              NOTICE OF HEARING ON THE FINAL ASSESSMENT ROLL

                        LOCAL IMPROVEMENT DISTRICT NO. 20
                            (SOUTH ISLAND SEWER LID)

       NOTICE IS GIVEN that the final assessment roll for Local Improvement District No.
20 (the “District” or the “LID”), established for the purpose of improving four neighborhoods
and an elementary school site within the City by the construction and connection of sanitary
sewer facilities (the “Improvements”), as ordered by Ordinance No. 2003-38, of the City of
Bainbridge Island, Washington (the “City”), passed October 8, 2003, has been prepared as
required by law and is on file and open to inspection at the office of the City Clerk at City Hall,
280 Madison Avenue North in Bainbridge Island, Washington.

        NOTICE FURTHER IS GIVEN that the City Council by Resolution No. 2006-36,
passed August 9, 2006, has appointed a Hearing Officer and set the time for the hearing upon the
final assessment roll to commence at 6:00 p.m., local time, on October 10, 2006, in the Council
Chambers at City Hall, 280 Madison Avenue North in Bainbridge Island, Washington.

        Any person desiring to object to any assessment appearing on the final assessment roll for
the District is notified to make all objections in writing and to file them with the City Clerk at or
prior to the date fixed for commencement of the hearing on the final assessment roll. All
objections must state clearly the grounds of the objections and should contain lot, block and
addition, section, tax number, or other identifying description of the property.

       At the time and place fixed, and at such other times to which the hearing may be
continued or adjourned, Hearing Officer Rodney Kerslake, will conduct the hearing for the
purpose of considering objections duly filed, together with all information and evidence
presented, and for the purpose of considering such assessment roll.

        Following completion of the hearing, the Hearing Officer shall make recommendations to
the City Council to correct, revise, raise, lower, change, or modify the roll or any part thereof, or
set aside the roll and order a new assessment to be made de novo, or that the City Council adopt
or correct the roll or take other action on the roll as appropriate, including confirmation of the
roll without change.

       Property owners who timely filed proper written objections to their proposed assessments
will be notified of the Hearing Officer’s recommendations and have 10 calendar days after the
mailing of such notice to file with the City Clerk a notice of appeal to the City Council if they
wish. After due consideration of such appeals and completion of the appeal process, the City
Council will confirm the assessment roll by ordinance after making any changes it may deem
appropriate.
        When property has been entered originally upon the roll, and the assessment thereon is
not raised, no objection shall be considered by the City Council or by any court on appeal unless
the objection is made in writing at or prior to the date fixed for commencement of the hearing
upon the roll.

       Personal notices of the hearing providing the details and amounts of individual
assessments are being mailed to affected property owners in the manner prescribed by law.
