In most cases the initial advice will be given free of charge and in over 95% of cases we will handle the legal work under a "no win no fee" agreement (also known as a conditional fee agreement). The personal injury group handles all types of personal injury claims including accidents at work, on the road or in public places. Members of the team have particular knowledge and experience in serious head injury cases, asbestos claims and medical accidents. Substantial awards have been obtained for head injury claims (in excess of £1,000,000) often including applications to the Court of Protection to appoint receivers. The team have also handled substantial criminal injury compensation claims with awards in excess of £100,000. EXPERIENCE The personal injury group deals with the following types of claim :       head injury cases brain injury cases, accidents on the road, in shops, in the street and in other public places industrial disease cases, including claims for mesothelioma and asbestosis medical accidents claims for compensation to the Criminal Injuries Compensation Authority applications to the Court of Protection for disadvantaged claimants

Two case studies where FSP acted for the injured party: Adult male, aged 23, sustained multiple life-threatening injuries when the car in which he was travelling as a front-seat passenger was involved in a high speed collision. The issue was raised as to his contributory negligence in accepting a lift from the defendant driver when it was alleged that the claimant was aware that the defendant had consumed alcohol, impairing his driving ability. A split trial on liability and quantum resulted in judgment for the claimant on liability at 90%. The claimant's injuries included a head injury, resulting in it being very unlikely he would ever work again and requiring long-term support. There was significant disagreement between the experts as to the extent and duration of that support. The claim was settled one week before trial at £1,350,000 gross. Adult male, sustained a head injury at his place of work resulting in his suffering an extreme psychological reaction and personality change. As a consequence of his injury the client had no recollection of the accident and there were no witnesses. The client's employers denied liability saying that without his being able to state precisely how the accident occurred he had no claim. Arrangements were made for a forensic engineer to inspect the workplace and report on the possible causes of the accident. On receipt of his report, the employers said that if the accident occurred as the engineer believed it was caused by the client's errors. The client entered into a "no win, no fee" agreement and Court proceedings were brought against his employers. When the claim was near trial, the employers made an offer of settlement and following negotiations the claim was settled for £90,000.
