11   Statement of purpose: This bill proposes to remove the dishwasher exemption

12   from the law that prohibits phosphorus above trace quantities in most

13   household cleansing products sold and used in the state.




14      AN ACT RELATING TO REDUCING THE AMOUNT OF
15      PHOSPHORUS ALLOWED IN HOUSEHOLD CLEANSING
16      PRODUCTS USED IN DISHWASHERS

17   It is hereby enacted by the General Assembly of the State of Vermont:

18   Sec. 1. 10 V.S.A. § 1382 is amended to read:

19   § 1382. PROHIBITIONS

20      (a) No household cleansing products except those used in dishwashers, for

21   cleansing medical and surgical equipment, food and beverage processing

 1   equipment, and dairy equipment may be distributed, sold, offered, or exposed

 2   for sale at retail, after April 1, 1978, or at wholesale, after January 1, 1978, or

 3   used in a commercial establishment in this state, after April 1, 1978, which

 4   shall contain a phosphorus compound in concentrations in excess of a trace

 5   quantity.

 6      (b) No household cleansing products used in dishwashers, for cleansing

 7   medical and surgical equipment and food and beverage processing equipment,

 8   may be distributed, sold, offered, or exposed for sale at retail, after April 1,

 9   1978, or at wholesale, after January 1, 1978, or used in a commercial

10   establishment in this state, after April 1, 1978, which shall contain a

11   phosphorus compound in concentrations in excess of 8.7 percent by weight

12   expressed as elemental phosphorus. No household cleansing products used in

13   dishwashers may be distributed, sold, offered, or exposed for sale at retail after

14   July 1, 2007 or at wholesale after January 1, 2008 or used in a commercial

15   establishment in this state after July 1, 2007, which shall contain a phosphorus

16   compound in concentrations in excess of a trace quantity.
