GUIDELINES V How to obtain exemption from Compulsory Service Background On 2 September 2004, the Registration of Pharmacists (Amendment) Act 2003 [Act A1207] comes into operation. Under Section 11C of the Act, pharmacists are required to serve in the public services and for a continuous total period of not more than three years [Section 11D]. However exemptions form the compulsory service can be granted to certain individuals or groups of individuals and at the present moment these are: 1. any person whose name appeared in the register under the principal Act immediately before 2nd September 2004 [Section 12(1) of the Act A1207] 2. any person who is undergoing apprenticeship and training immediately before 2 nd September 2004 [ Section 12(2) of the Act A1207] 3. any person who is registered or undergoing pre-registration training overseas before 2nd September 2004 in countries with pharmacy degrees which the Pharmacy Board of Malaysia [PBM] recognises 4. any person who holds a basic pharmacy qualification recognised by PBM and who holds a Ph. D qualification in pharmacy. 5. any person who holds a basic pharmacy qualification recognised by PBM and who holds a qualification of the Board of Pharmaceutical Specialties, United States of America Procedure For Application For Exemption From Compulsory Service A. For those who have not been registered overseas or have not completed their apprenticeship and training [ pre-registration training ] overseas A1. If the applicant in from group 4 or group 5 above who has not been registered overseas or has not completed their apprenticeship and training [pre-registration training], he has to apply to the Pharmacy Board of Malaysia [PBM] for provisional registration on Form 1 of the Registration of Pharmacists Regulations 2004. A2 The applicant should also at the same time apply to the Pharmaceutical Services Division, Ministry of Health Malaysia for exemption from compulsory service with justification. There are no fixed forms for this. However the applicant should submit documentation to justify the application for exemption. On completion of the training, the applicant can apply for full registration on Form 5 of the Registration of Pharmacists Regulations 2004. The Ministry of Health Malaysia will issue letters confirming the exemption from compulsory service for those eligible. B. For those who have been registered overseas or have completed their apprenticeship and training [ pre-registration training ] overseas B1 If the applicant is or has already been registered overseas or has already completed their training, he should apply to the Pharmacy Board of Malaysia [PBM] for full registration on Form 5 of the Registration of Pharmacists Regulations 2004.
