                                               SUMMARY OF
                                         ASSISTED LIVING FACILITIES
The Departments of Building and Safety (LADBS) and City Planning (DCP) have seen an increase in the
number and types of “assisted living facilities” submitted to the city for various approvals. However, the
term “assisted living facility” is not defined in the Zoning Code.

Assisted living facilities are for people needing assistance with some activities of daily living, but not to
a level of a nursing home. Residential facilities, including assisted living facilities, vary in the degree of
assistance provided. At one end of the spectrum, traditional nursing homes are designed to care for
people who are not able to care for themselves and need health care. At the other end of the spectrum,
traditional residential facilities are for people who are able to live without any assistance. In between,
some assisted living facilities provide assistance to elderly persons who are able to care for themselves
except for a few activities.

A person may begin in a traditional residential facilitiy, move to an assisted living facility as he or she
needs help with activities of daily living, and eventually move to a nursing home as ongoing care
becomes necessary. Each assisted living facility vary in their degree of services provided. Such services
may include help with eating, bathing, dressing, laundry, housekeeping, and/or assistance with
medications.

Since there is no definition of “assisted living facility” in the Zoning Code and that there are various types
of assisted living facilities, problems frequently arise with interpretation and enforcement of various
provisions of the code. To cross reference the term “assisted living facility” to the terms available in the
code, a summary of these types of facilities and the corresponding requirements are summarized in the
table below. The uses listed are those that appear in the “use list” of the code that most closely resemble
the assisted living facilities. These terminologies, as stated in the zoning code, and declared by the
applicant, are used by LADBS staff when entering the use codes in the permit application. Note that the
main differences between the assisted living facilities and apartments or convalescent homes are the
accessory uses permitted, the level of care provided at the facility, and the State licensing requirements.

The first two rows in the table are to be considered the “typical” assisted living facilities. The other rows
clarify how these facilities compare to other permitted uses in the code as well as to clarify what
accessory uses are permitted in apartments, boarding homes, retirement hotels, etc.

(1)        Services provided on site include, but need not be limited to the following: Group dining, cleaning
           similar to hotel, recreational facilities, medical clinic for persons on site only, assistance or medical
           help, medication by medical or non medical staff, regular nurse supervision and weekly/daily
           doctor visits, counseling and referral facilities for persons on site only. Any of the above uses may
           be provided for persons other than those residing in the facility provided the use is permitted in

           services may be provided to the residents of the building only.
(4)        Retirement Hotels requires that an affidavit be recorded assuring that at least 90% of the
           occupants are 62 years of age or older.
(5)        As used in the Zoning Code, a “board house” is defined as “a dwelling containing a single dwelling
           unit and not more than five guest rooms or suites of rooms, where lodging is provided with or
           without meals, for compensation.”
(6)        No hospital or sanitarium shall be established on any property within 600 ft of the property on
           which an elementary or highschool is being maintained.
