                                        VENDORS GUIDE


To better serve the vendors doing business with the State of Mississippi, the Office of Purchasing
and Travel of the Department of Finance and Administration has prepared this Guide. This Guide
briefly discusses the structure of purchasing in Mississippi and the various techniques of purchas-
ing available to governmental units. The Guide also identifies the commodity class and the items
covered by both the negotiated agreements and the competitively bid contracts. Further, it also
offers a brief discussion of open market purchases and the commodities covered by this purchase
method. Following the information on open market purchases, is a listing of the Office of Pur-
chasing and Travel staff and their respective areas of responsibility. Several common questions
and the answers are listed. Finally, the Guide includes a listing of the various agencies of the State
which have purchasing offices and the respective addresses.

No Centralized Purchasing

The State of Mississippi, unlike many states, does not have centralized purchasing. Each state
agency or institution has its own purchasing office. These various independent offices, as well as
all of the governing authorities, must purchase under the state purchasing statute which is set forth
in Section 31-7-1 et al. of the Mississippi Code. The Mississippi Code is available at
http://www.sos.state.ms.us. This Vendor Guide should be used as a reference manual and should
not be considered to be all inclusive.

Definitions

Because the laws and requirements are varied depending upon the type of governmental entity that
is doing the purchasing, the following brief definitions are given here as clarification.

"State agency" is intended to mean any agency or institution which is created by the Constitution or
statute except a legislative or judicial board or unit thereof.

"Governing authority" is intended to mean any political subdivision such as counties, cities,
schools, port authorities, etc.

General Guidelines - State Agencies

If a commodity is on a competitive bid contract (see page 7), state agencies must buy the contract
item from the contract vendor unless they get prior approval from the Office of Purchasing and
Travel. If a commodity is on a negotiated contract (see page 4), state agencies may buy from any
of the contract vendors, or state agencies may purchase the item from other than the contract vendor
provided that they must follow the applicable procedures set forth in Section 31-7-13 (a), (b), or
(c) and that the price paid shall not exceed the negotiated contract price. If a commodity is not
covered by any contract, state agencies must follow statutory bid procedures which are set forth in
Section 31-7-13 of the Mississippi Code. Section 31-7-13 states that purchases which do not
exceed $1500 may be made from any vendor; purchases which are over $1500 but not more than
$10,000 may be made from the lowest and best bidder provided at least two (2) competitive,
signed bids have been obtained; purchases which exceed $10,000 may be made from the lowest
and best bidder after advertising for competitive sealed bids once each week for two (2)
consecutive weeks and that the date of the bid opening is not less than seven (7) working days after

the last published notice. For construction contracts in excess of $15,000, the date of the bid
opening shall not be less than fifteen (15) working days after the last published notice. For pur-
chases in excess of $10,000 not covered by state contract, state agencies are required to obtain
approval from the Office of Purchasing and Travel prior to issuing a purchase order.

General Guidelines - Governing Authorities

If a commodity is on a competitive bid contract (see page 7), governing authorities may buy the
contract item from the contract vendor; or they may buy the identical item from any source
provided that the price does not exceed the state contract price; or they may ignore the contract and
purchase under the guidelines set forth in Section 31-7-13 of the Mississippi Code as outlined
above. If a commodity is on a negotiated contract (see page 4), governing authorities may buy
from any of the contract vendors; or they may buy the identical item from any source provided that
the price does not exceed the state contract price; or they may ignore the contract and purchase
under the guidelines set forth in Section 31-7-13. If a commodity is not covered by any contract,
governing authorities must follow statutory bid procedures which are set forth in Section 31-7-13
of the Mississippi Code. Governing authorities are not required to obtain approval from the
Office of Purchasing and Travel.

Specifications

It is the intent of the specifications to obtain a commodity that will adequately meet the needs of the
user while promoting the greatest extent of competition that is practicable. It is the responsibility
of the prospective bidder to review the entire Request for Bids packet and to notify the purchasing
entity and/or the Office of Purchasing and Travel if the specifications, instructions, general or
special conditions are formulated in a manner which would unnecessarily restrict competition.
Any protest or question concerning the specifications or bidding procedures must be received in
writing in the purchasing office not less than 72 hours prior to the time and date set for the bid
opening.

                  STATE OF MISSISSIPPI NEGOTIATED CONTRACTS


Nonexclusive, Negotiated Contract. This type of contract is often referred to as a “multiple
award schedule.” For this type of contract, we accept proposals from many vendors. These
proposals are evaluated with a contract being awarded to all vendors whose prices are "competi-
tive." These contracts can be used by any state agency or governing authority. The following is a
listing by class number of the commodity groupings currently covered by negotiated contracts. For
each class the first line(s) gives a general description of the class grouping; the indented lines
describe in detail exactly what commodities are covered by these negotiated contracts. Vendors
wishing to enter into contracts of this type should click on the class number of interest or go to
http://www.mmrs.state.ms.us/Purchasing/BidOp/Bidding_Op.htm, then click on the commodity of
interest, then click on Proposal Format and Guidelines. This document will provide the
information needed to submit a proposal. Vendors without internet capabilities should contact the
appropriate contract analyst (see page 12) for the proper proposal guidelines.

                              COMPETITIVE BID CONTRACTS


Statewide Competitive Bid Contracts. These contracts are established on the basis of written
specifications and sealed competitive bids with a contract being awarded to the vendor that has
submitted the lowest bid that meets the specifications. All state agencies are required to purchase
from the awarded vendor unless they obtain approval from the Office of Purchasing and Travel to
do otherwise. Governing authorities may purchase from other than the awarded vendor provided
they purchase an identical item at or below the contract price. The following is a listing by class
number of the commodity groupings currently covered by competitive bid contracts. For each
class the first line(s) gives a general description of the class grouping, the indented lines describe
in detail exactly what items are covered by these competitive bid contracts. Vendors wishing to
bid on these contracts should register online or submit a letter to the Office of Purchasing and
Travel indicating their desire to be placed on the Qualified Bidders List. The Office will then
send the vendor a blue bidders application form. The bidder should be sure that they have signed
up for all of the applicable classes of commodities. Upon receipt of this form, the Office of
Purchasing and Travel will send a detailed Product/Service Classification page for each class that
the bidder has indicated they can supply. The bidder will indicate the appropriate subclasses of
items and return the documents to the Office of Purchasing and Travel. For more information,

                   STATE OF MISSISSIPPI OPEN MARKET PURCHASES


Open-Market Purchase. Commodities that are not covered by any state contract may be purchased
on the open market provided the agency follows the regulations set forth in Section 31-7-13,
Mississippi Code of 1972, Annotated. Vendors interested in selling to the agencies under these
procedures should contact the individual agencies which may have a need for the vendor’s products
or services. A list of the agencies is shown beginning on page 18. A brief summary follows:

     Purchases not in excess of $1500. An agency may purchase without receiving any written
     quotes; however, it is suggested that the agency contact at least two vendors to get verbal
     quotes.

     Purchases of more than $1500 and not more than $10,000. The agency is required to solicit
     and obtain at least two competitive written quotes.

     Purchases over $10,000. The agency is required to advertise for two weeks and should solicit
     written competitive sealed bids.

                                   QUESTIONS AND ANSWERS

Some common questions asked by vendors interested in doing business with the State of Mississippi.

1.   How do I get on the bidders list?

     To get on the Qualified Bidders List for the Office of Purchasing and Travel, you must register
     on-line or first submit a letter requesting to be placed on the list. You will then be sent the
     proper forms to complete and return. You will not be placed on the list until all forms have been
     completed correctly and returned.

2.   Does being on the Office of Purchasing and Travel's Bidders List mean that I will receive
     Invitations to Bid from all of the state agencies?

     No. As stated on page 1, the State of Mississippi does not have centralized purchasing. Being
     on the Office of Purchasing and Travel's Bidders List will only mean that you will receive
     Invitations to Bid on statewide contracts and on a few items put out for bid by the Office. To
     receive Invitations to Bid from all of the agencies and governing authorities, you will need to
     contact each individual purchasing office for their correct procedures.

3.   What if I have a product that is single source? How can I get it certified by the State?

     The State does not have the authority to declare any item as "single source." Each state agency
     and governing authority wishing to purchase such an item must submit a certification of the
     conditions and circumstances requiring the purchase. For state agencies, this certification must
     be submitted to the Office of Purchasing and Travel. Governing authorities must submit the
     certification to the board of their governing authority who may authorize the purchase, which
     authority shall be noted in the minutes of the body at the next regular meeting.

4.   What if no single item costs more than $1500, do they still have to get two quotes?

     Yes, the law defines "purchase" as the total amount of money encumbered by a single purchase
     order. The law also stipulates that it is unlawful to split purchases so as to appear to be
     authorized as purchases which do not require competitive bids.

5.   I want to sell computers, software, telephones, fax machines, and mobile radios. How do I get
     these items on state contract?

     The Office of Purchasing and Travel is responsible for contracting and supervision of all
     commodities, supplies and equipment with the exception of computer equipment, software,
     telecommunications equipment and two-way communication equipment. These items come under
     the jurisdiction of the Department of Information Technology Services (ITS). Their phone
     number is (601) 359-1395.

6.   I want to get on the Bidders List for construction, who should I contact?

     The Office of Building, Grounds and Real Property Management is responsible for much of the
     construction and renovation of state office buildings. Their phone number is (601) 359-3621.
     The projects which they do not handle are usually under the jurisdiction of the individual agency
     or department. A list of the various state agencies is included in this guide.

7.   Does the State have any preference laws which would give an advantage to a small business, a
     local business, or a minority-owned business?

     The State does not have any preference laws, except that if a vendor from a state which has a
     preference law is bidding in Mississippi, then that vendor shall be penalized by the amount his

     state would penalize a Mississippi vendor. There is also a preference for commodities made
     from recycled materials provided that the quality level is the same and that the product made
     from recycled material is not more than 10% higher than the low bid. There are also statutes that
     permit, but do not mandate minority preferences.

8.   I see that you have some commodities on contract, but you don't have what I sell. How do I get
     the State to put my commodity on contract?

     Due to a limited staff and in the absence of any accurate method for collecting purchasing data,
     the Office of Purchasing and Travel attempts to determine the common-use items and the items
     that can most efficiently and economically be purchased using the contract system. For a new
     commodity to be put on state contract, we normally rely on the various state agencies to notify us
     of a need. If enough agencies request that we put a commodity on contract, then we will begin
     the process of developing specifications and soliciting bids.
