PART 5318 Emergency Acquisitions
[Revised March 14, 2007] SUBPART 5318.1 — AVAILABLE ACQUISITIONFLEXIBILITIES 5318.104 Unusual and compelling urgency. The Life Cycle Management Plan (LCMP)/Single Acquisition Management Plan (SAMP)/Acquisition Plan (AP) approval authority is authorized to sign and approve the Determination and Findings (D&F) required by FAR 6.202(b)(1). 5318.2 EMERGENCY ACQUISITION FLEXIBILITIES 5318.201 Contingency Operations. (1)(a) Selection, appointment, and termination of contingency contracting officer appointment. See Appendix CC-203, Selection of contingency contracting officers, and CC-204, Appointment of contingency contracting officers. See also AFFARS Library Appendix CC - Contingency Contracting. (1)(B) Delegation from head of the agency to Heads of Contracting Activities (HCAs) for micropurchases and simplified acquisitions of supplies or services as used in support of a contingency operation or to facilitate defense against or recovery from nuclear, biological, chemical, or radiological attack. See 5313.003(i) and 5301.601(a)(i)(A)-(D). (9) Authorization Acts, Appropriation Acts, and other statutory restrictions on foreign acquisition. When the contracting officer determines, through market research, that an article or suitable substitute is not available from a domestic source the contracting officer shall submit a determination and finding (D&F). See 5325.7002-2(b), and MP5325.7002-2.
