Important Notes

This Deed is suitable for use when additional Trustee(s) are being appointed by the Settlor who has created a trust of his Tunbridge Wells Equitable Friendly Society Plan using any of The Children’s Mutual draft Absolute, Flexible or Revertor Trust deeds and where the Settlor is the sole Trustee at present. This draft is not suitable for use with the The Children’s Mutual Statutory Trust under which Trustees are appointed in the Trust request itself.

If, after seeking legal advice, the draft Deed is to be used unamended, the parties should follow the completion instructions in the margin of the document.

This draft is suitable only to effect the first appointment of additional Trustees. When additional Trustees have already been appointed and it is desired to appoint further Trustees please refer to Tunbridge Wells Equitable Friendly Society or your legal advisers for assistance.

Notice of the appointment must be given to Tunbridge Wells Equitable Friendly Society.

By the Trust, a trust was created of the Plan numbered and issued by Tunbridge Wells Equitable Friendly Society (“the Plan”). The Settlor is/are the present Trustee(s) of the Trust. The power of appointing new or additional Trustee(s) under the Trust is vested for the time being in the Settlor. The Settlor desires to appoint the Additional Trustee(s) to act jointly with the Settlor as Trustees of the Trust in the execution and administration thereof. The Additional Trustee(s) wish to accept his/her/their appointment as Trustees of the Trust. The Plan is the only property at present held by the Settlor as Trustee(s) and it is intended that legal ownership of the Plan shall be transferred into the joint ownership of the Settlor and the Additional Trustee(s).

In exercise of the power conferred by the Trust and all other powers (if any) the Settlor HEREBY APPOINT(S) the Additional Trustee(s) to be a Trustee(s) to act jointly with the Settlor as Trustees for all the purposes of the Trust. The Additional Trustee(s) accept the appointment effected by this Deed. The Settlor as Trustee(s) hereby assign(s) the Plan to himself/herself/themselves and the Additional Trustee(s) (where the Trust is subject to the law of England and Wales or the law of Northern Ireland) jointly so that the Plan shall henceforth be in the legal ownership of all the Trustees of the Trust and (where the Trust is subject to the law of Scotland) the survivor(s) of them as Trustees of the Trust.

Settlor and the Additional Trustee(s) must give notice of this Appointment to Tunbridge Wells Equitable Friendly Society.

The parties hereto hereby agree to notify Tunbridge Wells Equitable Friendly Society of this change of Trustees. The parties hereto hereby certify that this instrument falls within Category A in the Schedule to the Stamp Duty (Exempt Instruments) Regulations 1987.
