SUBJECT:        Holiday Closure and Temporary Layoffs – Office of the President HR

As you may already know, the University and CUE reached agreement on Friday December 4, 2009 with
respect to temporary layoffs of clerical unit (CX) employees during 2009-10 and the scheduled Office of
the President closure days beginning December 2009. One important objective of the recent agreement
with CUE was to avoid having to treat the closure days and the temporary layoffs separately. If treated
separately, CX employees would have to use accrued vacation, CTO or leave without pay for the closure
days and then take unpaid days in connection with the temporary layoffs at other times during the year.
As a result of the recent agreement, unless a CX employee decides otherwise, s/he will have their
temporary layoff days coincide with the closure days.

The Office of the President Human Resources will be closed for business December 21, 2009 through
January 1, 2010. In accordance with the temporary layoff program, you will be on temporary layoff on
the following days: December 21, 22, 23, 28, 29 and 30, 2009.

In accordance with the agreement reached with CUE, income lost as a result of temporary layoffs will be
equally distributed over twelve (12) consecutive months beginning with February earnings (as reflected in
the March 1, 2010 paycheck). However, you may elect to opt out of the equal pay reduction by signing
the Request to Opt Out of Equal Pay Reduction over 12 Month Period form (attached) prior to the first
scheduled closure day (December 21, 2009). If you do this, the loss of pay experienced as a result of
temporary layoffs will occur in the months that temporary layoff days are taken.

Option to Take Temporary Layoff Days Separate from Closure Days: Whether or not you decide to
have the loss of income spread out over 12 months, you may elect to take temporary layoff days separate
from closure days. If you do not want to be laid off during the closure days you must notify your
supervisor prior to the first scheduled closure day (December 21, 2009), or the scheduled Office of the
President closure days shall count against the required number of temporary layoff days you will be
required to take. Your election not to be laid off during the closure days must be in writing; you must
identify the dates you elect not to be on temporary layoff; and, you must identify the type of leave you
will be using to cover those dates by signing and submitting the Election form for Alternate Temporary
Layoff Option (attached) to your supervisor. Please keep in mind that if you choose this option, the
applicable number of temporary layoff days (11-16 days depending upon your salary) shall be scheduled
later in the year.
