will prepare a contract to be sent to the buyer’s solicitor.
Flats
There is one important difference when selling a flat compared to a house - with a flat you will be selling a lease.
