                                                2003
             Australian Capital Territory   November 19       Removal of exemptions from the
                                                              Smoke-free Areas (enclosed Public
                                                              Places) Act 1994 and a phase out of
                                                              smoking in ACT restaurants and
                                                              licensed premises (ban smoking in
                                                              pubs and clubs) by December 2006.1

                      South Australia       November 27       Phased bans will apply to licensed
                                                              venues. Public places smokefree by
                                                              1 October 2007.2

                                                2004
                         Queensland         September 6       Indoor areas of liquor licensed
                                                              premises smokefree by 1 July 2006.

                                                              Ban smoking in all outdoor areas
                                                              where food or beverages are served
                                                              and are contiguous to the operations
                                                              within a business by 1 July 2006.

                          Tasmania          September 22      Tasmanian Premier, Paul Lennon,

Northern Territory                    Northern Territory has no proposed legislation and no announcement as yet.7

Western Australia                     Western Australia has no proposed legislation as yet, however, Jim McGinty
                                      announced in July 2004 that he would push for a ban on smoking in all
                                      venues.7

                                      Western Australia has brought forward by two years to December 2005 the
                                      review of its current regulations.8 A total ban in licensed premises will be
                                      considered in that review.

                                      Public record statements
                                      The Hon. Sue Ellery Parliamentary Secretary to the Minister for Health said in
                                      Parliament on Wednesday 5 May 2004:

                                              The Government has given a commitment that the review of part IXB of the Health
                                              Act 1911 and of the Health (Smoking in Enclosed Public Places) Regulations 1999
                                              … is now scheduled to be conducted and is to report by December 2005. … the
                                              terms of reference …

                                              1. Determine the effectiveness of the Act and the Regulations, in protecting the
                                              community from environmental tobacco smoke in enclosed public places, through
                                              consultation with the community, industry and the health sector.
                                              2. Determine the effectiveness of the Regulations, in relation to compliance and
                                              enforcement of provisions of the Regulations, through consultation with the
                                              community, industry and the health sector.
                                              3. Provide advice to the Minister for Health in relation to the operation and

                                              effectiveness of the Regulations and such further action as may be appropriate.

                                      On 28 July 2004, the West Australian reported that Jim McGinty, the Health
                                      Minister, said that the government put the entertainment industry on notice that
                                      it would push for a ban on smoking in all venues in 2005.9

                                      On 13 October 2004, ABC News reported that the Western Australian
                                      Government may move with the rest of Australia towards smoke free enclosed
                                      environments in the wake of plans for tough smoking restrictions in New South
                                      Wales and Victoria.10
