PATENT & TRADE INFRINGEMENT WARRANTY NON MERCHANTS Seller, in granting the warranty against infringement, stipulates that seller is not a merchant regularly dealing in the kind of goods covered by this agreement. Buyer, who __________ (is or is not a merchant) regularly dealing in the kind of goods covered by this agreement, is aware of seller’s non merchant status. This is a UCC-buying and selling provision.
