SUBJECT: Notice of Failure to Negotiate Agreement with Camp Dresser & McKee, Inc. for FY2001 Miscellaneous Plant Improvements Project Approved by EC-02-357 Pursuant to Section 14-7-2-6(E) of the Selection Advisory Committee Ordinance, R.O.A. 1994, formal notification is hereby provided to City Council that the Mayor is unable to negotiate a satisfactory services agreement with Camp Dresser & McKee, Inc., the first ranked proposer for Project No. 6844, FY2001 Miscellaneous Plant Improvements. The top three proposers in ranked order were approved by City Council on January 1, 2003 (EC-02-357). The negotiations with Camp Dresser & McKee, Inc. have been formally terminated based on unreasonable cost as indicated in the attached termination letter dated May 23, 2003. Since an agreement cannot be negotiated with the first ranked proposer, the Mayor will undertake negotiations as soon as practicable with proposer number 2, Wilson & Company, as provided in Section 14-7-2-6(D) R.O.A. 1994. This recommendation is being forwarded for Council consideration and action.
