DO I NEED BUILDING APPROVAL?

Generally any structural alterations or additions to an existing dwelling will need Building
Approval. Building approval is required for any Additions, Alterations or Extensions to your
home. Plumbing approval is also required if adding a toilet/sink/shower. For further advice
phone Logan Building Services on 3412 5300.

WHERE DO I START?

1. Visit Logan City Council so a preliminary check can be done to pick up any potential
   hazards or Council infrastructure on your property that may impact on your proposed
   building works.

2. If you are building an Extension onto your home, you will need a detailed site plan,
   construction plans, a soil report & footing and slab design prepared by a Geotechnical
   Engineer (Check yellow pages under consulting engineers). Depending on the age of
   your home you may be able obtain a copy of the original house plans from Council's
   records. These plans may also include your original engineer reports and designs then
   these may be acceptable instead of engaging another engineer. BUT, the designs can
   only be re-used if the proposed footing & slab is to be constructed to the same standard
   as original (ie. same storeys/levels) - Contact Logan City Council Council on 3412 5269 to
   check availability of plans on your property.

3. SITE PLAN & CONSTRUCTION DRAWINGS [A4 OR A3 sizes only - NOT GRAPH PAPER] Secure
   the services of a draftsman; building designer or architect to design and draw up your
   plans, it will help if you can provide them with your original house plans. For Minor House
   Renovations, you may only need to provide alterations to existing house plans, see Logan
   Building Services for further advice.

4. Engage the services of a builder to construct the work. If you're unsure of a builder, check
   with the QBSA or their website (www.bsa.qld.gov.au) to confirm if the builder is licenced
   and to check for any recorded complaints.

THINKING OF BEING AN OWNER BUILDER?

It is a requirement under the Queensland Building Services Authority Act 1991 that if you wish
to perform or co-ordinate building work on your own property valued at more than $11,000
(i.e. how much it would cost if a builder performed the work - labour & materials), you must
obtain an Owner-Builder Permit. (Permit only available from the Building Services Authority).
Refer to the attached Fact Sheet for further information.

HOW DO I OBTAIN BUILDING APPROVAL?

Complete the attached Part A & B forms, provide 4 sets of a detailed site plan, construction
plans, a soil report & footing and slab design prepared by a Geotechnical Engineer [A4 or
A3 sizes only - NOT GRAPH PAPER].

SEE CHECKLIST ON PAGE 4 - this should be ticked accordingly and submitted when lodging
your building application.

HOW LONG DOES IT TAKE?

Building Applications: - Approximately 5-15 working days. The approval will be valid for 1
year from that date, so it is important to have the final inspection booked in before
application expires or an additional fee will be charged.

Plumbing Applications: - Sewered properties - approximately 5-15 working days.
HSTP or Septic properties - up to 20 working days.

HOW MUCH DOES IT COST?

^NOTE: The pre- site & final inspection must be performed by a Logan Building Services Certifier. The Footings, Slab & Frame inspections (if
applicable) can either be performed by your Engineer or a Logan Building Services Certifier.

Payment can be made by cheque, cash or credit card and must be made at time of
lodgement of the building application. Without payment your building application will not
be processed.

REGISTERED PLANS

Registered Plans are required for ALL building applications. The Certifier is lawfully required to
check if there are any easements, encumbrances etc. on your property. (This plan shows
your property & surrounding properties under a common RP, SP or GTP number shown at the
bottom right hand side of plan - this is not house or building plans) You may already have a
copy of this in your original paperwork when you bought your property.

"ANNEXED UNIT" (Building) Class 1a

If you're proposing to build an attached or free standing unit for relatives this is referred to as
an "Annexed Unit" previously known as a Granny Flat, which can be completely self-
contained, (ie. rooms can include a toilet; shower; bathroom) must be:
• A building or part of a building;
• Limited to one annexed unit per house;
• Located on land with a minimum site area of 600m2;
• Located within 20 metres of the house;
• Of a maximum gross floor area of 70m2;
• One household with the house shares the same driveway as the house; and
• Designed so as to present the appearance of not more than one building from the
    frontage.

"DUAL OCCUPANCY" (2ND house on one property)

"Dual occupancy" is defined as a separate house on the one residential property (future
occupant/s do not have to be related, eg. can be rented out) with separate carparking,
separate access, separate landscaping and separate recreation area. This will require a
material change of use under the planning scheme, besides building and plumbing
approval. For further information relating to a material change of use contact Development
Assessment on 3412 5269.

QUICK CHECKLIST FOR CREATING HABITABLE AREAS:-

•   Can the required 2.4m from finished floor level to the ceiling be achieved if creating a
    room?
•   Are the existing external walls suitable (i.e. waterproof construction/cavities not single skin
    brick walls?)
•   Is the slab thick enough and has it been Termite Treated and Vapour proofed?
•   Distance between Ground level to Floor level, is there good site drainage around the
    dwelling?

CAN I ENCLOSE UNDER THE HOUSE, ENCLOSE A PATIO OR CONVERT THE
GARAGE/CARPORT/PATIO INTO A RUMPUS OR BEDROOM?

Building approval is required if you are:
• enclosing your Patio or under your house;
• converting car accommodation into a room/s; or
• changing / altering storage area into a habitable area.

There are different requirements to meet for habitable areas as opposed to non-habitable.
Note the checklist for creating habitable areas. Plans will need to be drawn up to reflect all
changes, so you may need the existing house plans & engineer designs to check if slab has
already been termite treated & vapour proofed (slab lined with plastic to prevent moisture
rising). If you don't have the approved house plans and engineer designs, you may be able
to obtain a copy from Council records. To check if Council has a copy of your original
approved house plans contact the Customer Service Unit on 3412 5318.

MINOR ALTERATIONS TO HOUSE

Moving a toilet or putting an extra one in - Plumbing Approval is required, BUT, If you're
putting up any walls or partitioning to create a room or toilet area - Building Approval is also
required. Replacing stairs, whether they be internal/external - requires building approval.
Minor building work to your house doesn't necessarily mean you have to go to the expense
of getting plans drawn up professionally. You may find you are able to do it yourself, BUT, a
site plan, all construction details of what you're doing and what materials are being used are
still required. If you can obtain your original house plans, they may only need minor
alterations. Contact Council's Customer Service to check availability. Phone: 3412 5269.

EXISTING WORKS:
ENCLOSED AREAS; EXTENSION ADDED ONTO THE HOUSE;
CONVERTED CARPORT/GARAGE/PATIO INTO A ROOM/S

Building approval is still required If you have already changed your car accommodation,
veranda or under your house into a habitable area, eg. rumpus; bedroom; etc. Plumbing
approval will also be required if you have added a toilet / bathroom etc. Plans will need to
be drawn up to reflect all changes. (You may also need to engage a structural engineer to
check slab/framework and provide an inspection certificate. The slab will need to have
been termite treated, have a certain thickness and been vapour proofed (eg. slab lined with
plastic to prevent moisture rising) If the slab was done at the same time as the house, the
original slab design from engineer may show that this was already done. (Phone Customer
Service Unit on 3412 5269 to find out if house plans & engineer designs are available)

BUILDING SETBACKS - (1) - LOGAN CITY COUNCIL

BUILDING SETBACKS FOR THE R250; R600; R1000 OR R2000 ZONE.

Dwellings - One Storey
• 1.5 m setback for side or rear boundary
• 6.0 m front setback

Dwellings - Two Storey
• 2 m setback for side or rear boundary (two storey = over 4.5m)
• 6.0 m front setback

BUILDING SETBACKS FOR THE R5000; R10000; CONSERVATION ZONE; NON URBAN
ZONE; PUBLIC SPACE ZONE OR INVESTIGATION ZONE.

FRONT ROAD BOUNDARY
R5000 and R10000: 10 metres from front boundary.
Conservation, Non Urban, Investigation, Public open space zones:         20 metres from front
boundary.

SIDE & REAR BOUNDARY CLEARANCE
R5000, R10000,Conservation, Non Urban, Investigation, Public open space zones: 6 metres
from side and rear boundaries.

NOTE: Check with Council to find out what the maximum site coverage for all roofed
structures on your property is, as this will differ depending what your zoning is.

BUILDING SETBACKS - (2) - FORMER BEAUDESERT SHIRE COUNCIL

Building setbacks in the former Beaudesert Shire Council are determined by:

              •    Queensland Development Code
              •    Building Envelopes
              •    Beaudesert Shire Council

To determine whether building works fall within the former Beaudesert Shire Council area and
to discuss applicable setbacks please telephone the Logan Customer Service centre on (07)
3412 3412.

BUILDING SETBACKS - (3) - FORMER GOLD COAST CITY COUNCIL

To determine whether building works fall within the former Gold Coast City Council area and
to discuss applicable setbacks please telephone the Logan Customer Service centre on (07)
3412 3412.

WHAT IF I NEED TO BUILD CLOSER THE BOUNDARY?

If you find you cannot achieve the boundary setbacks for the structure you want to build,
you need to apply for a variation. In Logan City Council and the former Beaudesert Shire
Council areas this is an assessment under the relevant Planning Scheme and will require the
lodgement of a D evelopment Application (BWAP). For building work in the former Gold
Coast City Council area an application for a boundary relaxation must be made. For details
and forms please contact the Logan Customer Service Centre on (07) 3412 3412.

WHEN CAN I START BUILDING?

Upon receiving your approved plans and decision notice.

HOW DO I ARRANGE FOR INSPECTIONS?

Depending on what type of addition is to be built, a footing, slab, frame and final inspection
may be required. This will be noted on the 2nd page of the Decision Notice when building
plans have been approved. (You may choose to use an engineer to do some of the
inspections, but this can only be the footing,slab or frame, and Logan Building Services must
do a pre-footing/ site inspection and a final inspection. However, if Logan Building Services is
to carry out the footing inspection then a pre-footing/site inspection will be carried out at the
same time.)


It will be your responsibility to book the final inspection within 5 days of completion of
construction work including connection of stormwater. The inspector will then go out to
ensure structure has been built in accordance to the approved plans. When the structure
has passed the final inspection, a final approval certificate will be issued to the property
owner and to Council for their records.

WHAT DO I DO WITH ROOFWATER FROM THE DOWNPIPES?

For any addition to your dwelling, roofwater is required to be piped to the street channel, or
to an existing stormwater pipe. Where these are not possible, then check with Logan
Building Services if a rubble pit can be used as an alternative. This will need to be a minimum
size of 1 cubic metre located 3 metres from any building or boundary.

 Footing/Slab design & soil report by an engineer if addition is to be built outside the perimeter of existing house. Or you
 can use the original from house if not old & if works are to the same standard & same number of storey's. Footing /slab
 layout detailing beam sizes, slab thickness & reinforcing. Sectional details of above showing sand filling, vapour barriers,
 slab height relative to ground levels, weepholes, step downs for damp courses & methods of termite protection.

 If you have purchased a prefabricated structure, the supplier is required to provide you with the standard engineering

 ADDITIONAL INFORMATION:
 Energy Efficiency approval for any new enclosed habitable areas.
 For Steel Framing: engineer design certification - include Manufacturers details.
 Registered Plan & Title Search required for Additions if building outside perimeter of house.
 Copy of any Development Approval for Town Planning/Operational Works, Vehicle crossover if steep site, Covenant
 approval, Building Envelope information, Reduced boundary setback approval, Building Over a Sewer approval etc.

 Q-LEAVE:
 Portable Long Service Levy is required when any building & construction work costs are $80,000.00 or more. This levy can
 be paid at any Post Office & copy of receipt to be included in Building Application.
 Owner builders - Get a 100% exemption, but a form must still be lodged at a Post Office & a stamped copy included in
 Building Application. This exemption is not available to registered builders building their own home. For further enquiries.

 QBSA INSURANCE:
 Using a Registered builder - If contract price for estimated labour & materials is under $3,300: NO insurance fee applies.
 If contract exceeds $3,300 in costs, Builder is required to pay insurance to QBSA & a copy of the "Confirmation of
 Insurance" letter forwarded to LBS before approved plans can be issued.
 Owner builders - Can build up to $11,000 in estimated costs without any QBSA insurance permit. If estimated costs
 exceed $11,000 - you will be required to complete an owner builder's course to obtain an owner builder licence.

 EXISTING STRUCTURES & SECOND HAND STRUCTURES
 You will still require all of the above eg. Forms, construction plans & information, in addition to this, you may also require a
 Soil Report, designs for footing & slab & certificate from a registered Structural Engineer to certify strength & soundness of

 TERMITE PROTECTION
 Underslab must be treated & a minimum 75mm exposed slab edge for perimeter of works.

Notes for completing this form

Question 8:
 Section 263 of the Sustainable Planning Act 2009 sets out when the consent of the owner of the land is required for an
  application. Section 260(1)(e) of the Sustainable Planning Act 2009 provides that if the owner’s consent is required
  under section 263, then an application must contain, or be accompanied by, the written consent of the owner, or
  include a declaration by the applicant that the owner has given written consent to the making of the application.
 Owner’s consent is not required for a mobile and temporary ERA.

Question 9:
 Section 264 of the Sustainable Planning Act 2009 provides that if a development involves a state resource, a
  regulation may require the application to be supported by certain evidence prescribed under the regulation. Schedule
  14 of the Sustainable Planning Regulation 2009 prescribes the state resources for which evidence is required to be
  given, and the evidence required, to support the application.

Question 13:
 The Building and Construction Industry (Portable Long Service Leave) Act 1991 prescribes when the portable long
  service leave levy is payable.
 The portable long service leave levy amount and other prescribed percentages and rates for calculating the levy are
  prescribed in the Building and Construction Industry (Portable Long Service Leave) Regulation 2002.

 The portable long service leave levy need not be paid when the application is made, but the Building and Construction
  Industry (Portable Long Service Leave) Act 1991 requires the levy to be paid before a development permit is issued.
