              MINUTES OF THE MEETING HELD ON THURSDAY 14 June 2007

1      APOLOGIES FOR ABSENCE

1.1    Apologies for absence were received from Cllr. Mrs. Browne, Cllr. Radford, County
       Cllr. Richard Stay and CSPO Darrell Saunders-Fearn.

2.     DECLARATIONS OF INTERESTS (Personal and/or Prejudicial) (Parish Councils
       (Model Code of Conduct) Order 2001).

2.1    No members had any declaration of interests, either personal and/or prejudicial, in
       any of the items under consideration at this meeting of the Parish Council.

3.     PUBLIC QUESTION TIME

3.1    A member of the public raised concerns over the number and times of vehicles using
       the industrial estate Common Road and which, if any restrictions, applied. The
       resident could supply photographic evidence if necessary to support his concerns
       which had been drawn to the attention of the police. Cllr. Moreton confirmed that this
       was an area which had concerned the Parish Council over a period of time and that
       they would continue to monitor the situation. The resident was requested to pass on
       any information relating to this issue to the police.

3.2    An update was provided on the plans for the Isle of Wight Lane/Common Road. A
       letter and questionnaire was to be issued at the end of June to each of the houses in
       the Isle of Wight Lane/Common Road area seeking views on the introduction of
       speed cushions and designating the Isle of Wight Lane as a ‘Quiet Lane’. These
       returns would be sent to Bedfordshire County Council at the end of July for collation
       before any decision is made.

3.3    Cllr. Moreton reported that a restriction had been passed some years ago prohibiting
       the unloading of goods on the road outside the industrial area site. He was unaware
       of any change to this condition by the authorities.

4.     POLICE MATTERS

4.1    Cllr. Moreton expressed the condolences of Members to the Chief Constable and
       colleagues following the sad loss of PC Jon Henry in Luton. Following a discussion it
       was unanimously: -
       Resolved: - that, a letter be sent to the Chief Constable and colleagues
       expressing condolences on this sad occasion and commending officers for the
       work they do, often in difficult circumstances, in the community.

4.2     Details were circulated of the fifteen crimes which had been committed in May 2007
        together with details of other reports made to the police.

4.3     WPC Louise Howard reported that a number of speed checks had been carried out in
        Kensworth recently. The majority of vehicles were travelling between 26-32mph.
        Three were stopped travelling at 35mph and advised and all were residents. It was
        intended to carry out a similar exercise on a monthly basis in future and it was noted
        that the flashing sign was a valuable reminder. Details were supplied of suitable
        areas to be covered and appropriate times.

4.4     The issue relating to ‘clear up’ rates for crimes committed in Kensworth was again
        discussed. WPC Louise Howard was unable to provide this information up and
        suggested that a letter be sent to Inspector Barrett who may be able to supply this
        information. It was: -
        Resolved: - that a letter, be sent to Inspector Barrett, requesting details of the
        „clear up‟ rates for crimes committed in Kensworth over the past two months.

4.5     WPC Louise Howard and WPC Viv Dady were thanked for attending the meeting and
        the contribution they had made.

Six young residents delivered a plan to provide facilities for a cycle course on the recreation
ground. Cllr. Moreton thanked them for this document which would be considered at a later
meeting of the Parish Council.

5.      MATTERS FOR THE COUNTY COUNCILLOR

5.1     In the absence of County Cllr. Stay no report was made and Members had nothing for
        his attention.


6.      MATTERS FOR THE DISTRICT COUNCILLOR

6.1     Members enquired when they could expect all the grass verges to be cut inside the
        30mph speed limit as some areas had been cut whilst others had been left.

6.2     Extreme concerns were raised by Members over the devastation caused by SBDC
        over the total clearance of vegetation on the triangle at the junction of the B4540 and
        Common Road/Isle of Wight Lane. This left the site open to unauthorised use by ‘new
        age travellers’. It was reported that this work was authorised by Basil Quinn,
        Highways and Waste Manager, without reference to the Parish Council. It was
        understood that Mr. Quinn had offered to attend the next meeting of the Parish
        Council and was also prepared to plant bushes in this area, at no cost to the PC,
        should Members so wish. Members felt that as an emergency measure a ditch and
        dyke should surround the whole area. A member of the public explained their
        involvement in this matter. It was reported that as this land was owned by
        Bedfordshire County Council, County Councillor Richard Stay should be contacted
        and advised of the situation.

6.3     District Cllr. Mrs. Mustoe reported that the balance of the Youth Club Funds following
        the closure had been placed in a Building Society account. It was for the previous
        committee members to decide what has to happen to these funds. District Cllr. Mrs.
        Mustoe had expressed an interest in attending a meeting at which the disposal of

       these funds was to be determined. Members suggested these funds be made
       available to Kensworth Lower School. The question of the whereabouts of the
       equipment was also raised as it was last held at the school.

6.4    District Cllr. Mrs. Mustoe reported on the District Council view on flytipping which
       could result in prosecution. Reports were usually dealt with within 24hrs of being
       received.

6.5    Members again discussed the decision by South Bedfordshire District Council to
       introduce new waste and recycling collection arrangements in South Bedfordshire. A
       response to the letter sent to Jon Ruddick, Chief Executive, from Peter Jones,
       Corporate Service Manager (Environment) failed to answer the question of the risk
       assessment carried out by SBDC. It transpired that SBDC had used the risk
       assessment carried out by another authority on this issue. Copies of the papers
       considered by SBDC had been e-mailed to Members for their information but these
       documents did not allay their fears in this matter. Following a discussion on this issue
       it was: -
       Resolved: - that, a letter be sent to Jon Ruddick, Chief Executive, expressing
       the continued concerns and dissatisfaction of the Parish Council over the new
       waste and recycling arrangements being offered by SBDC.

6.6    District Cllrs. Mrs. Mustoe and Mrs. Wyles were thanked for attending the meeting
       and the contribution they had made.

7.     MINUTES OF THE PREVIOUS MEETING

7.1    It was PROPOSED, SECONDED and RESOLVED that the minutes of the meeting

8.     REQUEST FROM VHMC FOR A LOAN

8.1    It was reported that in the absence of Cllr. Mrs. Browne and given that no business
       plan or accounts had been received this item could not be considered at this meeting
       of the Parish Council. It was: -
       Resolved: - that, this item be deferred pending the receipt of a business plan,
       accounts and the presence of Cllr. Mrs. Browne for a future meeting.


9.     PARISH CARNIVAL 2008

9.1    No update was available for this meeting of the Parish Council.


10.    LOCAL RIGHTS OF WAY IMPROVEMENT PLAN

10.1   It was reported that no applications had been received for the vacant P3 post. Cllr.
       Moreton agreed to speak to Stephen Hartley to enquire if he was willing to take over
       this role.

10.2   Members discussed the general state of the footpaths in Kensworth most of which
       were badly overgrown. As these were the responsibility of BCC it was: -

       Resolved: - that a letter be sent to Michelle Flynn, advising that if these
       footpaths were not maintained and the Parish Council have to arrange for this
       work to be done on their behalf any resulting invoice would be forwarded to
       them for payment.


11.    FUTURE DEVELOPMENT OF KENSWORTH LOWER SCHOOL

11.1   No update was available for this meeting of the Parish Council.


12.    REPORT OF CHAIRMAN

12.1   Cllr. Moreton reported that a letter had been received from Clive Beckett, BCC, to the
       council request to temporarily reopen the old toilets, including the disabled toilet, on
       Dunstable Downs. The letter was inaccurate on a number of points; however the
       outcome was that BCC were not prepared to meet the council’s request. It was: -
       Resolved: - that, a letter be sent to Mr. Beckett expressing the regret of
       Members that the County Council were not prepared to offer this service on a
       temporary basis.

12.2   It was reported that a letter had been received from Mrs. N. Haesler, secretary of
       Kensworth Junior Football Club, seeking use of the pitches on the recreation ground
       for the season 2007/2008. Concerns were raised over the state of the changing
       rooms. Following a full discussion it was: -
       Resolved: - that, a request be sent for a representative of KJFC to attend a
       meeting with Members to discuss a number of concerns which had arisen
       during the last season.


13.    REPORT OF REPRESENTATIVES ON OUTSIDE BODIES

13.1   Cllr. Blackburn reported that an advisory committee was to take place on 18 June.

       Allotments
13.2   Cllr. Mrs. Manton reported that work had now commenced to plough some of the
       allotments and some of the surrounding grass had been cut.

       Highways
13.3   Cllr. Moreton requested that any resident with concerns on any areas of road and
       footpaths should bring these to any Member of the Parish Council for reporting to the
       highway authority.

       School Governing Body
13.4   Cllr. Woods had nothing to report.

       Other Issues
13.5   Cllr. Mrs. Manton gave a report on the first Green Infrastructure (GI) workshop

       found very informative. The second workshop was to be held on 9 July at 7.30p.m.

15.       HIGHWAY MATTERS (Local Government Act 1972)

15.1      A list of four items outstanding (Pothole in Lynch Hill, Footpath Russell Close, State
          of Road at junction of Poplar and Common Road and the Drains leading to the A5 in
          Lynch Hill) which had been circulated previously, was discussed and follow up action
          agreed. It was agreed that the Removal of the Elder Tree at the side of the footpath
          between Russell Close and Green Lane be added.

      The meeting was adjourned at 8.38p.m. for a comfort break and was resumed at
                                        8.50p.m.

16.       PLANNING
          Notice of Planning Applications (Town and County Planning Act 1990)

16.1          TP/07/0507             Continued use of land for commercial parking & retention of

       Plans for the above were made available. The Parish Council objects to this application on the
       following grounds:-
       1. Although the height is not stated on the application form, this is a longstanding problem
            drawn to the attention of the District Council on numerous occasions when the condition
            has been totally ignored by the applicant. The restriction of 2 metres was set 20 years ago
            and Members would have no desire to change this and create an even greater fire hazard
            and an increase in the number of vehicles using this site.
       2.   The condition relating to no cars or lorries parking outside working hours has been
            contravened and we are given to understand that sub letting of the site currently occurs.
       3.   The drainage from the site has not been improved and continues onto adjoining private
            fields.
       4.   The photography supplied is misleading and the entry to the site is poor and is therefore
            contrary to Policy 42 of the Bedfordshire Structure Plan 2011 and T1 of the South
            Bedfordshire Local Review Plan.
       For the above reasons the Parish Council would formally request that an inspection of the site
       be carried out to enable Members of the Planning Committee to appreciate for themselves the
       concerns raised by the Parish Council.


16.5    TP/07/0695         Demolition of existing bungalow & outbuildings & erection of two chalet
                           bungalows.

        As notification of this application had only just been received no decision was made
        at the meeting and was referred to the Planning Committee for a decision. (Note
        Members of The Parish Council present object most strongly to this application)


17.    MATTERS OUTSTANDING (Within the remit of the Parish Council)

17.1   A list of eight items outstanding (Closure of Isle of Wight Lane, Clearance of drainage
       ditches, Provision of Bus Shelters, Tree Branch overhanging slip road, Provision of
       school gate, request for redeployment of speed gun, Appointment of P3 Co-ordinator
       and Purchase of Kissing Gate), which had been circulated previously, was discussed
       and follow up action agreed.

19.     ITEMS FOR INCLUSION IN “THE PARISH LINK” and WEBSITE

19.1    It was agreed that Cllr. Maryan would put together the items discussed tonight for
        inclusion in the Parish Link.


20.     REPORT OF CLERK

20.1    The clerk reported that a letter had been received from the Parochial Church Council

        seeking support for improving the signage for the 12 Century church in Kensworth.
        This request received the full support of the Parish Council.

20.2    Details were given of the new minimum rate of pay for refuse collection which was
        £5.95p.h. This rate came into operation on 1st April 2007. It was: -

        Resolved: - that, the rate of £5.95ph be payable to Mr. Curzon effective from 1
        April 2007.


21.     DATE AND TIME OF NEXT MEETING TOGETHER WITH ITEMS FOR INCLUSION

21.1    The next Parish Council meeting will be held on Thursday, 12                    July 2007 at
        7.00p.m. in Kensworth Methodist Church Hall, Common Road.

21.2    The following Parish Council meeting will be held on Thursday 13 September 2007
        following the summer recess at 7.00p.m. in Kensworth Village Hall.

       This concluded the business of the evening and the meeting finished at 9.05p.m
