Contingent Liability Insurance
This is not Professional Indemnity Insurance. It is expected that the NHS authority/employer would use their liability policy to defend their employee. It is designed as a Contingent Policy and would be used for example when the NHS authority/employer agrees with family members/parents who are suing the individual. Basically the employer would agree with the family’s claim for the individual’s misconduct and pursue the individual for misconduct.
Who Are Covered Individual Nursing, Auxiliary Nursing, Ambulance Crew, Health Visitors and Local Authority Professional Staff who are employed in the Local Health Authority (NHS Trusts), Social Care Workers in Residential and Nursing Settings, Care Home Workers, Independent and Voluntary Services and who are members of GMB Union.
Who Are Not Covered Individuals who are self employed (whole or part-time), or whose employer does not arrange cover, such as freelance first/surgical assistants. Doctors and Surgeons. Midwives not working for the National Health Service or working for a Fee. Any member who is working in the USA/Canada.
IT MUST BE MADE CLEAR THAT THE COVER IS PROVIDED AS A CONTINGENT INDEMNITY, AND IS NOT MEANT AS A PRIMARY INDEMNITY FOR THE MEMBERS. MEMBERS MUST BE EMPLOYED BY AN ORGANISATION THAT ARRANGES IT'S OWN LIABILITY INSURANCES. IT IS ASSUMED THAT IF AN INCIDENT OCCURS WITHIN A HOSPITAL/CARE HOME ETC, THEY WILL HAVE COVER IN PLACE FOR THEIR EMPLOYEES. THIS COVER IS IF THEY THEN BRING THE INDIVIDUAL MEMBER INTO ANY ACTION.

What Is Covered A.) Contingent Public Liability Legal Liability for damages in respect of 1. Accidental bodily injury, death, disease or illness of any third party person. 2. Accidental loss or damage to third party property Up to an indemnity limit of £2,000,000 including up to £250,000 Legal Defence Costs in respect of all costs and expenses arising out of all claims during the period. B.) Contingent Treatment Risks Cover A above is extended to include Indemnity against legal liability in respect of claims for Breach of Professional Duty consequent upon any Error or Omission in providing advice, treatment or prescription in the course of their duties. C.) Compensation For Court Proceedings - In the event of an insured person attending court as a witness in connection with a claim under Section A & B above - up to £250 per day D.) Central Council Proceedings Legal Defence Costs and Expenses for attendance at any proceedings before UK Central Council for Nursing, midwifery and Health Visiting or any equivalent competent Body in connection with a claim under this section up to a limit of £2,500 any one claim.
