RAILWAY SQUARE CONDOMINIUM ASSOCIATION RULES AND REGULATIONS 1. A maximum ONE HALF CORD of firewood may be stored on the patios or deck ON A METAL STORAGE RACK. Firewood shall not be stored directly on the ground in any location on any lot. All firewood must be removed from all decks by June 1 to avoid infestation of termites and carpenter ants. Any violations that result in causal damage will have repairs and treatment billed to the owner of the unit. 2. A unit owner shall not decorate, alter or attach anything to the exterior portion of his/her unit without prior written consent of the Board. 3. Drying or airing of any clothing, bedding or other articles shall not be permitted on any part of any unit or upon any of the common elements or from or upon any patio or deck. Clothes-hanging devices such as lines, reels, poles or frames shall not be erected at any time on any common element or limited common element. 4. All windows and glass doors shall be covered with curtains, drapes, shades, blinds or the like. Coverings visible from outside the unit shall be backed on the exterior side with white or off-white colored liners. 5. Window grids shall remain and be maintained in all windows. 6. Statuary, flags, lawn ornaments, benches, birdbaths, standing bird feeders or any permanent type of furniture shall not be placed on any part of the common area. 7. Only storm doors and screen doors approved prior to purchase by the Board of Directors are permitted. Owner must verify model and color with Managing Agent. 8. Vegetables shall not be grown on any lot. 9. Trash and recyclables will be picked up on days as agreed upon between Board of Directors and Contractor. There will be no trash pick-up on legal holidays. Heavy duty trash bags or trash receptacles are required to be placed at the curb no earlier than 6:00 p.m. the night before collection day. All trash receptacles and recycling bins shall be taken in prior to midnight of pick-up day. 10. Seasonal decorations may be displayed after Thanksgiving Day and shall be removed by January 15th each year. Decorations are not permitted on roofs. Decorations or light sets shall not be strung along eaves or gables of the individual units. When hanging lights, care should be taken as to not do permanent damage to exteriors of units. All exterior lights and extension cords shall be approved for exterior use (UL label). 11. Only annuals or perennials may be added to the existing beds and shall be maintained by the owner. If flowers are not maintained, the landscaper will return the bed to its original condition at the owner’s expense. Additional beds shall be approved by the Board of Directors. Unit owners shall not plant, place, prune or remove trees, shrubbery, bushes, vines or other plantings on or from the common elements, or any planting bed. 12. Each unit has one parking space with painted numbers as a courtesy to residents. All other vehicles shall be parked in unnumbered spaces. Overnight parking of commercial vehicles is prohibited. 13. Car repairs are not permitted in driveways, roads or parking areas. 14. Immoral, improper, offensive or unlawful use shall not be made of the property, or any part thereof. All valid laws, zoning ordinances and regulations of all governmental bodies having jurisdiction thereof shall be observed. 15. Noxious, unsightly or offensive activity shall not be conducted on the property, nor shall anything be permitted to be done thereon which may be or may become an annoyance or nuisance. No musical instrument, stereo, television, radio or sound amplifier shall be played or operated in such manner as to disturb or annoy other residents. Prior to 6:00 a.m. and after 12 midnight all noise from such activities and equipment shall be reduced to a level which is not audible to other residents. 16. All washers, dryers and stoves should be turned off prior to leaving the unit. 17. Outside shades, awnings, exterior window guards, ventilators, fans, air conditioners or like devices shall not be used in or about the windows or outside the building, except those which have been approved by the Board. 18. Patios and decks shall not be screened or altered in any way without prior written approval. 19. Storage sheds, doghouses, basketball backboards, play sets, outbuildings, etc. are not permitted on common areas. 20. Exposed exterior wiring is not permitted nor is alterations under the garden beds without specific approval from the association. Under no circumstances may additional natural gas or propane tubing be installed after initial construction. Violations of this rule are violations of township codes and homeowner rules and regulations. 21. Animals, livestock or poultry of any kind shall not be raised, bred or kept in any unit, or any part of the property. Dogs, cats or other domesticated household pets may be kept in the unit, provided they are not bred, maintained or kept for any commercial purposes, and that the presence of such animal does not disturb or interfere unreasonably with the rights, comfort or convenience of the other residents of the Community or cause injury to property. 22. No more than two (2) pets may be kept in any individual unit within the said property. The owner of a unit where any animal is kept or harbored or whose invitee brings any animal into the Community shall be responsible for and shall indemnify and hold harmless the Board, the Homeowners Association and all other unit owners from and against any loss of liability to person or property of any kind arising out of the presence of such animal. 23. All pets must be leashed, held by a person, at all times when on common grounds. Permanent stakes or other devices shall not be erected on the lot for the purpose of securing a pet. Every pet owner shall take all reasonable steps to prevent the noise, waste or odors of his/her pet from annoying other residents of the Community. The Association shall have the right to require that any potentially dangerous or habitually diseased, infested, unclean or noisy animal, reptile, fish or insect be removed from the Community. In the event of the breach of this Rule, the Association or its Agent, in the sole discretion of the Board or its Agent, may require of the owner of such pet or animal that it be permanently removed from the Community. Fines may be levied by the Association for non- compliance. All pets must be licensed by West Whiteland Township/Chester County and wear visible tags at all times even when leashed. 24. Each unit owner shall keep his/her patio, deck and/or front stoop in a state of neatness and cleanliness. Tires, bicycles, toys, tools, ladders, garbage bags, lawn ornaments or the like shall not be stored or left on any front stoop, patio or deck or under any deck. Only outdoor tables, chairs and grills may remain set up on patios and decks. 25. The Board may from time to time, approve additions or alterations. If an owner wishes to make additions or alterations he/she shall make such a request in writing to the Managing Agent, including descriptive information such as plans, pictures, elevations, specifications, etc., as may be necessary to outline the request fully. Any additional exterior alterations, including detailed plans of the work that will be done by a licensed contractor, must be submitted to the Board of Directors for approval. Also submitted at this time should be the contractor’s license number and a certificate of insurance from the contractor indicating Railway Square Condominium Association as additional insured and should include a workers compensation clause. All exterior additions and modifications must be disclosed as owner responsibility as part of a future sale. 26. Any approved addition or modification will be subject to a final inspection upon completion, to assure that it has been constructed properly and in accordance with the proposal accompanying the original request. 27. Inflammable or combustive material or any explosive or otherwise hazardous fluid, material, chemical or substance shall not be brought into or stored in any unit except those in common use for ordinary household purposes. 28. All garden hoses, when not in use during the gardening season, shall be coiled unobtrusively in a mulched area or mounted on a portable reel behind existing shrubbery where possible. Hoses shall be removed and stored during the winter months. 29. Any complaints regarding maintenance and condition of the Community or the action of the Board or its officers, agent, employees or independent contractors, or of any unit owner or any members of his family, guest, invitees, employees or independent contractors, shall be made in writing to the Board, or its Managing Agent, which shall be permitted (except in emergencies) a reasonable time in which to study and act upon the complaint before any other action is taken by the complainant. Any consent or approval given by the Board or its Managing Agent under these Rules may be revoked or modified at any time. The Board may amend these Rules from time to time. No unit owner or resident of the Community of Railway Square shall attempt to direct, supervise, or in any manner attempt to assert any control over the employees of the Homeowners Association or the Board or the Managing Agent. No employee shall be used to perform any function or service except that for which said employee is employed. The Board may delegate any of its responsibilities hereunder to its Managing Agent, except that only the Board may amend these Rules. 30. Violation of the Rules and Regulations may result in a fine or legal action. See attached schedule. 31. Any items attached to the siding of buildings will result in an immediate fine. Owner will also be responsible for repair or replacement of the siding. Repairs will be outlined and sent to the owner and will be done by the homeowners’ maintenance group or an outside contractor at the owner’s expense. You are advised that additional duties and regulations may be found in the Railway Square Condominium and Exton Station Community Association Declaration of Covenants and By-Laws.
