CHARGING ORDER To: Manager, LLC
1. This Charging Order is issued in the name of the State of _________ and accordingly you are charged as garnishee until further order of this Court. The above Plaintiff and Judgment Creditor has a judgment against the above named Defendant and Judgment Debtor. Currently the amount still due and owing on said judgment is ________ plus interest and costs. The Plaintiff and Judgment Creditor has named you as a limited liability company having possession or control of property, effects, credits or earnings of the named Defendant the Judgment Debtor, to-wit: said Defendant and Judgment Debtor is a member of LLC and periodically receives from this limited liability company economic distributions, capital, income and or wages. 2. As a holder of economic interest of said Defendant and Judgment Debtor's membership interest, you are advised that you are attached as garnishee of the above Defendant and Judgment Debtor pursuant to ____________. This Charging Order is a levy upon economic distributions, capital, income payments or wages to the Defendant Judgment Debtor. This Charging Order applies to all economic distributions, return of capital, income or wages due to the Defendant Judgment Debtor and those of the Defendant Judgment Debtor due in the future until the judgment, interest and costs have been paid in full or until further order of this Court. 3. One copy of this Charging Order shall be furnished by you to the Judgment Debtor the first time a distribution is due the Judgment Debtor. At that same time, you shall give the Judgment Debtor a copy of your Answer to Charging Order. 4. You shall pay over all distributions withheld pursuant to this Charging Order to the Clerk of Court. You shall file with the Clerk of Court a verified Answer to Charging Order no later than 10 days following the date the Judgment Debtor was to receive a distribution of any economic interest from the LLC. For each successive garnishment of the Judgment Debtor as required by this Charging Order, you shall file successive verified Answers to Charging Order with the Clerk of Court no sooner than five days nor more than ten days, excluding
